RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VI5TA APPROVING PRECISE PLAN FOR 17 GARDEN APARTMENT
UNITS AT 436-440 L STREET I1`d THE R-3-P-14 ZONE, AND
CERTIFYING THE NEGATIVE DECLARATION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council of the City of Chula Vista has
heretofore received the recommendation of the Planning Commission,
as contained in Resolution No. PCM-78-2, adopted on the 10th day of
August, 1977, setting forth the precise plan for 17 garden apart-
ment units at 436-440 L Street in the R-3-P-14 zone, and
WHEREAS, the City Council of the City of Chula Vista has
heretofore held a public hearing to consider said precise plan on
September 6, 1977, and has taken testimony and heard evidence
thereon, and
WHEREAS, a notice of the proposed negative declaration on
said precise plan was given in accordance with the Environmental
Review Policy, and
WHEREAS, the Environmental Review Committee found that
said precise plan would have no possible significant impact on the
environment and forwarded the attached negative Declaration, IS-78-6,
to the City Council of the City of Chula Vista for their considera-
tion, and
WHEREAS, said Negative Declaration has been available to
agencies having jurisdiction by law, all responsible agencies, and
to the public for an adequate period of time for their review and
comment, and
WHEREAS, the information contained in said negative declar-
ation has been considered by the City Council of the City of Chula
Vista prior to its action on the discretionary item before the City
Council.
NOW, THEREFORE, the City Council of the City of Chula Vista
finds as follows:
1. That the City Council of the City of Chula Vista adopts
as its record of this finding of no possible significant impact the
Council agenda statement on this agenda item and all of the attach-
ments thereto.
2. That the City Council of the City of Chula Vista finds
in accordance with the recommendation of the Environmental Review
Committee and the attached Negative Declaration that said precise
plan will not have any possible significant impact on the environ-
ment, and the attached Negative Declaration, incorporated herein
by reference as if set forth fully, has been prepared in accordance
with the California Environmental Quality Act of 1970, as amended.
3. That the Environmental Review Coordinator is hereby auth-
orized and directed to file said Negative Declaration with the County
Clerk of the County of San Diego subsequent to the preparation of a
notice of determination on this project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approve the precise plan for
17 garden apartment units at 436-440--L Street in the R-3-P-1~ zone
in accordance with Resolution No. PCM-78-2 of the Chula Vista
Planning Commission.

A. Project Setting
DATE: July 28, 1977
The project site involves 1.25 acres of property located at 436-440
L St. and is currently developed with one single family and two 2-
family dwellings. Adjacent land uses include single family homes and
vacant parcels, all located within the R-3-P-14 zone. L St. which
has an ADT volume of about 18,000 vehicles is adjacent to the north
and provides access to the site. -~
Urban support systems in the area are generally adequate to support
the proposed project, although the local elementary and jr. high
schools are currently overburdened.
The site is not subject to inundation, nor are there any known
geologic hazards or adverse soil conditions nearby. The property
appears void of any significant vegetation or wildlife, though, there
are several Calif. & Brizilian Pepper trees and a mature Poplar
onsite.
B. Project Description
The applicant proposes to construct a garden apartment complex which
will consist of one single story and two level buildings. The complex
will provide 17 two bedroom apartment units, patios a garden court
with recreational facilities including a recreation room, sauna
and Jacuzzi, parking facilities for 34 vehicles will be provided.
About 45$ of the site will be landscaped or devoted to open space.
The applicant also proposes the installation of flat plat solar
collectors for use in hearing water for residential use. This project
will be the first new construction of its type to utilize solar
energy within Chula Vista.
C. Compatibility with zoning and plans
The project site is being annexed to the City of Chula Vista. The
proposed precise plan is in conformance with the guidelines for the
R-3-P-14 zoning and is not at variance with the medium residential
density prescribed by the land use element of the general plan.
D.. Identification of environmental effects
Noise
A SWING noise analysis of existing traffic volumes on L St. was
conducted to determine potential noise exposure. The analysis
indicated that structures located 100+ feet from the roadway would
be subjected to noise levels of 60dB or less eminating from passing
vehicle traffic.
Since conventional construction will reduce interior noise intrusion
by 15+dB the required dwellinglnsolation of 45dB will be achieved
and no mitigation will be necessary.

The local senior high school is presently capable of accommodating
the projected increase in students, however, Chula Vista Jr. High
and Rice Elementary have exceeded capacity by 80 and 116 students
respectively.
Developers fees required by the appropriate school districts will
insure facility for new students until additional schools are
constructed, boundary changes implemented or a reduction in the overall
enrollment occurs.
E. Mitigation measures necessary to avoid significant impact.
1. Developers fees to appropriate school districts will be
required.
2. The Director of Public Works should '.review the drainage
plans to insure no problem is created.
F. Findings of insignificant impact
1. The project site is void of any significant natural or man
made resource and there are no geologic hazard or adverse soil
conditions known to be present in the immediate vicinity.
2. The proposed project conforms to the long range goals of
the City of Chula Vista and the precise plan process will
insure compatibility with adjacent land uses.
3. The urban infrastructure is generally adequate to accommodate
the proposed apartment complex; impact on educational facilities
can be mitigated to an acceptable level.
4. The project will not cause any substantial increase in
ambient noise levels and no significant source of hazardous
emissions will result.
