RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY
OF CHULA VISTA AND LUTHERAN SOCIAL SERVICES AND
AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby resolve as
fol 1 ows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chula Vista that certain agreement between THE CITY OF CHULA VISTA, a
municipal corporation, and LUTHERAN SOCIAL SERVICES, in regard to the
expenditure of City funds appropriated, dated the 8th day
of .. August , 1989, a copy of which is attached~to and
incor.porated herein, the same as though fully set forth herein be, and the
same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be,
and he is hereby authorized and directed to execute said agreement for and on
behalf of the City of Chula Vista.

AGREEMENT SETTING OUT TERMS AND OBLIGATIONS OF
LUTHERAN SOCIAL SERVICES IN REGARD
TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED
THZS AGREEIqENT, made and entered tnto thts 8th day of August ,
1989, by and between the CZTY OF CHULA VZSTA, 'a municipal corporation,
heroinafter referred to as "City" and LUTHERAN SOCIAL SERVICES, heretnafter
referred to as "Grantee",
HZTNESSETH
WHEREAS, the City Is currently tnvolved tn a Community Development
Block Grant program, a principal goal of vh$ch ts to benefit low and moderate
tncome persons; and
WHEREAS, the Grantee ~s eElutpped and ~11tng 'to provide' certain
services to the City 'which w~11 primarily benefit .-low and ~oderate ~ncome
persons and has the necessar~ expertise fn th~s ffeld for completing the same;
and,
WHEREAS, the City ts desirous of..havtng those certain services,
heroinafter enumerated, performed by the Grantee; and,
WHEREAS, funding for the Grantee ~s contingent upon receipt' of a
Letter of Credit authorizing a drawdoom of Block Grant funds from the U, S,
Department of Housing and Urban Development'{HUD); and .
WHEREAS, no expenditure may be made out of any appropriation. awarded
such a Grantee unless an agreement has been reached between the parties
setting out the terms and obligations for the expenditure of such funds,
WHEREAS, the Grantee agrees that (n receiving City CDBG funds the
Grantee ts not an agent or representative of 'the City, and that all operations
are independent of the City, The Grantee also agrees to indemnify and hold
the City free and harmless from any and all liability connected with the
Grantee's operation or use of funds,
NOW, THEREFORE, tn consideration of the mutual obligations of the
parties as heret, expressed, the parties hereto agree as follows:
1, The tam of this agreement shall be fur a period of one (1)
year, from July 1, 1989, through ,lune 30, 1990, unless further modified to
include other pennit, ted expenditures of funds that are appropriated by the
City Counct1.
2, Th~ administration of the Grantee agrees to expend
Ctty-approprtate~ funds .to meet bona fide obligations incurred for the
operation of an emergency ass(stance center serving the basic needs, such as
food, shelter, c~thtng, and maltcarton to individuals and families lacking
the resources to purchase these items for the period July 1, 1989, through
June 30, 1990, for an amount not to exceed $11,800 as demonstrated in. the
budget attached as Exhibit A and Incorporated herein,
3, Payment of those City-appropriated funds shall be made to the
Grantee in monthly ~nstallments (n roughly equal amounts following receipt by
the City of expense reimbursement claim forms from Grantee,
include the folioring statistics relative to clients re:errcd to the emergency
assistance center.'
(1) Number of clients served .
(2) :"Types' of services provided to cltent~ and number of
· clients receiving each type of service.
(3) Annual gross income of clients' households {by income
category)
(4)~ Gender of cllents
(5) Resldency of clients
'(6) Ethntcity of clients
(7) Previous quarter's expenditures of City Block Grant
funds.
7. Performance of this agreement may not, by subagreement,
assigned to any other entity without prior written consent of the City.
8. The City, at its discretion may require the Grantee to provide
or allow the City to undertake a complete financial and program audit of its
records. Those records shall contain, at a minimum, the following information
for each client served: income, resldency, gender and ethnicit),. The records
shall also contain receipts or other proof of all expenditures made with City
CDBG funds.
g. The Director of Community Development, or his/her designated
representative, shall represent the City in all matters pertaining to the
services rendered pursuant to the agreement and shall administer this
agreement on behalf of the City.
10. The Director of Lutheran Social Services or his/her designated
representative, shall represent the Grantee in all matters pertaining to the
services rendered pursuant to the agreement and shall administer this
agreement on behalf of tne Grantee.
The Grantee shall comply with Executive Order 11246, entttled
:Emplo3nnent Opportunity," as amended by Executive Order 11375 and as
.supplemented in Department of Labor regulations 41 CFR Part 60.
12, The Grantee agrees to abide by the requirements of Deparment of
Housing and Urban Development regulations 24 CFR 570,502,
13, The Grantee agrees to abide by the requirements of O~ Circular .
A-122 "Cost Principles for Non-Profit Organizations,"
14, The Grantee sha~l account for use of Block Grant funds
separately from other funds, so as to demonstrate that the funds are used for
their designated purposes.
15, The contract· may be terminated or suspended by the Ctty a.~ter 60 '
