A Public Hearing was held on May 24, 1977 to hear persons speaking in favor of or against the proposed easement vacation. Upon conclusion of the Public Hearing, the City Council directed that a resolution be brought back to the City Council order- ing the vacation of the easement. The resolution ordering the vacation of the easement has been held in abeyance until the developer and property owner, Dunphy Construction Co., relocated the sewer main and water main to a new location and dedicated a new easement for these relocated facilities. The developer has con- structed a new sewer main and water main within a new easement located along the boundary between Lots 10 and 11 in Block 2 of Sweetwater Industrial Park. The sewer main was accepted by the Director of Public Works on August 30, 1977. The property owner, Dunphy Construction Co., has executed a document which grants a new sewer easement to the City of Chula Vista. Since the developer has completed the construction of a new sewer main and water main, and has dedicated to the City the required sewer ease- ment, it is therefore appropriate for the City Council to adopt a resolution ordering the vacation of the old sewer easement crossing Lots 11 and 12.
