HomeMy WebLinkAboutReso 1977-87581' [ RESOLUTION NO. 8758 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING TENTATIVE SUBDIVISION MAP FOR SHEPHERDVILLE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Shepherdville and has recommended that the City Council approve said tentative map subject to the condi- tions as recommended in their Resolution No. PCS-77-8, adopted on the 13th day of July, 1977, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein, and WHEREAS, the Environmental Impact Report, EIR-76-1A, re- lating to this project, was certified by the City Council on the 3rd day of November, 1976, in conjunction with the rezoning of the property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that said Council does hereby approve the tentative subdivision map for Shepherdville in accordance with the recommendations of the Planning Commission of the City of Chula Vista as contained in their Resolution No. PCS-77-8, attached hereto. PCS-77-8 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP KNOWN AS SHEPHERDVILLE WHEREAS, Donald M. Russell submitted a tentative subdivision map to subdivide 1.76 acres located at the northwest corner of Quintard Street and Tobias Drive into 13 lots, to be known as Shepherdville, and WHEREAS, Section 66473.5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m. July 13, 1977 in the Council Chambers, City Hall, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the environmental impact report, EIR-76-1A, relating to this project was certified by the Planning Commission on June 28, 1976. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. From the facts presented to the Planning Commission, the Commission finds that the subdivision map known as Shepherdville is consistent with the General Plan for the City of Chula Uista as follows: a. Land Use Element - consistent at a density of 6.66 dwelling units per acre The proposed project will be developed The General Plan designates 4 to 12 dwelling units per acre for this area. b. Circulation Element - consistent. The project fronts onto two existing streets and the developer will provide required improvements. c. Housing Element - consistent. The project will provide small residen- tial lots for single family homes. The project is in an area suitable for the development of moderate cost homes. d. Conservation Element - consistent. The project will involve develop- ment of unused land within an existing urbanized area. No loss of significant natural habitat is involved. e. Open Space Element - consistent. The Open Space Element of the Gen- eral Plan does not designate the subject property as warranting preservation as open space. f. Parks and Recreation Element - compatible. The proposed project is located within a neighborhood park area which is identified as being deficient in parks. By recent action of the City Council, park land will be added in the immediate area. The developer will pay park fees in accordance with the City's adopted fee schedule. g. Seismic Safety Element - compatible. The Environmental Impact Report indicated the presence of an inferred fault in the vicinity of the subject property and recommended that a geologist be present during grading so that the matter can be given further study and a report submitted to the Environmental Review Coordin- ator. If this investigation should lead to actual discovery of a fault trace, appropriate mitigating actions can be taken at that time. h. Noise Element - consistent. The proposed project will not generate a significant amount of noise pollution and is not adjacent to any major streets or highways identified in the Noise Element as a major ground transportation noise source. i. Safety Element - consistent. The proposed project is located within a mile of an existing fire station on Melrose north of Palomar Street and will be served by a fire hydrant to be located on Tobias Drive. No comments were received from the Police Department which would indicate any unusual law enforcement problems. j. Scenic Highway Element - consistent. The project area is not near any scenic highway and would not constitute an adverse impact thereon. k. Bicycle Routes Element - consistent. Neither Quintard Street nor Tobias Drive is designated as a bike route. 1. Public Buildings Element - consistent. The proposed project will in no way interfere with or contravene the Public Buildings Element since no public buildings are proposed for this site. 2. The Planning Commission recommends to the City Council that Tentative Map PCS-77-8 for Shepherdville be considered as the precise plan for development in the R-1-5-P, and be approved, subject to the following conditions. a. A Homeowners association shall be formed subject to the approval of the City Attorney, for the perpetual maintenance of the private street, sewer, and lighting along the private street. b. Proposed street vacations of Tobias Drive and Quintard Street shall be approved by the City Council prior to approval of the final map. c. The lowering of the grade on Quintard Street will require the adjust- ment of existing driveways and approaches at the cost of the developer. A profile of each affected driveway shall be submitted to the City Engineer for approval. -2- d. The subdivider shall be required to provide an approved drainage system along each side of Quintard Street and also on First Avenue due to the increased run-off on Quintard Street. The developer shall increase the capacity of the existing curb inlet on First Avenue. e. The subdivision lies within the Castle Park moratorium area. Sewer connection and occupancy of the buildings will not be permitted until adequate downstream sewer facilities have been provided. The owner/ developer shall pay all applicable sewer assessment charges. f. All utilities shall be undergrounded including existing overhead utilities adjacent to the subdivision boundary within the public right of way. 9 h i j A geologist shall be present during grading and shall, together with soils and structural engineers, recommend mitigating measures, should any fault trace be discovered. Grading plans, including landscaping and irrigation plans, shall be approved prior to approval of the final map. The developer shall comply with all applicable sections of the Chula Vista Municipal Code prior to approval of the final map. The final map shall be prepared in accordance with the Subdivision Map Act, as amended January 1, 1977, and the Subdivision Manual of the City of Chula Vista. A complete fencing plan shall be required as follows: (a) solid 6 ft. high fence on west and north boundaries of the subdivision and between lots; (b) a decorative fence 6 ft. high, with masonry pilasters and solid woood fencing, shall be installed along Tobias Drive, 10 feet from the sidewalk adjacent to lots 1, 8 and 9. The area between the fence and the sidewalk shall be landscaped and irrigated with main- tenance the responsibility of each adjacent lot. Guest parking required for interior lots, Nos. 1 through 8, shall be provided through the provision of 16 ft. wide concrete driveways, not less than 23 feet long from face of garage to edge of street. Guest parking for the remaining lots may be accommodated by onstreet parking on Tobias Drive and Quintard Street; no parking shall be permitted on the private access street; the developer shall install appropriate signs and street markings. The developer shall have stated in the Covenants, -3- Conditions and Restrictions that no conversion of garages to other uses shall be permitted. k. The developer shall provide all required improvements for the private street indicated on the map, meeting the requirements for a 24 foot wide alley section designed to meet the standards of the Department of Public Works of the City of Chula Vista with concrete paving. Im- provement drawings shall be subject to approval by the Director of Public Works. The proposed private street shall line up with the street approved in the adjoining Sweetheart Subdivision. 1. All lighting plans for public and private streets shall be approved by the City Traffic Engineer prior to approval of the final map. m. The applicant shall comply with City Council Resolution #6792 regard- ing the provision for public facilities, including park fees (Ordinance #1668). n. The subdivision boundary shall be shown to the centerline of Tobias Drive and Quintard Street. 3. That this resolution be transmitted, along with the Tentative Map, to the City Council, and a copy of this resolution be transmitted to the applicant.
