Mr. V. Norman Rains, the owner of property at 4392 Acacia Avenue, has applied
for an encroachment permit to allow continued encroachment of an existing
fence and small corral into Lot 117 of Bonita Ridge Estates, Unit No. 2
Subdivision. Lot 117 is City owned property which was dedicated to and ac-
cepted by the City for open space purposes at the time the subdivision map
for Bonita Ridge Estates, Unit No. 2 Subdivision was approved by the City
Council.
The encroachment of the structures occurs at the rear of Mr. Rains' property.
The existing structures encroach approximately 11 feet along Mr. Rains'
easterly property line and approximately 0.5 feet along Mr. Rains' westerly
property line.
The Director of Parks and Recreation has no objections to the continued en-
croachment of the structures. Permitting the structures to remain will not
pose any problem at this time, and the encroachment permit will contain a
clause that the encroaching structures must be removed at the owner's expense
upon 30 days notice from the City of Chula.
Section 12.28.020 of the Chula Vista Municipal Code requires that encroach-
ments of this type be authorized by a resolution from the City Council.
