"F" Street, between Fourth Avenue and Church Avenue will be partia~.ly financed with~FAU fund. There is no relocation assistance involved. Federal law requires that acquisition be in conformance with Title III of the Federal Uniform Relocation Assistance and Real Property Acquisition Policy Act of 1970. CALTRANS Local Assistance Officer recommends that the City adopt by resolution the State of California Regulations titled "Regulations of Procedure, Code Title 21, Chapter II, Subchapter II, Section 1407." These regulations govern the guidelines and procedures for acquisition and relocation assistance re- quired by the Federal Highway Administration. On May 5, 1977 the Redevelopment Agency adopted, by Resolution Number 79, guidelines for property acquisitions by the Department of Community Develop- ment. The guidelines are general in nature and do not conflict with the State Department of Transportation regulations. Right of way certification is required by the regulations for all acquisitions involving Federally funded projects. The certification is the Local agency's assurance statement that it has acquired all of the right of way necessary for the project and it was acquired in accordance with applicable Federal and State regulations. The City Council may or other responsible behalf of the City Agreement adopta resolution giving the Mayor, Public Works Director official, authority to sign right of way certification on Resolution, EXHIBITS Ordinance Plat Notification List Other ENVIRONMENTAL DOCUMENT: Attached Submitted on FINANCIAL IMPACT The City is eligible to receive up to $139,000 in FAU funds. These funds will finance a portion of the construction cost for the widening of "F" Street from Fourth Avenue to Church Avenue. If City Council does not approve this reso- lution adopting CALTRANS regulations and granting authority to sign right of way certifications, the City could become ineligible to receive Federal High- way funds. Without FAU funds, the City would have to put up an additional $139,000 to finance the project. STAFF RECOMMENDATION 1. City Council adopt California Department of Transportation Regulations for acquisition of property for street and highway purposes. 2.
