ITEM EXPLANATION
A. BACKGROUND
1. The applicant is requesting approval of a Precise Plan for the development of a
60-unit apartment complex on 3.45 acres of property located on the north side of East
Orange Avenue, approximately 580 feet west of Melrose in the R-3-P-17 zone. The proposed
project represents the final phase of development for the apartments currently built and
under construction west of the Alpha Beta Shopping Center.
2. The Environmental Impact Report (EIR-76-10) on this project was adopted by the
Planning Commission on November 8, 1976.
B. ANALYSIS
1. Site Characteristics.
The project site is a 3.45 acre parcel on the north side of East Orange Avenue
between the Alpha Beta Shopping Center and Phase I of the East Orange Plaza and immed-
iately south of Phase II of the same apartment project. The site is currently being
graded in conjunction with the grading for the Phase II development.
2. Precise Plan Proposal.
The applicant proposes to construct 44 two-bedroom and 16 three-bedroom units for a
total of 60 units on the site. The apartments are all two-story townhouse plans grouped

STAFF RECOMMENDATION:
Concur with the recommendation of the Planning Commission.
BOARD/ COMMISSION RECOMMENDATION
On April 6, 1977 the Planning Commission voted 5-0 to recommend that the City
Council approve the precise plan for Phase III of the East Orange Plaza development
in accordance with Resolution PCM-77-14.

into seven buildings. A swimming pool and recreation building are proposed within the
center area of the group of four buildings on the westerly end of the project. Five
garage structures with space for 10 cars each are located on the periphery. The garages
have been sited to provide visual and acoustical screening from the shopping center and
to create interior residential enclaves.
3. Architecture,
The same architectural styling and character as the adjacent Phase I and II of East
Orange Plaza is proposed for this development. Exterior materials will include cement
plaster, wood siding and extensive wood trim. The buildings will be, for the most part,
flat roofed with sloping wood shingled roofs for accent over central portions of the
building and over porches. The building masses are broken up with changes in wall line,
fences and architectural projections. Architectural treatment of the garage areas abut-
ting the shopping center and Orange Avenue is also proposed.
4. Parking and Circulation.
a. The Precise Plan for Phase TIT also includes a revision to the parking and
circulation pattern of Phase II. The changes are as follows: (1) The circulation
connection between Phases T and II is eliminated; (2) the driveway located between
Phase II and III has been realigned further south, closer to the Phase III development;
and (3) some rearranging of the driveway and garage locations has taken place.
b. The revised circulation pattern has resulted in Phase II and III being
developed as one project completely independent from Phase I. In staff's judgment, this
is a preferable treatment. The two parcels of Phase II and III will be required to be
consolidated through the parcel map or adjustment plat procedure concurrent with the
issuance of building permits. The revised circulation has also resulted in additional
landscaping adjacent to the three southerly buildings in the Phase II development,
better internal circulation, and easier access for vehicles entering and leaving via
Orange Avenue.
c. The required parking for the combined 120 units of Phase II and III is 233
spaces. The total parking provided is 252 spaces, 80 of which will be in eight garage
structures.
5. Landscaping.
Final landscaping plans and details will need to be submitted for approval of the
City Landscape Architect. Permanent irrigation will be required for all landscaped
areas of the development. Care should be taken that no trees or tall shrubs interfere
with sight lines for vehicular traffic, particularly at the major ingress-egress points
to the project. A combination of landscaping, walls and buildings will screen the
development from the shopping center.

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF THE PRECISE PLAN FOR EAST
ORANGE PLAZA, PHASE III
i
WHEREAS, Ordinance No. 1718 adopted by the Chula Yista City Council on
December 21, 1976 established the zone for 7.45 acres located north of East
Orange Avenue, west of Melrose Avenue, as R-3-P-17, and
WHEREAS, a precise plan for the development of a 60-unit apartment
complex, called East Orange Plaza Phase III, on 3.45 acres of the property was
filed by Celia A. Seligson on March 15, 1977, and
WHEREAS, an environmental impact report, EIR-76-18 on the project was
adopted by the Planning Commission on November 8, 1976, and
WHEREAS, the City Planning Commission held a public hearing at 7:00 p.m.
on Wednesday, April 6, 1977 in the Council Chamber, City Hall, to consider the
precise plan for development as submitted.
NOW THEREFORE BE IT RESOLVED THAT THE CITY PLANNING COMMISSION finds as
follows:
a. That such plan will not, under the circumstances of the particular case, be
detrimental to the health, safety and general welfare of persons residing or
working in the vicinity, or injurious to the property or improvements in the
vicinity.
The proposal is for residential units at a density within that permitted
by the zoning of the property and will result in the integration of East
Orange Plaza Phase II and Phase III into one project.
b. That such plan satisfies the principle for the application of the "P"
Modifying District as set forth in Section 19.56.041.
Deletion of the circulation between the existing East Orange Plaza Phase I
and Phase II allows Phase I to be completely separated from the Phase II
and Phase III development without adverse effects upon the circulation of
either project. The architecture for Phase III is an extension of an
existing development previously approved by the Planning Commission and
City Council.
c. That any exceptions granted which deviate from the underlying zoning require-
ments shall be warranted only when necessary to meet the purpose and application
of the "P" Precise Play Modifying District.
No exceptions to the zoning requirements are contained in the project.
d. That approval of this plan will conform to the General Plan and the adopted
policies of the City. .
The plan and land use are compatible with the General Plan.
BE IT FURTHER RESOLVED that the City Planning Commission recommends to
the City Council the approval of the Precise Plan for East Orange Plaza Phase III
as submitted by Celia ,A. Seligson, subject to the following conditions:
1. Final plans indicating grading, drainage and landscaping shall be
submitted for approval prior to issuance of any building permit.
2. Final plans shall indicate circulation details onsite and within
access easements (pavement widths, curbs, medians, etc.) along with
sufficient dimensions and details to indicate good traffic flow and
adequate access for emergency vehicles.
3. Parking shall be controlled by means of "No Parking" signs or other
devices acceptable to the Department of Public Works so that parking
does not encroach into required driveways or backup space.
4. The final grading plan shall indicate all required retaining walls,
steps and other transitions between dwelling units and open areas to
insure a smooth transition with the adjoining slope areas.

ACCEPTING GRANT DEED TO CERTAIN REAL PROPERTY FROM
CLARENCE E, MINNERLY FOR ONE FOOT CONTROL LOT "A" IN SOUTH
BAY VILLAS, UNIT NO. 2 SUBDIVISION
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE BE IT RESOLVED that that certain grant of
real property, made by grant deed executed by CLARENCE E. MINNERLY
for one foot control Lot "A" in South Bay Villas, Unit No. 2 Subdivision
dated the 21st day of March 1977 , to the CITY OF
CHULA VISTA, a copy of which is attached hereto and by this reference
made a part hereof, the same as though fully set forth herein be, and
the same is hereby accepted by the City of Chula Vista as a grant for
one foot control Lot "A" to control access and adjacent development
along the northerly portion of East J Street.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby authorized and directed to record
said document in the office of the San Diego County Recorder.
