HomeMy WebLinkAboutReso 1983-11174 RESOLUTION NO. 11174 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA SUPPORTING AB 498 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the recent Appellate Court decision of Resource Defense Fund v. Santa Cruz Local Agency Formation Commission held that the legislature specifically mandated that local agency formation commissions must have an adopted sphere of influence for local government agencies within its jurisdiction in order to initiate, review, approve, or conditionally approve, or disapprove proposals affecting that local agency, including annexations to such agencies, and WHEREAS, in San Diego County, there are over 90 special districts, 76 of which are necessarily involved in annexation to any local agency, and 13 cities, all of which would require LAFCO approved spheres of influence to annex any territories to those cities, and WHEREAS, out of all of those local agencies, only Vista, Carlsbad, San Marcos and Escondido have LAFCO approved spheres of influence, and WHEREAS, it is not reasonable to assume that proper procedures can be expected to be implemented within a reasonable period of time to allow for the adoption of the required spheres of influence, and WHEREAS, three bills have been introduced in the legislature which would extend the time for the requirement of the adoption of spheres of influence, all of which are in response to the Santa Cruz decision, and WHEREAS, the bill by Senator Marks, SB 255, would specify January 1, 1985 as that deadline date, SB 322 would specify January 1, 1987 and AB 498 would specify January 1, 1986, and WHEREAS, the Legislative Committee of the City of Chula Vista has recommended the endorsement by the City Council of AB 498, but would have no opposition to SB 322 specifying a later date as the deadline. -1- NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby go on record in support of AB 498 with the proviso that other legislation which would equally specify the need for a reasonable period of time in which to accomplish the legislative goals for adopting spheres of influence Would be favorably viewed. BE IT FURTHER RESOLVED that the City Council does hereby authorize the Mayor to send a letter or other communication to all members of the government committees conducting a hearing on this matter and urge the immediate adoption of required legislation to defer the deadline for compliance with the legislation as mandated by the Santa Cruz case.
