SUMMARY
The City of Chula Vista has provided animal care and animal control services to the cities
of Lemon Grove and Imperial Beach as well as animal care services to National City for
many years. In the spring of 2009 City of Chula Vista staff entered into negotiations with
the staffs of these cities to update the language of the respective agreements to include
the goal of providing full cost recovery for services provided by Chula Vista. This action
would extend for one year the updated agreements with Lemon Grove, National City and
Imperial Beach.
ENVIRONMENTAL REVIEW
The City's Environmental Review Coordinator has reviewed the proposed activity for
compliance with the California Environmental Quality Act (CEQA) and has determined
that the activity is not a "Project" as defined under Section 15378 of the State CEQA

Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the
activity is not subject to CEQA.
RECOMMENDATION

DISCUSSION
City of Chula Vista staff has agreements with the cities of National City, Lemon Grove
and Imperial Beach to provide animal care and animal control services. The agreements
contain provisions for multiple one-year extensions.
The agreements are intended to provide full cost recovery to Chula Vista for the services
rendered. The cost for animal control services is based on the actual cost of the services
included in the scope of services covered by the agreements. Animal care services are
those required to kennel animals from Chula Vista and the three client cities. The annual
cost to be paid by each city is determined by apportioning the projected costs for each
succeeding fiscal year based on the relevant proportion of animals coming from each of
the four cities during the previous calendar year. For Fiscal Year 200 1 1/2 01 2, the three
client cities were notified of the relevant cost for services in March 2011.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is
not site specific, and consequently the 500 foot rule found in California Code of
Regulations section 18704.2(a)(1) is not applicable to this decision.
CURRENT YEAR FISCAL IMPACT
These agreements are structured to achieve full cost recovery for the services rendered
such that there should be no net fiscal impact to the City of Chula Vista General Fund.
ONGOING FISCAL IMPACT
These agreements are structured such that the costs will be updated annually to
incorporate the projected costs for each subsequent fiscal year. These revenues are
reflected in the FY 2011/2012 proposed budget.

WHEREAS, the City of Chula Vista has been providing Animal Care and Animal Control
Services to the City of Lemon Grove for several years, and
WHEREAS, the City of Lemon Grove desires to continue to receive these services from the City
of Chula Vista, and
WHEREAS, the City of Chula Vista desires to continue to provide these services to the City of
Lemon Grove.
NOW THEREFORE BE IT RESOLVED THAT THE City Council of the City of Chula
Vista does hereby approve a one year extension of the agreement with the City of Lemon Grove
for animal care and animal control services and authorizes the Mayor to execute the agreement
on behalf of the City.

Dear Scott:
I am in receipt of your letter dated March 15, 2011 regarding the agreement
between the City of Chula Vista and the City of Lemon Grove regarding animal
control services. The purpose of this letter is to inform you that the City of Lemon
Grove agrees with the proposal to extend the agreement for one more year-
between July 1, 2011 and June 30, 2012-for the amount set forth in your March
15, 2011 letter.

This First Amendment to the Agreement is entered into this 1~~ day of June 2011, by and between
the City of Chula Vista, a chartered municipal corporation of the State of Cal'fornia, and the City of
Imperial Beach, a municipal corporation of the State of California. The City of Chula Vista and the City of
Imperial Beach may be referred to collectively as "Parties."
RECITALS
A. The Parties entered into an Agreement on November 23, 2010 (the "Agreement"), wherein
the City of Chula Vista agreed to provide animal shelter and on call control services for the
impounding, adoption, redemption, and the care and disposition of dogs, cats, and other
small animals for the amount of $174,078.40 for the remainder of Fiscal Year 2010-11.
B. The Agreement provides the City of Imperial Beach an option to extend the Agreement for
two (2) additional one (1) year terms.
C. The Parties now desire to amend the Agreement dated November 23, 2010, to provide
the City of Imperial Beach the option to extend the term of the Agreement for two (2)
additional fiscal years instead of calendar years.
D. The Parties now desire to extend the term of the Agreement through Fiscal Year 2011-
2012, beginning July 1, 2011 and ending June 30, 2012, for a total of $212,655.
E. The City of Imperial Beach desires to amend the Agreement such that the City of Chula
Vista will provide animal control services to Imperial Beach four (4) days per week,
NOW, THEREFORE, the Parties agree that the Agreement entered into on the 23rd day of
November, 2010, shall be amended to provide the City of Imperial Beach the option to extend the
Agreement for two (2) additional fscal years.
The Parties further agree to extend the term through Fiscal Year 2011-2012, beginning July
2011 and ending June 30, 2012, for a total amount of $212,655 and to add animal control services four
(4) days per week.
The parties further agree that with the foregoing exceptions, each and every term and provision
of the Agreement dated November 23, 2010, shall remain in full force and effect.

This First Amendment to the Agreement is entered into this 19`~ day of April 2011, by and
between the City of Chula Vista, a chartered municipal corporation of the State of Califomia, and the City
of National City, a municipal corporation of the State of California ("National City"). The City of Chula
Vista and the City of National City may be referred to collectively as "Parties."
RECITALS
A. The Parties entered into an Agreement on April 6, 2010 (the "Agreement"), wherein the
City of Chula Vista agreed to provide animal shelter and control services for the
impounding, adoption, redemption, and the care and disposition of dogs, cats, and other
small animals for the not to exceed amount of $377,730.00 for Fiscal Year 2010-2011.
B. The Agreement allows the City of National City the option to extend the Agreement for
one-year terms each fiscal year, up to four such extensions.
C. The Parties now desire to amend the Agreement dated April 6, 2010, to extend the term
of the Agreement for an additional year, through Fiscal Year 2011-2012, beginning July
1, 2011 and ending June 30, 2012, for a total not-to-exceed amount of $317,733.
NOW, THEREFORE, the Parties agree that the Agreement entered into on the 6th day of April,
2010, shall be amended to extend the term through Fiscal Year 2011-2012, beginning July 1, 2011 and
ending June 30, 2012, for a total not-to-exceed amount of $317,733.
The parties further agree that with the foregoing exception, each and every term and provision of
the Agreement dated April 6, 2010, shall remain in full force and effect.
