The permit was processed through Engineering. The staff, through an oversight, did not discover the presence of an existing 8 inch sewer main in conflict with the swimming pool construction. The existing sewer main was dis- covered subsequent to the excavation for the pool. If staff had discovered the presence of the sewer prior to the issuance of the building permit, the property owner would have been required to relocate the pool so that it was not in conflict with the sewer or relocate the sewer main at his expense. Another alternative would have been for the property owner to request the granting of an encroachment permit to construct the pool over the existing sewer. Since the City has issued a building permit and the property owner has proceeded with the pool construction in good faith, Engineering staff feels that it would now be inappropriate for the City to require the property owner to relocate his pool or relocate the sewer at his expense. Engineering staff has met with Mrs. Earl Turner, the property owner, and Mr. Chris Stevens, of Anthony Pools, the Contractor, to discuss an acceptable alternative to all parties so that construction of the pool can proceed and yet assure adequate protection for the public sewer main. Based upon these discussions and the field investigation, Engineering staff is recommending that an encroachment permit be issued to Mr. and Mrs. Earl Turner for the construction of the swimming pool over the KJG•et FY 005 (Continued on Supplemental Page 2) tXH1~115 Agreement Resolution x Ordinance Plat x Notification List Other ENVIRONMENTAL DOCUMENT: Attached Submitted on FINANCIAL IMPACT The City will bear the cost of labor and materials for the installation of the encasement around the existing sewer. Estimated cost for materials is $150 to $200. The encroachment permit should be issued with the following conditions: 1. The existing 8 inch vitrified clay sewer main shall be encased with Portland cement concrete in accordance with Chula Vista Standard Drawing No. 306. City forces will encase the sewer. Approximately 40 feet of the existing sewer is in conflict and will lie below the proposed swimming pool. The cost of materials for encasing this 40 feet of sewer will be approximately $150 to $200. It is Engineer- ing staff's opinion that encasement of the sewer will be sufficient and adequate protection for this facility. 2. The bottom of the swimming pool will be raised such that it is above the top of the sewer main and encasement. All over excavation and voids will be backfilled with air blown mortar to ensure that there will be no settlement or cracking of the pool shell. 3. Installation of the swimming pool shall in no way interfere with the existing sewer. Any changes made to the sewer because of the swim- ming pool installation shall be at the sole expense of the property owner. 4. Maintenance, removal, or relocation of the swimming pool shall be the sole responsibility of the permittee, leasee, or the representa- tive of the owner, or leasee, or his successor in interest, at no expense to the City of Chula Vista. 5. Installation of the swimming pool shall conform to the standards of the City of Chula Vista. Since the construction of the swimming pool over the existing sewer main represents a permanent encroachment, Chapter 12.28 of the Chula Vista Municipal Code requires that the issuance of an encroachment permit for a permanent encroachment be approved by the City Council prior to the issuance of the permit by the Director of Public Works. Mrs. Earl Turner has made application for and paid the required application permit fee as required by the City Code.
