HomeMy WebLinkAboutReso 1977-8673RESOLUTION NO. 8673 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING THAT CERTAIN MEMORANDUM OF UNDER- STANDING CONCERNING WAGE5 AND OTHER TERMS AND CONDITIONS OF EPZPLOYMENT BETWEEN THE CITY OF CHULA VISTA AND THE CHULA VISTA CHAPTER, WESTERN COUNCIL OF ENGINEERS FOR FISCAL YEAR 1977-78 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Management Negotiation Team representing the City Manager of the City of Chula Vista, acting for and on behalf of the City Council of the City of Chula Vista, have heretofore met and conferred with the Chula Vista Chapter, Western Council of Engineers, an organization representing certain members of classified employees in the City of Chula Vista, in accordance with the provisions of Section 3500 et seq. of the Government Code of the State of California, and WHEREAS, the Memorandum of Understanding jointly prepared by said parties as a result of meeting and conferring in good faith has been presented to the City Council and is contained in Exhibit "A" attached hereto and incorporated herein by reference as if set forth in full. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve and accept said Memorandum of Understanding as contained in Exhibit "A" for fiscal year 1977-78. WHEREAS, as a result of meeting and conferring in good faith with said group, agree- ment has been reached on the folloa~ing terms and conditions of employment as applied to those classified employees who are members of, and represented by, said organiza- Lion and said representatives of the City of Chula Vista and of the Chula Vista Chapter, 4Jestern Council of Engineers do Hoar jointly prepare a written Memorandum of Understanding concerning said agreed terms and conditions of employment for presenta- tion to the City Council of the City of Chula Vista for determination, to wit: 1. The City of Chula Vista and the Chula Vista Chapter, 4Jestern Council of Engineers hereby agree to certain salary adjustments as contained in Attachment "A" attached hereto and incorporated herein by reference as it sei~ forth-in full. 2. The City of Chula Vista and the Chula Vista Chapter, Western Council of Engineers hereby agree to the folloa~ing proposals as contained in Attachment "8" attached hereto and incorporated herein by reference as it sets forth in ful]. 3. It is further understood and agreed that any other benefits and ~vortring conditions and the terms and conditions as specified in this agreement or other published City documents thereof presently in effect shall remain unchanged unless and until said terms and conditions shall be modified as a result of meeting and conferring in good faith between the City of Chula Vista and .the Chula Vista Chapter, Western Council of Engineers pursuant to the provisions of Section 3500 of the Government Code of the State of California. 4. If any provision of the agreement, or the application of such provision, should be rendered or declared invalid by any court action or by reason of any existing or subsequently enacted legislation, the remaining parts or ortions of this agreement shall remain in full force and effect. . ~ > A. ATTACliME(~T "B" R EFFECTIVE JULY 1, 1977 1. Classifications represented by the Chula Vista Chapter, !~lestern Council of Engineers, 4ri11 be given the option of the City's current Group Insurance .Program or participating in the Kaiser Plan. The City grill pay the full _ cost of the regular program for employees or an equal dollar amount toward the Kaiser Plan, with the employee paying the excess. 2. The current Bilingual Pay Differential will be modified to $25/month. 3. Members in this unit ~•rho are assigned, 4rith the approval of the appointing authority, the normal duties of higher level positions for~more than 30 days 4ri11 be compensated at a rate 5% above their current salary, commencing the thirty first day. 4. The Junior Civil Engineer classification will be considered as career ad- vancement to the Assistant Civil Engineer level. 5. The current vacation accrual and accumulation standards shall remain in effect, with any individual transition difficulties to be handled in a mutually satisfactory manner. 6. Employees in this unit will have the option of placing up to the amount of their salary increases granted this year (on Attachment "A") into a "defer^ed compensation" plan t•rhich the City will pay to the Public Employees' Retirement System. Employees in this unit are advised that there may be a question as to the practicability of such a plan and they could, as a result of an adverse I.R.S. or judicial ruling, be ineligible for such a plan.
