HomeMy WebLinkAboutAgenda Statement 1977/03/29 Item 04r CITY OF CHULA VISTA ITEM N0. 4 COUNCIL AGENDA STATEMENT FOR A~EETING OF: 329/77 ITEM TITLE Resolution 8S'S`'Declaring City's Intention to Vacate a Portion of Quintard Street and Tobias Drive Adjacent to Sweetheart Manor Subdivision and Setting Date for Public Hearing SUBMITTED BY~ Director of Public Works/City Engineer J ('~ yv '/ ITEM EXPLANATION Sweetheart Construction Company has submitted a request to vacate the easterly four feet of Tobias Drive and the northerly two feet of Quintard Street adjacent to the subdivision boundary of Sweetheart Manor Subdivi- sion. Vacation of this right of way will bring the right of way for the easterly half of Tobias Drive and the northerly half of Quintard Street in conformance with the City's adopted standards, since Tobias Drive and Quintard Street are classed as a residential and residential collector respectively. A residential street requires 52 feet of right of way and the residential collector requires 56 feet of right of way. The Street Vacation Act of 1941, in accordance with the California Streets and Highways Code, requires that a public hearing be held to hear people in favor of or objecting to the proposed street vacation. Mayor and City Council pirector of Public Works Director of Planning I~ r7 Mr~R 2 ~ ' ~ ~ u~ CI'i i C' ~:~,~~ ~.>~f ~=ICE Subject: Vacation of a portion of Quintard Street and Tobias Drive adjacent to Sweetheart Manor Subdivision At the meeting of March 9, 1977 the City planning Commission considered a request submitted by Sweetheart Construction Company to vacate the easterly 4 feet of Tobias Drive and the northerly 2 feet of Quintard Street adjacent to the subdivision boundary of Sweetheart Manor subdivision. The Commission made the following findings of fact with respect to the partial street vacation as requested: 1. The present right of way is in excess of that required for construction of full ultimate street improvements in this location. Present adopted City standards require that the easterly half of Tobias Drive have 26 feet of right of way and the northerly half of Quintard Street have 28 feet of right of way. This is the width of right of way which shall remain upon vacation for each half of the street. 2. All public utilities have been notified and have no objection to the proposed street vacation.
