TO 3:00 P.M. AND SUNDAY, AUGUST 7, 2011 FROM 7:00 A.M. TO 10:30 A.M. AND APPROVING AN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND USA TRIATHLON FOR THE EVENT SUBMITTED BY: COMMUNICATIONS ORDINATOR REVIEWED BY: CITY MANAGER ASSISTANT CITY ANAGER S 4/STHS VOTE: YES ~ NO SUMMARY USA Triathlon is requesting permission for the temporary intermittent street closure of Bay Boulevazd from "H" Street to "L" street and segments of Marina Pazkway and West "J" Streets on Saturday, August 6 and Sunday, August 7, 2011 to conduct the 2011 USA Triathlon Jr. and Youth National Championships in and around Marina View Pazk, Chula Vista Bayfront Park and the Chula Vista Harbor. ENVIRONMENTAL REVIEW The City's Environmental Review Coordinator has reviewed the proposed projects for compliance with the California Environmental Quality Act and has determined that the projects qualify for a Class 4 categorical exemption pursuant to Section 15304(e) of the State of CEQA Guidelines. Thus, no further environmental review is necessary. RECOMMENDATION That the City Council adopts the resolution. BOARDS/COMMISSION RECOMMENDATION 7-1 JULY 19, 2011, ITEM? Page 2 Not Applicable DISCUSSION USA Triathlon (sponsor) in partnership with the San Diego Sports Commission plans to conduct the 2011 USA Triathlon Jr. and Youth National Championships in and around Marina View Pazk, Chula Vista Bayfront Park and the Chula Vista Hazbor on Saturday, August 6 and Sunday, August 7, 2011. In order to safely conduct this youth triathlon, event sponsors aze requesting the temporary intermittent street closures of Bay Boulevazd from "H" Street to "L" Street and segments of Marina Parkway and West "J" Streets. These streets would be closed to traffic from 7:30 a.m. to 3:00 p.m. on Saturday, August 6 and from 7 to 10:30 a.m. on Sunday, August 7, 2011 in order to stage the event. Diagram of road closure is attached. The USA Triathlon 2011 Jr. and Youth National Championships consists of nine individual youth races in swimming, biking and running over the course of two days. The sponsor anticipates approximately 500 youth and junior competitors ranging in ages from 7 to 19 yeazs of age in attendance, including athletes from Canada, Mexico and Puerto Rico. The sponsor expects an additional 500 spectators each day through the event. This is the first year for this event in the city. The Chula Vista Police, Fire Department and Traffic Engineering departments have reviewed and approved the traffic control plan and road closure. The City of Chula Vista Police Department will be overseeing traffic control, street equipment, directional signage and use of City streets. The City's transit system will not be affected. The sponsor is required to provide the adequate insurance as requested by Risk Management as outlined in Attachment "A." Also, the approval of the request will be subject to the conditions listed on the above-mentioned attachment. The closure of the requested streets will affect the flow of traffic in the mentioned area. Event sponsors will be required to communicate with the Port of San Diego, local businesses as well as the marina district how traffic will affect the day-to-day activities during the two-day event. The street closures aze intermittent which allow traffic to local businesses during the event. Roads will be open to traffic in between competifions. On Saturday, August 6, races will last approximately 45 minutes each with approximately 30 minutes to 45 minutes between each race. On Sunday, races begin at 8 a.m. and end by 10:30 a.m. in which the road will be re-opened for traffic On either day, should the general public need immediate access to the marina area and cannot wait for the next opening, traffic will be detoured north to "F" Street/Lagoon Drive to access Marina Parkway to prevent any delays. Chula Vista Police Department will be on-site to monitor all traffic access throughout the event. The Port of San Diego has pernutted the pazk and marina usage since this event takes place on their property. The Port permit is responsible for all pazk and marina logistics 7-2 JULY 19, 2011, ITEM Page 3 including all activities in the pazk and off shore, pazk maintenance, parking lots, trash services, portable toilets, etc. Additional duties of the event aze listed in the agreement between the City and USA Triathlon. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the property, which is subject of this action. CURRENT YEAR FISCAL IMPACT The event sponsor will be responsible for all event costs. Any services provided by the City before, during or after the event will be fully reimbursed by the sponsor. ONGOING FISCAL IMPACT None. AND SOUTH NATIONAL CHAMPIONSHIPS 7-4 ATTACHMENT "A" AGREEMENT Between the CITY OF CHULA VISTA, a California municipal corporation and USA TRIATHLON for the 2011 USA TRIATHLON JR. AND YOUTH NATIONAL CHAMPIONSHIPS Recitals A. USA Triathlon will conduct the 2011 USA Triathlon Jr. and Youth National Championships on Saturday, August 6 and Sunday, August 7, 2011. B. USA Triathlon requests to close intermittent street closures of Bay Boulevard from "H" Street to "L" Street and segments of Marina Parkway and West "J" Streets from 7:30 a.m. to 3:00 p.m. on Saturday, August 6 and from 7 to 10:30 a.m. on Sunday, August 7, 2011 in order to stage the event. Agreement 1. USA Triathlon Duties USA Triathlon shall perform each of the duties described in Attachment A, attached to this Agreement and incorporated into this Agreement by this reference. 2. Term This Agreement is effective upon the execution of the Mayor and expires on August 8,2011. 3. Ternunation of Agreement If USA Triathlon fails to fulfill, in a timely and proper manner, any of USA Triathlon obligations or duties under this Agreement, or if USA Triathlon violates any of the covenants, agreements or stipulations of this Agreement, City has the right to temunate this Agreement by giving at least one (1) day written notice to USA Triathlon of the termination before the effective date of the termination. 4. Assignability USA Triathlon shall not assign or transfer any interest in this Agreement without prior written consent of City. 7-5 5. Independent Contractor USA Triathlon and any of the USA Triathlon's agents, employees or representatives aze, for all purposes under this Agreement, independent contractors and shall not be deemed to be employees of City, and none of them shall be entitled to any benefits to which City employees aze entitled including but not limited to, overtime, retirement benefits, worker's compensation benefits, injury leave or other leave benefits. 6. Insurance USA Triathlon represents that it and its staff and agents employed by it in connection with the Special Event are protected against the risk of loss by the insurance coverage outlined in Attachment A, Duties of USA Triathlon including naming the City, it officials, officers, agents, employees and volunteers as additional insured. 7. Hold Harmless USA Triathlon agrees to defend, indemnify and hold harmless the City, its elected and appointed officials, officers, agents and employees pursuant to the Group/Organization Waiver and Release of Liability executed by USA Triathlon. 8. Notices All notices to be given pursuant to this Agreement must be in writing. All notices to be sent to any parry shall be deemed to have been properly given or served if personally served or deposited in the United States mail, addressed to such party, postage prepaid, registered or certified, with return receipt requested, at the addresses identified in this Agreement as the places of business for each of the parties. 9. Entire Agreement/Amendments This Agreement, the Group/Organization Waiver and Release of Liability, and any other written document referred to or contemplated in this Agreement embody the entire Agreement and understanding between the parties. Neither this Agreement nor any attachment or provision may be amended or modified except in writing executed by each parry to the Agreement. 10. Full Cost Recovery USA Triathlon shall reimburse the City for all costs incurred by the City before, during, and after the Special Event. 11. AND YOUTH NATIONAL CHAMPIONSHIPS USA Triathlon shall perform the following to the satisfaction of the City Manager: 1. Submit proof of insurance in the form of a Certificate of Insurance for $2 million per occurrence, or equivalent form, with a policy endorsement naming the City as additional insured, making their insurance primary with respect to the City's insurance and providing notification of cancellation. 2. Provide, at its own expense, all necessary supplies and services required to safely conduct the event, including trash receptacles, trash control, crowd control, traffic control and traffic control equipment, signs and security, including any overnight security. Post applicable street closure signs and directional signs at least 48 hours in advance of the event. 4. Ensure that all participants, or their legal guazdians, sign liability waivers approved by the City Attorney as to form. These waivers must indicate that the USA Triathlon will indemnity and hold the City of Chula Vista harmless for any injury or loss of any kind in connection with the event. 5. Provide adequate supervision of event spectators and participants to prevent damage to City property and landscaping. 6. Provide adequate and sufficient street barricades and supervision to insure that no vehicles are permitted into the event area throughout the duration of the event. 7. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula V ista does hereby approve the intermittent closure of Bay Boulevazd from "H" Street to "L" Street and segments of Marina Parkway and West "J" Street for the 2011 USA Triathlon Jr. and Youth National Championships on Saturday, August 6, 2011 from 7:00 a.m. to 3:00 p.m. and on Sunday, August 7, 2011 from 7:00 to 10:30 a.m. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista approves the Agreement between the City of Chula Vista and the USA Triathlon a copy of which shall be kept on file in the office of the City Clerk, and authorizes the Mayor to sign the Agreement for and on behalf of the City of Chula Vista.
