HomeMy WebLinkAboutReso 1989-15230 (c) RESOLUTION NO. 15230 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND SOUTH BAY MEALS-ON-WHEELS AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Chula Vista does hereby resolve as fol 1 ows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that certain agreement between THE CITY OF CHULA VISTA, a municipal corporation, and SOUTH BAY MEALS-ON-WHEELS, in regard to the expenditure of City funds appropriated, dated the 8th day of August , 1989, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. ~ BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of the City of Chula Vista. THIS AGREEMENT, made and entered tnto this 8{;hday of Aueuat 1989, by and between the CITY OF CHULA VISTA, a municipal corporation, heretnafter referred to as "CITY," and SOUTH BAY MEALS-ON-HEELS, a nonprofit charitable organization, here{nafter referred to as "SBMOW," a division of Sen{or Adult Services, Inc, WXTNESSETH: WHEREAS, the City Council of the City of Chula Vista has determined that the functton of SBMOW serves. a valid public purpose and' primarily benefits low and moderate income persons, and WHEREAS, funding for SBMOW is contingent upon receipt of a Letter of Credit authorizing a drawdown of Block. Grant funds from the U, S, Department of Housing and Urban Development (HUD); 'and WHEREAS, the Ctty Council of the City of Chula Vista destres to encourage the beneficial atms of the SBM014 organization through appropr.tatton G funds, and of Block rant 14HEREAS, the City Council has established a policy for consideration of requests for funding by private organizations and Individuals, and WHEREAS, such policy stipulates that no expenditure may be made out of any appropriation awarded said charitable organizations unless an agreement has been reached between the parties setting out the terms' and obligations for the expenditure of such funds. 14HEREAS, .the Grantee agrees that in recetvlng Ctty CDBG funds the Grantee is not an agent or representative of the Ctty, and that all operations are independent of the City. The Grantee also agrees to indemnify and hold the City free and harmless from any and all liability connected wtth the Grantee's operation or use of funds. N014, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. That the term of this agreement shall be for. a pertod of one (1) year, from July 1, 1989, through June 30, 1990, unless further modtfted to t nclude other permitted expenditures of funds t;~at are appropriated by the C~ ty Cou,~ct I. 2. The nonprofit organization known as South Bay t4eals on 14heels agrees to provide ~ community s~.rv~ce through voluntary workers to prepare adequate r..eals for those pers.nns who are unable, either because of chronic or temporary illness, d~sabtltty, or age, to prepare such meals for themselves. 3. The meals will consist of a hot noon meal and a cold support Honday through Friday delivered to the residence of the recipient.
