ITEM EXPLANATION The developer of Bonita Ridge Estates Unit #4 Subdivision submitted a revised site plan and an improvement plan which affects Lots 196, 197, 198 and 219 of Bonita Ridge Estates Unit #4. The revision of the site plan and the improvement plans has been approved by the Planning Depart- ment and Department of Public Works respectively. The revision to the site plan and improvement plan relocates the private driveway and sewer which serves these lots. The developer has granted a new easement to the City for sewer purposes. The developer has filed an application requesting that the original easement across Lots 196, 197, 198 and 219 which was dedicated on the Final Map of Bonita Ridge Estates Unit #4 be vacated. The Public Service Easement Vacation Law of the State of California requires that a public hearing be held to hear people in favor of or objecting to the intended vacation. BOARD/ COMMISSION RECOMMENDATION The Planning Commission recommended vacation of the easement on March 9, 1977. The Commission made the following findings of fact with respect to the subject portion of the easement: 1. The original easement dedicated on Map 8370 is no longer needed and has not been utilized by the City nor any utility. 2. Anew easement has been granted to the City. Its location conforms to the location shown on the approved revised plot plan and improve- ment plan. 3. The public sewer serving Lots 196, 197, 198 and 219 of Bonita Ridge Estates No. 4 has been constructed within the new easement.. 4. All utility companies have been contacted and have no objection to the vacation of the original easement.
