RESOLUTION NO. 15235
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY
OF CHULA VISTA AND SAN DIEGO RESIDENT RELATIONS
FOUNDATION AND AUTHORIZING THE MAYOR TO EXECUTE
SAID AGREEMENT
The City Council of the City of Chula Vista does hereby resolve as
fol 1 ows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chul a Vista that certain agreement between THE CITY OF CHULA V I STA, a
municipal corporation, and SAN DIEGO RESIDENT RELATIONS FOUNDATION, in regard
to the expenditure of City funds appropriated, dated the 8tl~ day
of . August , 1989, a copy of which is attached ~o and
incorporated herein, the same as though fully set forth herein be, and the
same is hereby approved.~
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be,
and he is hereby authorized and directed to execute said agreement for and on
behalf of the City of Chula Vista.

IN REGARD TO THE EXPENDITURE OF CITY FUNDS APPROPRIATED

referred to as "City" and SAN DIEGO RESIDENT RELATIONS FOUNDATION, hereinafter
referred to as -"Grantee".

14HEREAS. the City ts currently tnvolved ~n a Community Development
Block Grant program, a principle goal of ~htch is to benefit lw and moderate
income persons; and ,
tiHEREAS, the Grantee ~s equtpped 'and willing to !~rovtde certain
services to the City ~hich ~111 primarily benefit low and moderate income
persons and has the necessar~ expertise in this field,for completing the same;
14HEREAS, the City is desirous of having those certain services,
heretnafteP enumerated. performed bY' the Grantee; and. '-
14HEREAS. funding for the Grantee ~s contingent upon receipt of a
Letter of Credit authorizing a drawdown of Block Grant funds from the .U.S.
Department of Housing and Urban Development (HUD); and
NHEREAS, no expenditure may be made out of any appropriation awarded
such a Grantee unless an agreement has been reached between the parties
setting out the terms and obligations for the expenditure of such funds.
14HE~EAS, the Grantee.-agrees that in receiving City CDBG funds the
Grantee is not an agent or representative of the City, and that all operations
are independent of the City. The Grantee also agrees to indemnify and hold
the City free and harmless from any and all liability connected with the
Grantee's operation or use of funds.
N014, THEi~EFORE. ~n consideration of the mutual obligations of the
parties as herein expressed, the parties hereto agree as follows:
1. The term of this agreement shall be for a period of one {1)
year. from ~luly 1, 1989, through June 30, 1990, unless further modified to
include other permitted expenditures of funds that are appropriated by the
City Council.
2. The admt nt stratt on of the Grantee agrees to expend
City-appropriated funds to meet bona fide obligations incurred for staff
costs, utilities, ',~Bnsportatton, supplies and postage costs-associated ~th
provision of services to low ~ncome Chula Vista residents, for the period ~luly
1, 1989, through ~lune 30, 1990, for an amount not to exceed $8,100. as
demonstrated (n the budget attached as Exhibit A and incorporated herein.
3. Payment of those City-appropriated funds shall be made to the
Grantee in quarterly installments in roughly equal amounts following receipt
by City of expense reimbursement claim forms from Grantee. .

: services rendered pursuant to the agreement and shall administer th~s
:agreerant on behalf of the City.
:, '10. The President of San DIego Resident RelaUons Foundation or
his/her:designated representaUra, shall represent the Grantee ~n all matters
to the services rendered pursuant to the agreement and shall
this agreement on behalf of the Grantee.
11. The Grantee shall comply with Executive Order 11246, enUtled
"Equal Employment Opportunity," as amended by Executive Order 11375 and as
supplem, ented in Department of Labor regulations 41 CFR Part 60.
12. The Grantee agrees to abt de by the requl rements of' :;,,',the '-
Department of Housing and Urban Development regulations 24 CFR 570.502. ., ,.,
13. The Grantee also agrees to abide by the requirements of'.. 0f48
Circular A-122 entttled "Cost Princlples for Non-Profit Organizations." .:
14. The contract may be temlnated or suspended by the City afte~ 50'
days notice to the Grantee due to default by-the .Grantee or the Grante~'s
Inability to perfom, regardless 'of whether such inability is' due...'to -'
circumstances wtthtn or beyond the grantee's control.' Settlement 'of any
disputes shall be based on the laws of the State of California. .-, :,
15. The parties reserve the, right' to pursue any remedy provided
under California law for remedy, tn Instances where contractors violate or ,.
breach contract terms. -.
16. The Grantee shall account for the use of Block Grant funds
separately from other funds. so as to demonstrate'that the funds are used,'.for
their designated purposes. '
17. Any program income derived from Block Grant funds must be
reported to the City and etther returned to the City or used for the purposes
specified under this contract.
18. The Grantee shall transfer any remalntng CDBG funds 'to the City
at the time of expiration of this contract.
19. The Grantee shall maintain a drug-free workplace at all times
for the duration of this contract.
