Mr. W. N. Ahrens, the owner of property at 4316 Acacia Avenue, has
applied for an encroachment permit to allow continued encroachment
of an existing wood shed, fences and a grass volleyball court into
Lot 140 of Bonita Ridge Estates, Unit No. 3 Subdivision. Lot 140 is
City owned property which was dedicated to and accepted by the City for
open space purposes at the time the subdivision map for Bonita Ridge
Estates, Unit No. 3 Subdivision was approved by the City Council.
The encroachment of the structures occurs at the rear of Mr. Ahrens
property. The existing structures encroach approximately 40 feet along
Mr. Ahrens easterly property line and approximately 20 feet along Mr.
Ahrens westerly property line.
The Director of Parks and Recreation has no objections to the continued
encroachment of the structures. Permitting the structures to remain will
not pose any problem at this time, and the encroachment permit will con-
tain a clause that the encroaching structures must be removed at the
owner's expense upon 30 days notice from the City of Chula Vista.
Section 12.28.020 of the Chula Vista Municipal Code requires that
encroachments of this type be authorized by a resolution from the City
Council.
