HomeMy WebLinkAboutAgenda Statement 1977/08/23 Item 09~~ ~" CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT Item No. 9 For meeting of 8/23/77 ITEM TITLE Resolution 8793 Declaring City's Intention to Vacate Mankato Street Between Third Avenue and Garrett Avenue ~~ SUBMITTED BY Director of Public Works/City Engineer ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES NO x) On June 8, 1977, Project Design Consultants, on behalf of their client, the County of San Diego, submitted a request to the Director of Public Works to vacate Mankato Street between Third Avenue and Garrett Avenue. This portion of Mankato Street lies within the project area for the proposed South Bay Regional Court Facility. In order to proceed with this project, Mankato Street must be vacated. The request to vacate Mankato Street is in accordance with Resolution 8578, adopted by the City Council on April 12, 1977, endorsing the Superior Court Facility in the San Diego South County Regional Center. The Street Vacation Act of 1941, in accordance with the California Streets and Highways Code, requires that a public hearing be held to hear people in favor of or objecting to the proposed street vacation. Peterson, Director of Planning Subject: Vacation of Mankato Street from Third Avenue to Garrett Avenue At the meeting of August 10, 1977 the City Planning Commission considered a request submitted by Project Design Consultants on behalf of the County of San Diego to vacate Mankato Street between Third Avenue and Garrett Avenue The Planning Commission considered and certified the Environmental Impact Report (EIR-76-18-82) on the project, which was adopted by the. County Board of Supervisors, and made the following findings of fact with respect to the vacation of Mankato Street: 1. Condition No. 5 approving tentative parcel map 13-77 requires that Mankato Street between Third Avenue and Garrett Avenue be vacated prior to approval of the final parcel map. 2. As a condition of development, the County of San Diego will install additional street improvements to provide the required capacity and circulation of traffic flow about the South County Regional Center. Mankato Street will not be essential to providing circulation to the site nor to areas adjacent to the project. 3. It is highly desirable to vacate Mankato Street in order to achieve flexibility in site building and circulation design and to avoid an arbitrary division of the site by a minor street. 4. All utility companies have been notified and have requested that ease- ments be preserved for their existing facilities lying within that portion of Mankato Street to be vacated. If easements are provided for their facilities, the utility companies have no objections to this street vacation. Upon vacation of Mankato Street, the underlying fee will revert to the adjacent property owner. The Planning Commission recommends that Mankato Street be vacated from Third Avenue to Garrett Avenue.
