ITEM TITLE Resolution 8682: Approving Final Map for Rancho Robinhood III

The final .map for Rancho Robinhood III Subdivision has been checked by the
Engineering Division and found to be in conformity with the tentative
map approved by the City Council on October 26, 1976 by Resolution No.
8366. Robinhood Homes, Inc., subdivider, has paid all fees and submitted
all bonds and required documents. Approval of the final map includes
the dedication of a portion of Otay Lakes Road, Surrey Drive, Wagonwheel
Way, Corral Court, Rawhide Court and Camino del Cerro Grande. Easements
are being dedicated to the City for storm drain, sewer, street trees,
access and public utilities, equestrian trail and bicycle path purposes.
Lots 242, 243, 244, 245 and 246 are being dedicated to the City for park,
recreational, open space and other public uses.
California American 6Jater Company has informed the ~7eveloper that Lc?t^ _
132 through 199 inclusive can expect a fire flow of 1000 gallons per minute
which is inadequate for shake roofs. Building permits_f_or structures with
wood shingle roofs will not be issued for these lots unless the cleveloner
provides adequate fire flow in accordance with the requirements of the
City Fire Marshall.
One of the conditions for the approval of the tentative map is that the
owner/subdivider shall comply with Ordinance #1492 regarding Park Dedica-
tion fees. In accordance with Section 17.10.050 of the Municipal Code,
the City Council must determine the fair market value of land to be deve-
loped concurrent with. the approval of the Final Map. This determination
of fair market value is then used to compute the required park fees based
on the formula set forth in Section 17.10.

The present owner of Rancho Robinhood III is consumating the sale of the
property concurrent with the recordation of the final map. A copy of the
escrow intructions with the agreed sale price has been filed with the City.
The sale price is $1,500,000 for the 97.887 acres. Based on the formula
set forth in Section 17.10, the total park fee for land and improvements
is $26,760.25.
It is the staff's recommendation that the agreed upon selling price esta-
blished between the buyer and owner be used by the City Council to esta-
blish the fair market value of this site and that the City Council, accept
at this time the amount of $26,760.25 for the required park fees for Rancho
Robinhood III Subdivision. Justification of staff's recommendation to use
the actual selling price is contained in the attached memo from Kenneth Lee,
Current Planning Supervisor, dated June 13, 1977.

Subject: Required Park Dedication Fees for Rancho Robinhood III
In accordance with Chapter 17.10 of the Municipal Code, the City Council
must determine the fair market value of the proposed subdivision concurrent
with the approval of the final map, This determination of fair market
value is then used to compute the required park fee based on the formula
set forth in Chapter 17.10.
The present owner of the Rancho Robinhood III property is consumating
the sale of the site concurrent with the recordation of the final map.
A copy of the escrow instructions with the agreed sale price has been
filed with the City. That sale price of $1,500,000 for the 97.887 acres
computes out to a total park fee of land and improvements equal to
$26,760.25, based on the for-nula set forth in Chapter 17.10.
If the Council has reason to believe that the agreed upon sales rice
does not represent the fair market value of this property, the Council
may request that the developer secure an appraisal of the site before
the Council agrees to a figure establishing the fair market value.
It is staff's recommendation that the agreed
between the buyer and seller be used by~the Councilpin~egtablishing~the,hed
fair market value of this site and that the Council accept, at this time,
the figure of $26,760.25 for the required park fees for the subdivision
knovrn as Rancho Robinhood III.
