HomeMy WebLinkAboutAgenda Statement 1977/03/29 Item 03CITY OF CHULA VISTA COUNCIL AGENDA STATEMENT ITEM NO 3 FOR MEETING OF: 3/29/77 ITEM TITLE: Resolution 8555• Summary Street Vacation of "C" Street Between North Glover Avenue and Third Avenue SUBMITTED BY~ Director of Public Works/City Engineer ,~ ITEM EXPLANATION On March 27, 1974, the Planning Commission, by Resolution PCC-74-6, approved a conditional use permit for the construction of the new Department of Motor Vehicles` facility. The State agreed to realign and construct North Glover Avenue adjacent to the property and to extend North Glover Avenue to Third Avenue. The purpose of the realignment was to improve traffic circulation in the area azd relieve traffic congestion at the new Depart- ment of Motor Vheicles' site. On December 23, 1975, the City Council, by Resolution 7797, accepted a Grant of Easement for Street Purposes from the State for North Glover Avenue. The construction of North Glover Avenue is essentially completed and the Engineering staff will be submitting an agenda item for acceptance of street improvements by the City Council in the near future. The construction of North Glover Avenue has effectively isolated that portion of "C" Street lying between North Glover Avenue and Third Avenue and has essentially closed this portion of "C" Street to vehicular traffic, therefore, the right of way for "C" Street.. is no longer needed for public use or access by the public. The State intends to use this portion of the right of way for "C" Street as an extension of their new parking lot which will be bounded by North Glover Avenue and Third Avenue. Section 1930 of the Streets and Highway Codes, State of California, states that the City Council may summarily vacate and abandon a portion of a street which has been superseded by relocation. It is, therefore, appropriate at this time to proceed with the vacation of "C" Street between North Glover Avenue and Third Avenue. The Engineering staff finds that: 1. The construction of North Glover Avenue negates the public need for "C" Street between North Glover Avenue and Third Avenue. 2. The vacation of this portion of "C" Street is essential to the develop- ment and completion of tree Department of Motor Vehicles' facility which was approved by Planning Commission on March 27, 1974 by Resolution PCC-74-76. Portions of the right of way to be vacated are owned both in fee by the State and the City of Chula Vista. Upon vacation of the right of way, the portion of right of way in which the State of California has fee interest will revert to the State, and the portion of the right of way lAswpart ofethe City of Chula Vista has fee interest will revert to the City. overall agreement with the State, the City has agreed to quit-claim its fee interest in any portion in the right of way for "C" Street being vacated to the State of California. This is in consideration of the right of way which the City received from the State which the City Council accepted on December 23, 1975 by Resolution 7997. All utility companies have been notified and have responded to the Engineering staff's requests for comments. The utility companies have no objections to vacation of this portion of "C" Street. California-American Water Company and San Diego Gas and Electric Company have requested that easements be reserved for their facilities. The City of Chula Vista will reserve easements for drainage and sewer within the right of way to be vacated. Upon adoption of this resolution by the City Council, the City Clerk shall record a copy of this resolution summarily vacating that portion of "C" Street lying between North Glover Avenue and Third Avenue in the office of the County Recorder. A transparency is available for Council viewing.
