ITEM EXPLANATION
The developer of Bonita Ridge Estates Unit #4 Subdivision submitted a
revised site plan and an improvement plan which affects Lots 196, 197,
198 and 219 of Bonita Ridge Estates Unit #4. The revision of the site
plan and the improvement plans has been approved by the Planning Depart-
ment and Department of Public Works respectively. The revision to the
site plan and improvement plan relocates the private driveway and sewer
which serves these lots. The developer has granted a new easement to
the City for sewer purposes. The developer has filed an application
requesting that the original easement across Lots 196, 197, 198 and 219
which was dedicated on the Final Map of Bonita Ridge Estates Unit #4
be vacated.
The Public Service Easement Vacation Law of the State of California
requires that a public hearing be held to hear people in favor of or
objecting to the intended vacation.
A transparency is available for Council viewing.

STAFF RECOMMENDATION:
City Council set April 19, 1977 at 7:00 p.m. in the City Council Chambers
as a date for the public hearing to hear people in favor of, or objecting
to the vacation of the easements across Lots 196, 197, 198 and 219 of
Bonita Ridge Estates Unit #4 Subdivision, Map 8370.
BOARD/ COMMISSION RECOMMENDATION
The Planning Commission recommended vacation of the easement on March 9,
1977. APPROVED

Subject: Vacation of general utilities, sewer and access easement
in Bonita Ridge Estates #4
At the meeting of March 9, 1977 the City Planning Commission considered
a request submitted by the developer of Bonita Ridge Estates No. 4
for the vacation of a 30 ft. wide general utilities, sewer and access
easement in Lots 1.95, 196, 197, 198 and 219 of Bonita Ridge Estates
Unit No. 4.
The Commission made the following findings of fact with respect to the
subject portion of the easement:
1. The original easement dedicated on Map 8370 is no longer needed and
has not been utilized by the City nor any utility.
2. Anew easement has been granted to the City. Its location conforms
to the location shown on the approved revised plot plan and improve-
ment plan.
3. The public sewer serving Lots 196, 197, 198 and 219 of Bonita Ridge
Estates No. 4 has been constructed within the new easement..
4. All utility companies have been contacted and have no objection to
the vacation of the original easement.
The Commission recommends that the subject easement be vacated.
