Home My WebLink AboutReso 1989-15238 (k) RESOLUTION NO. 15238 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND SOUTH BAY GUIDANCE CENTER AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and SOUTH BAY GUIDANCE CENTER, in regard to the expenditure of City funds appropriated, dated the 8 day of August , 1989, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. I/( BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. FULASZ, CMC, CITY CLERK of the City of Chula Vista, California, DO HEREBY CERTIFY that the above and foregoing is o full, true and correct copy of RESOLUTION NO. 15238 ,and that the same hos not been amended or repealed DATED t¢~'' / City Clerk ~C-660 ~. ,~ AGREEMENT SETTING OUT TERMS AND OBLIGATIONS OF SOUTH BAY GUIDANCE CENTER IN REGARD TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED THZS AGREElqENT, made and entered ~nto this 8th day of August , 1989, by and between the CZTY OF CHULA VZSTA, a municipal corporation, hereinafter referred to as "Ctty" and SOUTH BAY GUIDANCE CENTER, heretnafter referred to as "Grantee", 14ITNESSETH 14HEREAS, the City ~s currently ~nvolved tn a Community Development Block Grant program, a principal goal of which is to benefit low. and moderate. ~ncome persons; and I~HEREAS, the Gr, an~e ts ,e~lu~pped and willing to pro;tde certain services to the City which w~11 primarily. benefit low and moderate tncome persons and has the necessary expertise tn this field for completing the same; and, WEREAS, the City ts desirous of having those certain services, heretnafter enumerated, performed by the Grantee; and, NHEREAS, funding for the Grantee ts contingent upon receipt" if a Letter of Credit authorizing a drawdown of Block Grant funds from the U, S, Department of Housing and Urban Development (HUD); and 14HEREAS, no expenditure may be made out of any appropriation awarded such a Grantee unless an agreement has .been reached between the parties d t . for the setting out the terms an oh1 gattons expenditure of such funds. 14HEREAS, the Grantee agrees that in receiving City CDBG funds the Grantee is not an agent or representative of the Ctty, and that all operatlons are Independent of the City. The Grantee also agrees to Indemnify and hold the City free and harmless from any and all liability connected with the Grantee's operation or use of funds. N014, THEREFORE, in conslderatton of the mutual obltgatfons of the parties as herein expressed, the parties hereto agree as follows: 1. The term of this agreement shall be for a period of one. (1) year, from July 1, 1989, through June 30, 1990, unless further modtfted to include other permitted expenditures of funds that are .appropriated by the Ctty Council. Z. Tile admt nt strait on .... ~f' 'the Grantee agrees to expend City-appropriated funds to meet bona flde obligations tncurred for the operation of a psychiatric treatment center serving adolescents, adults, and senior citizens, for the perlod J~ly 1, 1989, through June 30, 1990, for an amount not to exceed $10,000 a~ demonstrated (nthe budget attached as Exhibit A and incorporated herein. 3. Payment of those C(ty-approprtated funds shall be made to 'the. .. Grantee in quarterly Installments tn roughly equal amounts following recetpt by the City of expense reimbursement claim forms from Grantee.. 4, The Gran'tee shall maintain all financial records for three years .~ ~,!. following the year in which it was active, 5, %n exchange for those City-appropriated funds, the Grantee agrees to provide crisis intervention, community services, and mental health · '- prevention to children, adolescents, adults., and senior citizens, *. -- 6, The Grantee shall provide.the City with a quarterly report to include the following statistics relative to clients referred to the psychiatric center: "' (1) Number of clients served (2) Types of services provided to clients and number of clients receiving each type of service. i. The Grantee agrees to abide by the requirements of HUD regulations 24 CFR 570.502. 13. The Grantee agrees to abide by the requirements of ONB Circular' A-122 "Cost Principles for Non-Profit Organizations." 14. The Grantee shall account 'for use of Block Grant funds separately from other funds. so as to demonstrate that the funds are used for their designated purposes. 15. The contract may be terminated or;suspended by the City after 60 days nottce to the Grantee due to default by "the Grantee or the Grantee's inability to perform. regardless of ~hether such Inability ts due to circumstances within or beyond the grantee's control. Settlement of any disputes shall be based on the laws of the State of California. 16. The parttes reserve the right' to pursue any remedy provided under California law for remedy tn Instances ~here ,contractors vtolate or breach contract terms. 17. Any program tncome derived ,fro~ Block Grant funds must be used for ~servlce operations funded undeP.,thts contract. . 18. The Grantee shall transfer, any remaining CDBG funds to the City at. the t~me of expiration of contract. 19. The Grantee shall maintain a drug-free Norkplace at all times for the duration of this contract.
