RESOLUTION OF THE CITY COUNCIL OF TiiE CITY OF CHULA
VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND CHULA VISTA AQUATICS ASSOCIATION IN REGARD
TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agreement
between THE CITY OF CHULA VISTA, a municipal corporation, and
CHULA VISTA AQUATICS ASSOCIATION, in regard to the expenditure of
City funds appropriated
dated the 21st day of July , 1977 , a copy of
which is attached hereto and incorporated herein, the same as though
fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

AGREEMENT SETTINGOUT THE TERMS AND OBLIGATIONS
OF "CHULA VISTA AQUATICS ASSOCIATION" IN REGARD
TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED
THIS AGREEMENT, made and entered into this 21st day o£
July 1977 , by and between the CITY OF CHULA VISTA,
a municipal corporation, hereinafter referred to as "City", and CHULA
VISTA AQUATICS ASSOCIATION, a non-profit City Charter group, hereinafter
referred to as "C.V.A.A."

WHEREAS, the City Council of the City of Chula Vista has
determined that the function of C.V.A.A. serves a valid public purpose,
and
WHEREAS, the City Council of the City of Chula Vista
desires to encourage the beneficial aims of the C.V.A.A. organization
through appropriation of reasonable amounts of City funds, and
WHEREAS, such policy stipulated that no expenditure may
be made out of any appropriation awarded said non-profit organizations
unless an agreement has been reached between the parties setting out
the terms and obligations for the expenditure of such funds.
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between
the parties hereto as follows:
1. The charter organization known as the C.V.A.A.
agrees to:
a. Work toward the improvement and progress of
competitive swimmers and divers.
b. Work with the Chula Vista Parks and Recreation
Department in providing facilities, training
and encouragement for increased proficiency in
competitive amateur aquatic sports.
c. Further the interest and education of children
and parents in competitive aquatic sports.
d. Maintain membership with the Amateur Athletic
Union (A.A.U.), by abiding by its rules and
regulations.
e. Encourage and develop good sportsmanship,
individual integrity and team play.
2. THAT the administration of the C.V.A.A. agrees to
expend City appropriated funds in an amount not to exceed $8,470
to meet bona fide obligations incurred in performing these services,
to wit: salaries for instructors and coaches, swimming supplies and
equipment, and other aquatics related materials and/or supplies and
equipment deemed necessary for the accomplishment of the agreed items
included in paragraph one (1).
3. THAT the City will, on a quarterly basis provide
the C. V.A.A. an advance in an amount of $2,117.50 for expenditures
related to the abovementioned services.
4. THAT the C.V.A.A. agrees to submit to the City or
its designated agent on a quarterly basis a complete report of all
financial expenditures in order to justify subsequent advances as
follows:
a. Cancelled checks for the entire quarter under
examination should be furnished along with all
paid invoices.
b. The various positions being compensated should be
identified and the hourly rates given. If rates
are going to change, the maximum rate should be
stated for each position.
c. The number of hours scheduled for each position
in a pay period should be noted or estimated.
d. The total scheduled hours for all staff for a
given month should be stated or estimated.
5. THAT the C.V.A.A. will establish a uniform banking
system exclusive of all other funds which shall be approved by the
City or its designated agent, and such system shall include an
expenditure authorization to include no less than a two (2) signature
checking account. It is further understood that the abovementioned
two (2) signatures shall specifically be those of the President and
the Treasurer, who shall be duly elected officers of the C.V.A.A.
6. THAT the C.V.A.A. agrees to submit to the City or
its designated agent (City Finance Department) the names and sample
signatures of the President and the Treasurer who shall be duly
elected officers of the C.V.A.A. It is further understood that if
there is a change of officers, the C.V.A.A. will notify the City or
its designated agent of the change indicating the officer(s) to be
deleted and the officer(s) and sample signature(s) to be added.
7. THAT the City will be permitted to inspect all
books and records of the C.V. A.A. and termin ate'its entire obligation
upon notice if the C.V.A.A. violates any of the terms of the agreement
or for other good cause shown not related to a violation of the terms
of the agreement. The City Manager shall thereafter notify the City
Council of the notification of termination made to the C.V.A.A.
IN WITNESS WHEREOF, the n3*+;es ]iereto have caused this agreement
to be executed the day and year first hereinabove set forth.
