On July 28, 1966 the parties herein ~*+~*+~~ the agreanent by executiiiy the First Amendment to Agreenent to provide for the addition of Chula Vista Service Areas IIIA, VII and VIII to which service is msde available by the District's Sewer System, as delineated on plats marked Exhibits B, C and D. 3. On June 6, 1967 the ~~-+-; es herein amended the agre~ient by executing the Second Amendment to Agreement to provide far the addition of .Chula Vista Service Areas IIIB and IIIC to which service is made available by the District's Sewer System, as delineated on plats marked Exhibits E and F. 4. On October 3, 1968 the parties herein amended the agreemant by executing the Ttvrd Amendment to Agre~nent to provide for two additional areas, which will become part of Chula Vista Service Area IV, as delineated on plats marked Exhibits G and H. 5. On December 9, ]968 the parties herein amended the agreanent by executing a Fourth Amendment ~ Agreement to provide for the addition of Section 16.1, Date Street, Faivre Street and future construction project as delineated on plats and table marked Exhibit I. 6. On Fd~ruary 16, 1971 the ~~ties herein amennded the agreanent by executing a Fifth Amencl[tent to Agreement to amend Section 10 to reflect a higher service chazge. -2- 7. On November 23, 7971 the parties herein amended the agreement by executing a Sixth Amendment to Agreement to provide for an additional area which became part of Chula Vista Service Area ]V as delineated on a plat marked Exhibit K, and to provide an additional area which became part of Chula Vista Service Area III as delineated on a plat marked Exhibit J. 8. On September 26, 1972 the parties herein amended the agreement by executing a Seventh Amendment to Agreement to add two additional. service areas which will became a part of Chula Vista Service Area III, as delineated on plat marked Exhibit L. 9. The District proposes to construct a new sewer line parallel to the existing suer line located in Orange Avemn~, Third Aventi~, Tremmrmt Street and Fresno Avenue to be referred to as the "Castle Park Relief Sewer" as shown on the attached map marked Exhibit M and Chula Vista desired to participate in the construction of said sewer. It is proposed that the contract for construction of the Castle Park Relief Sewer will be advert%sed during the umnth of August 1977. NOW Tf~'ORE, THE PARTIES fIEREI'O AQ2EE AS Fl~LL04V5: I. Section 15.1, entitled "CASTLE PARK RELIEF' SEWER PRQ71xT", is added to said agreattent to read as follows: Section 15.1. CASTLE PARK REL,IEE' SEWER CONSTRUCPIGN PROJECT. 1. The District will construct a sewage system to cronsist of a new sewer line parallel to the existing trunk sewer line located in -3- Orange Avenue, Third Avenue, Tremont Street and Fresno Avenue to be referred to as the "CASTLE PARK RELIEF SEWER" as shown on the attached map marked Exhibit b1. 2. Chula Vista and the District will share in the local costs of the CASTLE PARK RELIEF SEWER in accordance with the rela- tive capacities reserved in those lines by said parties. The capac- ity that each party will reserve in those sewer lines is shown in Table 1 on Exhibit M and incorporated herein by this reference. 3. (a) It is anticipated that the cost of constructing this project and of performing inspection services will be paid through Federal grants. Non-federally funded costs shall be shared by Chula Vista and the District in the proportions shown on Exhibit M - Table #l. (b) Chula Vista shall deposit with the District, before the District awards the construction contract for the Castle Park Relief Sewer, the sum necessary to pay Chula Vista's estimated share of the project costs. The said sum shall be determined in accordance with the percentages shown in Table 1, Exhibit t1, and the Engineer's Estimate, shown in Table 2, Exhibit M, as appropri- ate. (c) L9ithin thirty (30) days of the completion of con- struction the District shall render to Chula Vista an itemized statement o£ the costs of the Castle Park Relief Sewer and a state- ment of Chula Vista's share of said costs computed pursuant to paragraph (a) of this Section 3. The deposits, therefore made by Chula Vista pursuant to paragraph (a) of this Section 3 shall be credited against Chula Vista's share -4- - of the ousts and any excess xefimded. In the event the deposit or deposits do not equal Chula Vista's share, Chula Vista shall forthwith pay the difference to the District. 4. The discharge of sewage from Chula Vista service areas and from Montgomery Sanitation District service areas defined in the original agrec~ws<t and amendments thereto prior to this amend- ment has been provided for in said original agreement and aicienchnents. The District will authorize Chula Vista to discharge a maxinnan of 1.18 Mf.~ peak flag rate (estimated 0.64 MGA Average Daily Flow Pate) combined to the Castle Park Relief Sewer and the parallel existing tnmk sewer. Surplus capacity as may be available shall be shared by Chula Vista and the District in direct proportion to their respective parti- cipations in the total project Est as shown in Table 1, Exhibit M. 5. The cost of future major reconstruction, replacement or repairs of the lines designated as the Castle Park Relief Sewer will be financed proportionately by the District and Chula Vista in accard- ante with the capacities reserved in the lines by those r~,+;es at the time such reconstruction, replacement or repairs are needed.. II. Exhibit M, consisting of a map and tables I and II, is attached hereto and is hereby incorporated and made a part of this agreement by this reference. -5- IIT.
