HomeMy WebLinkAboutAgenda Statement 1977/10/25 Item 11CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT Item No. 11 For meeting of 10/25/77 ITEM TITLE Resolution 8861 - I~termining that the Division and Develognent of E1 Rancho del Rey will not Unreasonably Interfere with the Free and Complete Exercise of the Public Entity or the San Diego Gas & Electric Company's Easement SUBMITTED BY City Attorney ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES- NO X ) The Subdivision Map Act requires the signature of all public utilities which own real property easements in the area to be subdivided. In lieu of this signature requirement, the City Council may, under Section 66436 of the Government Code, pass a resolution determining that the division and development of the property in the manner set forth on the final map will not unreasonably interfere with the exercise of the public utility's easement and the signature of the public utility may be omitted. San Diego Gas & Electric has indicated to us that they do not object to the establishment of an open space maintenance district for E1 Rancho del Rey Unit No. 5, but that they prefer not to sign the map because they are afraid that this might be construed by some parties as a subordination of their easement to the open space use of the land. They have further indicated that they will waive the right of appeal and their time for appeal.
