C. Glad Properties and the City for construction of drainage improve- ments across a portion of their property. The agreement provides that E. C. Glad Properties will construct the improvements across their property at a cost of $225 per lineal foot to the City. Glad for construction of drainage improvements SUBMITTED BY Director of Public Works/City Engineer a G~ ITEM EXPLANATION (4/5TN'S VOTE REQUIRED YES NO x) E. C. Glad Properties, a Limited Partnership, has submitted a proposal to the City for them to construct a drainage culvert across their prop- erty with financial participation from the City of Chula Vista. In order to develop his property on Park Way for apartment units, E. C. Glad has constructed a double 6'x 5'box culvert along the Park Way front- age of his property and also along the westerly property line for approxi- mately half the distance of his lot. The flow then leaves his property and goes in a privately constructed 5'x 4'box culvert in a southwesterly direction underneath other apartment buildings to the culvert in "G" Street. (See attached sketch.) This culvert is undersized, is not con- structed to City standards or under City inspection, and appears to not have adequate steel reinforcing. The C.I.P. Committee has programmed a drainage project for the 1978-79 fiscal year C.I.P. Program to build a box culvert from the end of Mr. Glad's box culvert across the remainder of his property to "G" Street, and then proceed westerly in "G" Street to the existing box culvert crossing "G" Street. That project also includes constructing a culvert of adequate size from the beginning of the E. C. Glad culvert in Park Way proceeding easterly in Park Way to join an existing open drainage ditch on the north side of Park Way just westerly of Fifth Avenue. Mr. Glad's request will, if approved, move ahead a small portion of that 1978-79 project to this current fiscal year. C. Glad and have developed the following arguments for and against construction of the requested cul- vert at this time: Arguments for: 1. Based upon recent bids for drainage projects, Mr. Glad's proposal is approximately $6,750 below what the City could get the project for. That is $37,125 versus the $30,375 that he has agreed to do it for. The main reason for this is that he would coordinate the excavation for the culvert in conjunction with his development of the property. 2. The alignment of the storm drain presently is in an unpaved, unland- scaped area. He is presently completing the improvements on his lot so that at a later date, when the City would normally propose to do the project, the alignment will be in a paved area in a nar- row driveway between buildings and walls. The project would then cause inconvenience to the people in the area and will also cost more, due to pavement replacement and so forth. 3. There is a two-story building just being completed by Mr. Glad that is very close to the trench proposed for the drain. Were Mr. Glad to build the drain, then they would become liable for any damage that may be experienced by this building due to trench failure. At a later date, under a City contract, the City of course would assume any liability due to trench failure. 4. There are flooding problems in this stretch of the basin now. As stated, the C.I.P. Committee has programmed this for submittal to the Council for next year's C.I.P. budget. Therefore, the City would be installing a needed facility close to the intended schedule. 5. The 5' x 4' box culvert underneath the apartment ~o the west of this project is a private box culvert that was built without the benefit of City plan checking or inspection, is caay undersized, and I believe it is unsuitable for a permanent part of the drain- age system. 6. Mr. Glad has indicated he would be willing to give the City an easement for this proposed storm drain culvert if the City enters into an agreement at this time. If the City does not enter into an agreement at this time, due to the inconvenience to his per- spective tenants, he may not be as cooperative in dedicating an easement to the City free of charge. Arguments against: 1. A large sum of money ($30,375) would be expended at this time with- out the opportunity of competing on a city-wide basis with other projects. 2. Since we are only building a portion of the total project, this portion of the drain will not be usable until the rest of the proposed City project for fiscal year 1978-79 is completed. Therefore, funds will be expended that will not be able to be used for possibly a period of a year. 3. Even though we believe we were given an excellent cost estimate by E. C. Glad, we really do not know, through the advantage of a public bid, whether we have the best price under market conditions. Due to the pressures of inflation, inconvenience to the prospective residents in the new development, and the cost savings given to the City by E. C. Glad, I believe the advantages for doing this project outweigh the disadvantages; and I recommend that the City enter into an agrement to construct the storm drain at this time. i; `_l, C i. E. C. We feel at this time that the drainage ditch should be extended from the culvert we are now constructing to "G" Street. This extension falls within the City's six-year capital improvement plan. Our reasoning for this exten- sion at this time is as follows: S^7e have been quoted a price of $275 per foot for the culvert we are now building, however, E. C. Glad Properties can do the same work for $225 per foot. With the price differential, we will consider a small donation to the improvement of our City. The advantages of extending the drainage ditch at this time are as follows: 1) We will alleviate any future problems involved in digging up the black top and changing the culvert now under construction. 2) The City will avoid the cost increase due to inflation in the next 1- 2 years. The cost will also be reduced since there is no existing pavement to be torn up and replaced. 3) Quality of construction will be identical. 4) The inevitable inconvenience and noise disturbance, etc., to the residents of the project and their neighbors will be avoid- ed if the work is accomplished now rather than after the project is occupied. Mr. John Lippitt August 25, 1977 Page Two RE: Parkway Townhouse Drainage Easement We would like to form a joint venture with the City to cover the cost of construction at this date. As expressed above, we will donate $50 per foot to the City of Chula Vista with the City pay- ing the remainder ($225 per foot) to us, covering our expense for material and labor in construction of extending the culvert. For the reasons stated above, we feel that it would benefit both the City and the taxpayers financially and less inconvenience to the future owners to do so at this time.
