HomeMy WebLinkAboutReso 1977-8705RESOLUTION N0. 8705 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING REVISED TENTATIVE SUBDIVISION MAP FOR GARDEN VIEWS, AND CERTIFYING THE NEGATIVE DECLARATION The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Garden Views and has recommended that the City Council approve said tentative map subject to the condi- tions as recommended in their Resolution No. PCS-77-3, adopted on the 25th day of May, 1977, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein, and WHEREAS, the Garden Views subdivision map has been revised to reduce the number of lots from 21 to 17 and is otherwise in con- formance in design to the map recommended for approval by the Planning Commission, and WHEREAS, a notice of the proposed negative declaration on the tentative subdivision map of Garden Views was given in accor- dance with the Environmental Review Policy, and WHEREAS, the Environmental Review Committee found that said tentative subdivision map would have no possible significant impact on the environment and forwarded the attached Negative Declaration, IS-77-28, to the City Council of the City of Chula Vista for their consideration, and WHEREAS, said Negative Declaration has been available to agencies having jurisdiction by law, all responsible agencies, and to the public for an adequate period of time for their review and comment, and WHEREAS, the information contained in said negative declar- ation has been considered by the City Council of the City of Chula Vista prior to its action on the discretionary item before the City Council. NOW, THEREFORE, the City Council of the City of Chula Vista finds as follows: 1. That the City Council of the City of Chula Vista adopts as its record of this finding of no possible significant impact the Council agenda statement on this agenda item and all of the attach- ments thereto. 2. That the City Council of the City of Chula Vista finds in accordance with the recommendation of the Environmental Review Committee and the attached Pegative Declaration that said tentative subdivision map of Garden Views will not have any possible signifi- cant impact on the environment, and the attached Negative Declaration, incorporated herein by reference as if set forth fully, has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. 3. That the Environmental Review Coordinator is hereby authorized and directed to file said Negative Declaration with the County Clerk of the County of San Diego subsequent to the prepara- tion of a notice of determination on this project. - 1 - NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that said Council does hereby approve ,the revised tentative subdivision map for Garden Views in accordance with the recommendations of the Planning Commission of the City of Chula Vista as contained in their Resolution No. PCS-77-3, attached hereto, with the exception of reducing the number of lots from 21 to 17 and Section (a) of the Land Use Element, which specified 6.2 units per acre as the gross density is hereby revised to approxi- mately 5 units per acre which is still consistent with the General Plan designation, and Section (g) of the recommended approved con- ditions shall indicate that the developer shall relinquish all access rights to Fourth Avenue, K Street, Fig and Guava. PCS-77-3 •• RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF TENTATIVE MAP KNOWN AS GARDEN VIEWS WHEREAS, August Development Company submitted a tentative subdivision map to subdivide 3.4 acres of property located at the northwest corner of Fourth , Avenue and K Street into 21 single family residential lots to be known as Garden Views, and WHEREAS, Section 66473.5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the subdi- vision map and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., May 25, 1977 in the Council Chambers, City Hall, before the Planning Commission and said hearing was thereafter closed, and 'rlHEREAS, on h1ay 25, 1977 the Planning Commission certified the Negative Declaratior. cn IS-77-28 fc~ the uevelOp~~ient. , NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. From the facts presented to the Planning Commission, the Commission finds that the subdivision map known as Garden Views is consistent with the General Plan for the City of Chula Vista as follows: a. Land Use Element. The General Plan designates the site for medium density residential use to be developed at 4-12 du/ac. This project achieves a gross density of 6.2 units per acre under the R-1-5 zone and thus is consistent with the Ueneral Plan designation. b. Circulation Element. The proposed new street, a cul-de-sac, will provide adequate residential access onto K Street. The proposed right of way width meets General Plan standards. c. Housing Element. The proposed single family residential development provides additional needed family residences in the community. The project is consistent with the General Plan residential proposals. d. Conservation, Open Space, and Parks and Recreation Elements. The project site is not designed by the General Plan for park or open space, and no public need has been identified for this property. 1 , ' e. Seismic Safety Element. The project site is not subject to ~,' inundation or located on a designated flood plain. The La Nacion fault, identi- fied as potentially active, is located approximately one mile east of this site. The report will be reviewed by the Environmental Review Committee and, based on their findings, applicable city codes and requirements will dictate development techniques to ameliorate hazards. f. Safety Element. This project provides necessary public improvements and fire hydrants in conformance with city standards. The site is located within a 3 minutes response time zone for Fire Station No. 1, located approximately 1~ miles north of the project site. g. Noise Element. The Noise Element recognizes the need to continue to utilize the City's Environmental Review process to evaluate and ameliorate noise impact. The subdivider has submitted an Initial Study of environmental impact for the City's consideration. h. Scenic Highways Element. The site does not abut a "Scenic Highway" or "Gateway." i. Bicycle Routes Element. K Street is designated as a major bicycle route adjacent to the proposed project. Space limitations preclude the construc- tion of a bike path along this route. j. Pubiic Buildings Element. Public buildings are neither proposed nor required on the subject site. 2. The Planning Commission recommends to the City Council the approval of Tentative Map PCS-77-3 for Garden Views, subject to the following conditions: • a. One fire hydrant shall be located at the end of the cul-de-sac. b. A homeowners' association shall be formed far the maintenance of the common landscaped areas adjacent to K Street and Fourth Avenue, and the required walls facing fourth Avenue, K Street and the terminus of Fig and Guava Avenues. c. The developer shall construct permanent improvements on K Street (to the centerline, if appropriate, to meet City standards), Garden Place, and at the southerly terminus of Fig Avenue and Guava Avenue. These improvements shall consist of but not be limited to curb, gutter, sidewalk, pavement, street lights and sewer facilities as approved by the City Engineer. d. The developer/owner shall grant an easement along Garden Place for street tree planting and maintenance purposes. The easement width shall total 10 feet from the back of sidewalk. -2- -- ., - e. The developer shall comply with all the requirements of the •~ Chula Vista Municipal Code as it pertains to this subdivision. Improvement plans and final map shall be prepared in accordance with the City of Chula Vista Subdivision Manual. f. The developer shall construct a 6 ft. high decorative fence interspersed with masonry pilasters, minimum 20' on center, subject to planning staff approval. Fence to be located adjacent to Fourth Avenue, K Street, and the terminus of Guava Avenue and Fig Avenue (from building setback to building setback). g. The developer shall relinquish all access rights to Fourth Avenue> K Street,~Fig and Guava Avenues for lots 1-19. h. Except for the corner of fourth Avenue and K Street, the land- scaped areas between the wall and the sidewalk adjacent to ,Fourth Avenue and K Street shall be planted with trees, woody ground cover and shrubs. The corner area shall be limited to low growing (2z ft. high maximum growth) ground cover. The irrigation system shall be automatic and designed in such a manner as to reduce the potential from vandalism. The plans shall be reviewed and approved by the City Landscape Architect. 3. That this resolution be transmitted, along with the Tentative Map, to the City Council, and a copy of the resolution be transmitted to the applicant. Project Proponent: CEPA 5555 A~agnatron Blvd. Suite D San Diego,29111 The finding that the project will not have a significant effect en the environment is based on the following reasons: 1. The site }ias been used for agriculture in the past and is currently used for floriculture. It is void of any significant wildlife and there are no geologic hazards or adverse soi_1 conditions known t,o exist on the property. 2. The prol~osed subdivision and rezoning is consistent with the Gencr_ it Plan and associated el.emc~nz,s and is not anticipai=cd to achieve short term to the disadvani.age of long term goals. 3. Proposed resiclent;ial density i_s expected to generate app.r.oxi_n~ately 5000 gallons 6f liquid se~a~age per day which could contribute to a regionally cumulative impact on sewage treat- ment facilities and secondary impacts on outfal.l water gnali_ty. The effected se~•~ac~e treatment is currently operating over capacity at this time and until new facilities are constructed or the existing plant expanded, urban growth will continue to exacerbate the existing situation. ~!. Local public systems are adequate for this residential expansion and no substanti.al_ emission of noise or any hazardous substance which would adversely effect humans is anti r.i.pated to occur. The proposed mitigation will avoid any substantial inverse traffic noise impact. Mitigation measures included as part of the project to avoid significant impact: 1. The applicant proposed to construct a six ft. masonry wall which will provide line of site acoustical protection from traffic noise on 4th Ave. 2. The developer will be required to obtain assurance from the school districts that adequate school facilities are available. Project Prospective Existing sewage treatment facilities are near or at capacity but are adequate to provide a secondary treatment level. Continued urbanization will exacerbate this existing problem. Proposals fo.r expansion of the system are being examined by the City of San Diego. The Initial Study Application & Evaluation forms documenting the fin 'xi of no sign'f'~ zt i pact, are attached.
