RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING TENTATIVE SUBDIVISION MAP FOR CHULAS
CASITAS NO. 1, AND CERTIFYING THE NEGATIVE DECLARATION
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Planning Commission of the City of Chula
Vista has heretofore approved that certain tentative map of a
subdivision to be known as Chulas Casitas No. 1 and has recommended
that the City Council approve said tentative map subject to the
conditions as recommended in their Resolution No. PCS-77-4, adopted
on the 8th day of June, 1977, a copy of which is attached hereto
and by this reference made a part hereof, the same as though fully
set forth herein, and
WHEREAS, a notice of the proposed negative declaration on
the tentative subdivision map for Chulas Casitas No. 1 was given
in accordance with the Environmental Review Policy, and
WHEREAS, the Environmental Review Committee found that
said tentative subdivision map would have no possible significant
impact on the environment and forwarded the attached Negative
Declaration, IS-77-16, to the City Council of the City of Chula
Vista for their consideration, and
WHEREAS, said Negative Declaration has been available to
agencies having jurisdiction by law, all responsible agencies, and
to the public for an adequate period of time for their review and
comment, and
WHEREAS, the information contained in said negative declar-
ation has been considered by the City Council of the City of Chula
Vista prior to its action on the discretionary item before the City
Council.
NOW, THEREFORE, the City Council of the City of Chula Vista
finds as follows:
1. That the City Council of the City of Chula Vista adopts
as its record of this finding of no possible significant impact the
Council agenda statement on this agenda item and all of the attach-
ments thereto.
2. That the City Council of the City of Chula Vista finds
in accordance with the recommendation of the Environmental Review
Committee and the attached Negative Declaration that said tentative
subdivision map will not have any possible significant impact on
the environment, and the attached Negative Declaration, incorporated
herein by reference as if set forth fully, has been prepared in
accordance with the California Environmental Quality Act of 1970,
as amended.
3. That the Environmental Review Coordinator is hereby
authorized and directed to file said Negative Declaration with the
County Clerk of the County of San Diego subsequent to the prepara-
tion of a notice of determination on this project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that said Council does hereby approve the ten-
tative subdivision map for Chulas Casitas No. 1 in accordance with
the recommendations of the Planning Commission of the City of Chula
Vista as contained in their Resolution No. PCS-77-4, attached hereto.

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF TENTATIVE MAP KNOWN AS
CHULAS CASITAS N0. 1
WHEREAS, Russell W. Shiroma submitted a tentative subdivision map to
1.21 acres of property located at the southeast quadrant of First Avenue and
"H" Street into 5 lots, to be known as Chulas Casitas No. 1, and
WHEREAS, Section 66473.5 of the Government Code provides that approval
of a subdivision map shall be based upon findings of consistency between the
subdivision map and the adopted General Plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place fora public
hearing to consider said tentative map, and notice of said hearing, with its
purpose, was given by the publication in a newspaper of general circulation in
the city at least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.,
June 8, 1977 in the Council Chambers, City Hall, before the Planning Commission
and said hearing was thereafter closed, and
WHEREAS, the Planning Commission found that in accordance with the
Negative Declaration on IS-77-16 and the findings stated therein, this project

NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. From the facts presented'to the Planning Commission, the Commission
finds that the subdivision map known as Chulas Casitas No. 1 is consistent with
the General Plan for the City of Chula Vista as follows:
a. Land Use Element. The General Plan designates the site for medium
density residential development (4-12 du/ac). The proposed project, a five lot
subdivision of a 52,858 sq. ft. parcel, would achieve a gross density of 4.2 du/ac.
and would be consistent with the residential designation indicated by the General
Plan.
b. Circulation Element. The proposed new street would provide adequate
residential access onto First Avenue. In addition, the right-of-way vridth meets
the General Plan standards.
c. Housing Element. The project will provide additional single family
residences in the community and is consistent with the General Plan residential
proposals.
d. Conservation, Open Space, and Parks and Recreation Elements.
The project site is not designated by the General Plan for park or open space
and no public need has been identified for the subject property.
e. Seisrnic Safety Element. The La Nacion Fault, considered as
potentially active, is located approximately one-half mile east of the property
and applicable city codes and requirements will dictate development techniques
to mitigate hazards.
f. Safety Element. The project site is not subject to inundation or
located on a designated flood plain. All proposed public improvements will
conform to City standards. The site is located within a 3 minute response time
from the nearest fire station..
g. Noise Element. The Noise Element recognizes the need to continue
to utilize the City's environmental reviwe process to evaluate and ameliorate-
noise impacts. The subdivider has submitted an Initial Study for consideration
and it was determined there will be no adverse effect.
h. Scenie Highways Element. The site does not abut a "Scenic Highway"
or "Gateway."
i. Bicycle Routes Element. There are no designated bikeways abutting
or adjacent to the project site.
j. Public Buildings Element. Public buildings are neither proposed
nor required on the subject site.
2. The Planning Commission recommends to the City Council that Tentative
Map PCS-77-4 for Chulas Casitas No. 1 be approved, subject to the following
conditions:
a. Street "A" shall be dedicated as a public street and designated
as Casitas Court.
b. Curb return radius at the intersection of First Avenue and Street
"A" shall be 20' minimum. The developer shall be responsible for
installing a 5 ft. sidewalk along First Avenue.
c. A minimum 56 ft. diameter, curb to curb cul-de-sac shall be
provided at the easterly terminus of Street "A". Sufficient right
of way shall be provided within the cul-de-sac to accommodate a
5.5 ft. wide monolithic curb and sidewalk across the front of Lot 5.
d. A one foot control lot shall be provided at the easterly end
and south side of Street "A".
e. The developer shall improve the natural drainage channel to
carry 260 cubic feet per second. The City of Chula Vista will
accept for maintenance a drainage courst if it is improved to
full City standards, i.e., concrete lined channel in a City
easement or underground pipe system with a City easement provided.
Minimum improvements shall consist of a graded grass lined
channel with a concrete paved invert to carry the trickle flow.
This and other alternatives to handle the drainage must be approved
by the City Engineer. A grass lined channel will not be accepted
for maintenance by the City and therefore a homeowners' association
shall be formed to maintain the channel. Formation of the homeown-
ers' association and the CC&R's shall be subject to the approval
of the City Attorney. The drainage channel shall be shown on the,
final map as a private drainage easement held in common interest
by the homeowners' association. The CC&R's shall specify that the
City, its agent, or contractor may enter the channel for mainten-

the total cost of labor, materials and equipment to keep the channel
in a condition able to carry the flow.
f. A.grading permit and/or a watercourse permit is required. Street
improvement, grading, and drainage plans must be approved by the
City Engineer prior to approval of the final map by the City Council.
g. A street tree planting and maintenance easement, 7-1/2 feet in
width, shali be provided along the northerly side of Street "A"
and the east side of First Avenue and shall be dedicated to the City.
h. All utilities serving the subdivision shall be undergrounded. The
developer shall be responsible for installing street lights.
i. The developer shall plant street trees along dedicated streets; the
number and species to be determined by the City Engineer.
j. The developer shall comply with applicable sections of the Chula
Vista Municipal Code in effect at the time the tentative map is
approved by the City Council. Final map and improvement plans shall
be done in accordance with the Subdivision Manual.
k. The CC&R's shall stipulate that any fencing constructed across
the lot shall provide access to the drainage area for mainten-~
once purposes.
1. A 20 ft. building setback shall be established along First
Avenue
3. That this resolution be transmitted, along with the Tentative Map,
to the City Council, and a copy of this resolution be transmitted to the
applicant.

The Environmental Review Committee of the City of Chula Vista
has recommended that the• appropriate decision making bodies
find that the project noted below will not result in any significant
environmental impact. The project is described as follows:
the subdivision of one parcel into four or five separate parcels
for residential development.
Project Location: 523 First Ave.
Project Proponent: R & R Eng. Co. 1014 W. Washington St. San Diego
The finding that the project will not have a significant effect on
the environment is based on the following reasons:
1. The project site does not appear to~support any significant
wildlife which could be impacted by the project proposal, nor is
the site subject to any known geologic hazard.
2. The project is consistent with the General Plan and associated
elements and is not anticipated to result in the achievement of
short term to the disadvantage of long term environmental goals.
3. There are no impacts anticipated to result form the subject
subdivision that could interact to create a substantial cumulative
adverse environmental effect.
4. The project will not result in any significant increase in
ambient noise levels nor will any hazardous substance be emitted
due to residential development.

Project Perspective
1. Local schools are currently or .approaching capacity in the
subject area and will continue to be so burdened in the future
as a result of residential growth, until such time as the school
districts deem additional facilities necessary and funding is
appropriated.
2. Park district No. 5.01 is void of any substantial neighborhood
park facilities and as the local population increases so does the
need for adequate parklands. This. situation will not improve
until additional funding for the acquisition of parklands within _
the city is appropriated.
