RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, CALIFORNIA, RECITING THE FACT OF THE GENERAL
MUNICIPAL ELECTION HELD IN SAID CITY OF CHULA VISTA
ON THE 12th DAY OF APRIL, 1977, DECLARING THE RESULT
THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY
THE PROVISIONS OF THE CHARTER OF THE CITY OF CHULA
VISTA
WHEREAS, a regular general municipal election was held and
conducted in the City of Chula Vista, County of San Diego, State of
California, on Tuesday, the 12th day of April, 1977, as required by
the Charter of the City of Chula Vista, and
WHEREAS, notice of said election was duly and regularly
given in time, form and manner as provided by law, that voting pre-
cincts were properly established; that election officers were appointed
and that in all respects said election was held and conducted and the
votes cast thereat, received and canvassed and the returns made and
declared in time, form and manner as required by the provisions of the
Elections Code of the State of California for the holding of elections
in cities, and
WHEREAS, pursuant to Resolution No. 8563, adopted the 5th
day of April, 1977, the City Clerk of the City of Chula Vista canvassed
the returns of said election and has certified the results to this
City Council, said results are received, attached and made a part
hereof as Exhibit "A".
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA VISTA,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
Section 1. That there were seventy-four (74) voting precincts
established for the purpose of holding said election, consisting of
the regular precincts in the City of Chula Vista, as established for
the holding of state and county elections.
Section 2. That said regular general municipal election
was held for the purpose of electing the following officer of said
City as required by the Charter of the City of Chula Vista, to-wit:
One (1) Mayor of the City of Chula Vista for a full
term of four (4) years.
Section 3. That at said regular general municipal election,
the following measures were submitted to the electors of said City,
to-wit:
PROR OS I TION A
Amend Article IV, Sections 400 and 401 thereof, of the
Charter of the City of Chula Vista to be, and to read
as follows:

Sec. 400. City Manager.
Appointment; Salary. There shall be a City Manager
who shall be the executive officer of the City. He
shall be appointed by and serve at the pleasure of the
City Council. He shall be chosen on the basis of his
administrative qualifications and shall be paid a
salary, fixed by the Council, commensurate with his
responsibilities.
Removal. The City Manager may be removed from
office by motion of the City Council adopted by at
least three affrimative votes.
Ineligibility. No person shall be eligible to re-
ceive appointment as City Manager while serving as a
member of the City Council, nor within one year after
he has ceased to be a City Councilman.
Sec. 401. City Manager; Powers and Duties.
Generally. The City Manager shall be the head of
the administrative branch of the City government. He
shall be responsible to the City Council for the proper
administration of all affairs of the City. Without
limiting the foregoing general grant of powers, respon-
sibilities and duties, the City Manager shall have power
and be required to:
(a) A pointment and Removal of Employees and
O facers.
Subject to the provisions of Section 500 of Article
V of the Charter, the City Manager shall appoint all
department heads and officers of the City except elec-
tive officers and those department heads and officers
whose power of appointment is vested in the City Coun-
cil, and pass upon and approve all proposed appointments
and removals by department heads and other appointive
officers.
(b) Prepare the budget annually, submit such bud-
get to the City Council, and be responsible for its
administration of ter adoption;
(c) Prepare and submit to the City Council as of
the end of the fiscal year a complete report on the
finances and administrative activates of the City for
the preceding year;
(d) Keep the City Council advised of the financial
condition and future needs of the City and make such
recommendations as may seem to him desirable;
(e) Establish a centralized purchasing system for
all City offices, departments and agencies;
(f) Prepare rules and regulations
contracting for, purchasing, storing,
or disposal of all supplies, material
required by any office, department or
City government and recommend them to
for adoption by it by ordinance;

(g) Enforce the laws of the State pertaining
to the City, the provisions of this Charter and
the ordinances of the City; and
(h) Perform SUCK other duties consistent with
this Charter as may be required of him by the City
Council.
PROPOSITION B
Amend Article VI, Section 611 thereof, of the Charter
of the City of Chula Vista to be, and to read as
follows:
Sec. 611 Civil Service Commission.
There shall be a Civil Service Commission consisting
of five (5) members to be appointed by the City Council
from the qualified electors of the City, none of whom
shall hold any salaried City office or employment.
The members of the Civil Service Commission shall
be nominated and appointed in the following manner:
Two (2) members shall be appointed by the City Council
from a list of four (4) persons to be nominated by elec-
tion of the employees in the Classified Service, two (2)
members shall be appointed by the City Council directly,
and the fifth shall be appointed by the City Council
from a list of three (3) persons nominated by the four
(4) thus appointed. The successor of any member of
the Commission shall be nominated and appointed in the
same manner as such member was nominated and appointed.
The term of the members of the Civil Service Com-
mission shall be four (4) years. Members shall hold
office until their respective successors are appointed.
The terms of members shall commence on the first day
of July and as soon as practicable upon the appoint-
ment of three (3) members after ratification of this
amendment, the Civil Service Commission shall organize
by electing one of its members to serve as chairman
at the pleasure of the Commission. All proceedings
of said Commission shall be open to the public and a
majority vote of the entire membership of such Com-
mission shall be necessary for it to take action.
PROPOSITION C
Amend Article VIII, Sections 800 through 804 thereof,
of the Charter of the City of Chula Vista to be, and
to read as follows:
Sec. 800. Merit Principle.
Appointments and promotions in the Classified Ser-
vice of the City shall be made according to merit and
fitness and from eligible lists to be established in
accordance with Civil Service rules and regulations
adopted in the manner provided in this Charter.

Sec. 801. Unclassified and Classified Service.
The Civil Service of the City shall be divided into
the Unclassified and the Classified Service.
(a) Unclassified Service. The Unclassified Service
shall include the following officers and positions:
1. All elective officers;
2. City Manager, Director of Finance, City
Clerk, City Attorney, Assistant or Deputy
City Attorneys, Assistant City Manager, a
private secretary to the City Manager, a
private secretary to the Mayor and Council,
a private secretary to the City Attorney,
department heads, or as provided in Section
500 of this Charter.
3. All members of boards and commissions;
4. Positions in any class or grade created
for a special or temporary purpose and which
may exist for a period of not more than ninety
(90) days in any one calendar year;
5. Persons employed to render professional,
scientific, technical or expert service of
any occasional and exceptional character;
and
6. Part-time employees paid on an hourly or
per diem basis.
(b) CZassified Service. The Classified Service
shall comprise all positions not specifically included
by this section in the Unclassified Service.
Sec. 802. Repealed at election April 9, 1968.
Sec. 803. Rules and Regulations.
The Civil Service rules and regulations shall provide
for the following matters, in addition to such others
as the Civil Service Commission may deem necessary,
proper or expedient to carry on the intent and purpose
of the Civil Service provisions of this Charter.
1. The classification of all positions in the
Classified Service.
2. The selection, employment, advancement, suspen-
sion, demotion, discharge and retirement of all
persons in the Classified Service.
3. The recruitment of applicants for City positions
through public advertisement inviting applications
and by the establishment of lists according to the
merit and fitness of the applicants, to be deter-
mined by free examinations in accordance with .such
rules. The holding of promotional examinations to
fill vacancies where promotional examinations are
practicable in the opinion of the Civil Service Com-
mission.

4. The number and method of certifying names
standing highest on the eligible list to the
appointing authority to fill a position in the
Classified Service.
Sec. 804. Appointments from Classified
Service Positions.
In the event an officer or employee of the City
holding a position in the Classified Service is ap-
pointed to a position in the Unclassified Service,
and should within six months thereaf ter be removed
or resign therefrom, he shall revert to his former
position in the Classified Service without loss of
any rights or privileges and upon the same terms and
conditions as if he had remained in said position
continuously.
PROPOSITION D
.Amend Article XI, Section 1108 thereof, of the Charter
of the City of Chula Vista to be, and to read as
follows:
Sec. 1108 Bonded Debt Limit.
The City shall not incur an indebtedness evidenced
by general obligation bonds which shall in the aggre-
gate exceed the sum of fifteen percent (15~) of the
total assessed valuation, for the purposes of City
taxation, of all the real and personal property with-
in the City.
No bonded indebtedness which shall constitute a
general obligation of the City may be created unless
authorized by the affirmative votes of two-thirds of
the electors voting on such proposition at any elec-
tion at which the question is submitted to the electors
and unless in full compliance with the provisions of
the State Constitution and of this Charter. No bonds
payable out of any revenues of the City or of any de-
partment thereof, shall be issued without assent of
a majority of the voters voting upon the proposition
of issuing the same, at an election at which such pro-
positions shall have been duly submitted to the quali-
fied electors of the City.
Section 4. That the whole number of votes cast in said
City (except absent voter ballots) was 9453.
That the whole number of absent voter ballots cast in
said City was 175, making a total of 9628 votes cast in said City.
Section 5. That the names of persons voted for at said
election for Mayor of the City of Chula Vista are as follows:
Frederick A. R. (Fred) Drew
Donald A. Painter
Will T. Hyde
Clay Ford
Norm Ross
That the propositions voted upon at said election are as
set forth hereinabove, and

That the number of votes given at each precinct and the
number of votes given in the City to each such person above named
for the office of Mayor, and for and against the propositions set
forth herein are as shown in Exhibit "A", attached hereto and made
a part hereof by reference.

Section 6. That the City Council does declare and deter-

That as a result of said election, a majority of the quali-
fied voters voting on Proposition C, did not vote in ffavor thereof,
and that said change was not carried and shall not be deemed adopted
and ratified, and
That as a result of said election, a majority of the quali-
fied voters voting on Propositions A, B and D did vote in favor there-
of, and that said propositions carried, and shall be deemed adopted
and ratif ied .
Section 7. That the City Clerk shall enter on the records
of the City Council of said City a statement of the results of said
election showing:
(1) The whole number of votes cast in the City;
(2) The names of the persons voted for;
(3) The propositions voted upon;
(4) The office for which each person was voted for;
(5) The number of votes given at each precinct to
each person and for and against each proposition.
Section 8. That the City Clerk shall immediately make
and, upon compliance by the person elected with the provisions of
Section 11550 and Section 11559 of the Elections Code of the State
of California, shall deliver to such person so elected a Certificate
of Election signed by her and duly authenticated; that she shall
also administer to such person elected, the Oath of Office pre-
scribed in the State Constitution of the State of California and
shall have him subscribe thereto and file the same in her office.
Whereupon, such person so elected shall be inducted into the office
to which he has been elected.
Section 9. That the City Clerk shall certify to the
passage and adoption of this resolution; shall enter the same in the
book of original resolutions of said City; and shall make a minute
of the passage and adoption thereof in the records of the proceedings
of the City Council of said City, in the minutes of the meeting at
which the same is passed and adopted.

I, Jennie M. Fulasz, City Clerk of the City of Chula Vista, California,
County of San Diego, State of California, duly authorized by Resolution
No. 8563, adopted by the City Council of said City on the 5th day of
April 1977, do hereby certify that I have canvassed the returns of the
regular general municipal election held in said city on the 12th day
of April 1977, and find that the number of votes given at each precinct
and the number of votes given in the City to persons voted for, the
respective office for which said persons were candidates and for
and against the measures were as follows:
That the whole number of votes cast in the City of Chula Vista,
California was 9634..
That the following person was elected to fill the office of Mayor for
a term of four years:
Will T. Hyde
That the following propositions were voted upon at said election:
PROPOSITION A: An amendment to the Charter of the City of Chula Vista
amending Article IV, Sections 400 and 401 thereof,
designating the City Manager as the executive officer
of the City and authorizing the City Manager to appoint
all department heads and officers of the City except
elective officers and those department heads and officers
whose power of appointment is vested in the City Council.
PROPOSITION B: An amendment to the Charter of the City of Chula Vista
amending Article VI, Section 611, eliminating the pro-
hibition against service for a period of one year by
members of the Civil Service Commission from serving
in any elected or appointive positions in the City.
PROPOSITION C: An amendment to theCharter of the City of Chula Vista
amending Article VIII, Sections 800 through 804 pro-
viding for the deletion of obsolete phraseology which
has been previously apg~roved, and the elimination of the
restrictive "Rule of Three."

PROPOSITION D: An amendment to the Charter of the City of Chula
Vista amending Article XI, Section 1108 thereof,
eliminating references to the Water Department of
the City, which no longer exists.
That as a result of said election, a majority of the qualified voters
voting on said Propositions A, B, and D did vote in favor thereof,
and that said Propositions carried and shall be deemed adopted.
That as a result of said election, a majority of the qualified voters
voting on said Proposition C relating to a Charter change did vote
against the Proposition and therefore, it shall be deemed defeated.
That attached hereto and made a part hereof is a list of persons voted
for and the Propositions and measures voted on, together with the
number of votes received in each precinct and the total votes received
in the election.
Further, that the number of precincts in said election was 74.
I certify that the foregoing statement of results is a full, true and
correct statement of the facts of said canvass and of the results of
said election, and that as soon as the result was declared, the afore-
said statement was duly entered by me, the City Clerk of the City of
Chula Vista, on the records of said City Council.
