A. BACKGROUND
On February 8, 1977 Council adopted Resolution No. 8505 which declared that neither the
Planning Commission nor the City Council would consider tentative maps and development

B. ANALYSIS
1. Purpose of "Moratorium"
Resolution No. 8505 was adopted in order

* There may be several sma11 areas west of Paseo Ranchero, north of "J" Street and south
of the south leg of Rice Canyon that should also be excluded from the moratorium. The
location and configuration of these areas will 6e determined at the time of tentative
map review.

3. Area between J Street and Telegraph Canyon Road.
Staff believes that the area between J Street extended and Telegraph Canyon Road
(see attached plat for precise area boundaries) can be considered for release from
the moratorium to allow plans to be reviewed by the Planning Commission and City
Council. In Staff's opinion these areas are primarily tributary to Telegraph
Canyon Road and should bear the responsibility for construction of Telegraph Can-
yon Road and the adjacent drainage channel. These areas are only secondarily
tributary to "H" Street. Since under typical assessment procedures, properties
are responsible for only one major roadway, it is unlikely that these areas would
or should bear responsibility for the construction of "H" Street. Therefore
their early development would probably not have a bearing, on the timing of con-
struction of that street.
However, the 1970 plan of record designates substantial portions of the Telegraph
Canyon Road frontage for multiple family and commercial development which is
now considered by Staff to be inappropriate. Therefore, a condition of the lift-
ing of the moratorium should be that the Planning Commission and City Council will
consider development plans on their own merit and without regard to the designations
shown on the plan of record.
Additionally, if new developments are proved along Telegraph Canyon Road without
appropriate construction on that road, Staff is concerned that traffic conditions
may prove to be unsafe and congestive. To provide a safe roadway it is important
that Telegraph Canyon Road be improved from west to east. Therefore, if develop-
ment does not improve sequentially from west to east, Staff will insist at the
time of review of the Development Plan that sufficient off-site improvements on
Telegraph Canyon Road be provided by the Developer to ensure the public's safety
and convenience.
