RESOLUTION NO. 15236
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY
OF CHULA VISTA AND METROPOLITAN YMCA <SOUTH BAY
BRANCH) AND AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT
The City Council of the City of Chula Vista does hereby resolve as
follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chul a Vista that that certain agreement between THE CITY OF CNULA VISTA, a
municipal corporation, and METROPOLITAN YMCA (South Bay Branch), in regard to
the expenditure of City funds appropriated, dated the 8tb day
of August , 1989, a copy of which is attached hereto and incorporated
herein, the same as though fully set forth herein be, and the same is hereby
approved.~
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be,
and he is hereby authorized and directed to execute said agreement for and on
behalf of the City of Chula Vista.

AGREEMENT SETTING OUT TERMS AND OBLIGATIONS OF METROPOLITAN YMCA OF
SAN DIEGO COUNTY (SOUTH BAY BRANCH) IN REGARD
TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED
THIS AGREEHENT, made and entered ~nto thts 8th day of August,
1989, by and bel~een the CITY OF CHULA VISTA, a municipal corporation,
heretnafter referred to as "City" and YMCA, a California public benefit
corporationI which operates the South Bay Family YMCA, heretnafter referred to
as Grantee.

WEREAS, the City ~s currently Involved tn a Community Development
Block Grant program, a principal goal of ~htch ts to benefit low and moderate
Income persons; and ·
NHEREAS, the' 'Grantee!' tS""equ(pped and wtlltng to provtde certain
services to the City ~htch wtll primarily benefit low and moderate Income
persons and has the necessary expertise tn thfs field for completing the same;
and,
NHEREAS, the C~ty. ~s destrous of having those certatn services,
heretnafter enumerated, performed by the Grantee; and, ..-
14HEREAS, funding for the Grantee ~s contingent upon receipt of a
Letter of Credtt authorizing a dra~do~n of Block Grant funds from the U. S.
Department of Houstng and Urban Development (HUD); and
NHEREAS, no expenditure may be made out of any appropriation awarded
such a Grantee unless an agreement has been reached be~een the parties
settfng out the terms and obligations for the expenditure of such funds.
t4HEREAS, the Grantee agrees that tn receiving City CDBG funds the
Grantee ts not an agent or representative of the City, and that all operations
are independent of the Ctty, The Grantee also agrees to Indemnify and hold
the Ctty free and harmless from any and all 11ability connected wtth the
Grantee's operation or use of funds.
N014, THEREFORE, in consideration of the mutual obligations of the
parties as herein expressed, the parties hereto agree as follows:
1. The term of this agreement shall be for a period of one (1)
year, from July 1, 1989, through June 30, 1990, unless further roodtried to
tnclude other permitted expenditures of funds tlle~ are appropriated by the
Ctty Counct1.
2. The admintstratlon of the Grantee agrees to expend
Cfty-appropr(ate~ funds to meet bona fide obligations incurred for the
operation of a childcare site serving children from Harborside, Otay,
Nontgomery, Feaster and V'is~a Square Elementary Schools, for the tod

July 1, 1989, through June , 1990, for an amount not to exceed $27,~ as
demonstrated (n the budget attached as ExhtbJt A and incorporated here(n.
3. Payment of those City-appropriated funds shall be made to the
Grantee tn monthly tnstallmenta in roughl~ equal amounts following receipt by
the Ctty of expense reimbursement claim forms from Grantee.

4. The Grantee shall maintain all financhl records for three years
following the year tn which tt was active.
5. In exchange for those City-appropriated funds, the Grantee
a~rees to forward reports by the California Department of Sociaq Services for
s~te inspection visits.
