SUMMARY
California voters passed Proposition 84 (Safe Drinking Water, Water Quality and Supply, Flood
Control, River and Coastal Protection Bond Act of 2006) on November 7, 2006 and is detailed in
the Public Resources Code Section 75001 through 75090. Funding for the $368 million
Statewide Park Program grant was made available through the Sustainable Communities and
Climate Change Reduction chapter within Proposition 84 (Public Resources Code Division 43,
Chapter 9, Section 75065 (b) (1-5)). This Statewide Park Program awards grants on a
competitive basis for the creation of new parks and new recreation opportunities in proximity to
the most critically underserved communities across California.
The State Department of Parks and Recreation has been delegated the responsibility by the
Legislature of the State of California for the administration of the Statewide Park Program,
establishing the necessary procedures governing the Application. Said procedures established by
the State Department of Parks and Recreation require the applicant to certify by resolution the
approval of application before submission of said application to the State.
In the first round of funding, the City was not awarded a grant far the Orange Avenue Library
Park site. The City proposes to re-apply for the State Park Program grant in the second round. If
approved, staff will return to Council for approval of the grant scope contract with the State of
California and the appropriation of funds to the project. Staff requests approval to file an
application for the Orange Avenue Library Park site for Round Two of funding and requests
authority to Director of Public Works and his/her designee to conduct all negotiations, sign and
submit all documents, including, but not limited to applications, agreements, amendments, and

payment requests, which may be necessary for the complete performance of the grant scope
contract.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class 25 (f) categorical exemption [Acquisition, sale, or other transfer to preserve open
space or lands for park purposes] pursuant to Section 15325 (Transfers of Ownership of Interest
in Land to Preserve Natural Conditions) and a Class 4 (b) categorical exemption [New gardening
or landscaping] pursuant to Section 15304 (Minor Alterations to Land) of the State CEQA
Guidelines. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
The Statewide Park Program provides grant funding for the creation of new parks and recreation
opportunities in underserved communities in California. This competitive program was created
by Assembly Bill 31, Chapter 623, Statutes of 2008. There are two rounds awarding $368
million to critically underserved commwiities across California. The City will be applying for
Round Two. Round Two applications must be post marked or hand delivered to the Office of
Grants & Local Services (OGALS) no later than July 1, 2011. Round Two will make $184
million available for the creation of new parks and recreation facilities in critically underserved
communities throughout California.
Eligible applicants include cities, counties, districts, joint powers authorities and non-profits.
Partnerships are encouraged between two or more agencies. The minimum grant request is
$100,000 and the maximum grant request is $5,000,000 with no match required.
The Statewide Park Program requires projects to meet six eligibility requirements. Projects
cannot be funded unless all six requirements are met. A point system has been established which
awards points for meeting each of the eligibility requirements. Public Works Engineering staff
has been working diligently with other City departments to determine potential candidate
projects to submit that meet the six project eligibility requirements. The project requirements are
as follows:
Critical lack of park space or significant poverty
Type of project
Safe public use
Sustainable techniques
Project funding
Fees and hours of operation

Staff hosted a Technical Assistance Workshop with State grant representatives on Thursday,
April 7, 2011 in Council Chambers.
The Project Development Team (PDT), which consists of staff from Development Services,
Public Works Engineering/Operations and Recreation, met several times to discuss potential park
sites. After entering the project data into a criteria matrix, the Orange Avenue Library Park site
met all the eligibility requirements and had the most potential for the highest points. Staff is also
worlting with the Conservation section to ensure the Land Tenure agreements (with SDG&E) are
met.
It is staff's intent to re-submit an application for the Orange Avenue Library Park site. Several
community workshops/outreach efforts have been held and facilitated by city staff for the
purpose of educating the community of this park project and for gathering community input into
the design of the park. The workshops with the Southwest Civic Association community group
have resulted in dynamic and interactive group participation. Park programming has been
discussed and oppommities and constraints of the park site identified for the residents and
community leaders. In addition to community workshops, staff has made a presentation to the
Parks and Recreation Commission. The Commission provided favorable comments on the park
design and expressed their pleasure that a new park was being planned for western Chula Vista.
It is the intent for staff to conduct one more community workshop to engage residents and
confirm their input on the park.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found a conflict exists, in
that Councilmember Ramirez has property holdings within 500 feet of the boundaries of the
property, which is the subject of this action.
CURRENT YEAR FISCAL IMPACT
There is no impact to the General Fund. If the resolution is approved, the City will apply far
Statewide Park Program grant fiords. If a grant is awarded, staff will retum to Council to
approve a contract with the State of California and recommend accepting and appropriate the
grant funds into the Capital Improvement Program.
ON GOING FISCAL IMPACT
If a grant is awarded, staff will return to Council to approve a contract with the State of
California and recommend accepting and appropriating the grant funds into the Capital
Improvement Program.

FUNDS, MAKING THOSE CERTIFICATIONS AND
PROVIDING SUCH AUTHORIZATIONS NECESSARY TO
OBTAIN THE GRANT FUNDING, AND AGREEING TO
COMPLY WITH ALL LAWS
WHEREAS, the State Department of Parks and Recreation has been delegated the
responsibility by the Legislature of the State of California for the administration of the Statewide
Park Program, setting up necessary procedures governing the Application; and
WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant to certify by resolution the approval of application(s) before
submission of said application(s) to the State; and
WHEREAS, the applicant will enter into a contract with the State of California to
complete the grant scope project; and
WHEREAS, it is staff's intent to submit an application for the Orange Avenue Library
Park site.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby:
1. Approve the filing of an application for the Orange Avenue Library Park Site; and
2. Certify that said applicant has or will have available, prior to commencement of any
work on the project included in this application, sufficient funds to complete the project
3. Certify that said applicant has or will have sufficient funds to operate and maintain
the project(s); and
4. Certify that the applicant has reviewed, understands, and agrees to the General
Provisions contained in the contract shown in the Grant Administration Guide; and
5. Authorize the Director of Public Works or his designee to execute, during the
competitive application process, all documents associated with the request for grant funding and,
should the grant be awarded, to execute, subject to City Council approval, those agreements,
amendments, and payment requests, required to complete the grant scope; and

6. Agree to comply with all applicable federal, state and local laws,
