HomeMy WebLinkAboutReso 1983-11173 Revised 2/11/83 RESOLUTION NO. 11173 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REQUESTING THE SAN DIEGO COUNTY BOARD OF SUPER- VISORS TO RECONSIDER PORTIONS OF THE HAZARDOUS WASTE ORDINANCE REGULATIONS RELATIVE TO SMALL BUSINESS OPERATIONS INCLUDING GAS AND OIL ORIENTED BUSINESSES AND RECONSIDERATION OF FEES RELATING THERETO The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, your honorable Board on May 25, 1982 adopted Ordinance No. 6293 and 6376 relating to disclosure and surveil- lance of hazardous waste materials and on the same date adopted a resolution urging the cities of San Diego County to adopt ordi- nances similar in content to said ordinances, and WHEREAS, in response to said request from the County of San Diego in the firm belief that the regulation of hazardous waste materials is a matter of extreme gravity and importance, the City Council of the City of Chula Vista on July 20, 1982 adopted the County ordinances by reference, and WHEREAS, subsequent thereto, the County amended the original ordinances by Ordinances No. 6469 and 6470 on November 16, 1982, which ordinances have also been adopted by reference by the City Council, and WHEREAS, the City Council of the City of Chula Vista is strongly of the opinion that the regulation of hazardous waste materials must be implemented on a regional scale and that the County is the organization best suited to such regulation both by virtue of the scope of the problem and the availability of tech- nically skilled and trained personnel to properly carry out such a function, and WHEREAS, although the City Council remains committed to the County implementation of such a program and places full reliance upon the advice and knowledge of the County officials, complaints have now been received relative to the implementation of the surveillance ordinance as it is applies to service stations and other small businesses, and, WHEREAS, such service stations and other small businesses may store quantities of used oil derived from both their own operation or oil brought to them by private parties for appropriate disposal, and I WHEREAS, these small businesses object not only to the extremely complicated reporting forms but also to the high minimum permit fee of $75.00 which relates soley to the number of employees in a particular business and not necessarily to the actual amount of time that may be required to be expended by an inspector. NOW, THEREFORE, be it resolved that the City Council of the City of Chula Vista ~oes hereby urge the County Board of Supervisors to further examine the ordinances regulating hazardous waste materials and disclosure, especially as such ordinances apply to automobile service stations and other small businesses that store use~ oil, which is classified as a hazardous material. BF IT FURTHER RESOLVED that the City Council also requests the County Board of Supervisors and the County staff of the Health Department carefully analyze the financial impacts and the burden of reporting that may be imposed on all small businesses that store or maintain small quantities of materials classife~ under State law as hazardous, which may properly be exempted from the operation of State law and County regulatory process without any danger to the public health. BE IT FURTHER RESOLVED that the Boar~ of Supervisors speci- fically address the issue of the $75.00 minimum permit fee required of all service stations and other small businesses under the surveillance ordinance without regard to the actual time and man- power costs that may be involved in performing inspections and to immediately consider a significant reduction in the present flat permit fee to a suggested level of $20 or to some other appropriate rate that more adequately reflects the actual time and manpower costs involved. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista requests that the Board of Supervisors re-examine its present policy of seeking ratification by each city of health regulations mandated by the State which should have uniform applica- tion throughout the County, both to ensure a proper protection of the public health and to avoid the inequities of financial burden that support for such programs place upon only those cities that adopt the County regulations. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to forward a certified copy of this resolution to the Board of Supervisors.
