HomeMy WebLinkAboutAgenda Statement 1978/01/17 Item 06CITY OF CHULA,VISTA ~• •~ COUNCIL AGENDA STATEMENT • Item No. For meeting of 1-17-77 ITEM TITLE Resolution #8973 Setting Date for Public Hearing - Deferring the Requirements to Underground Existing Overhead Utilities Along Otay Valley Road Adjacent to Rancho Rios Unit #4 and 5 Subdivision SUBMITTED BY ~ Director of Public Works/City Engineer ~,1,~ ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES NO x ) On December 22, 1977, Delta Consultants, on behalf of their clients, Rancho Rios Developers - Odmark Company, filed an application with the Director of Public Works requesting a waiver of the requirements to underground the existing overhead utilities along Otay Valley Road adjacent to the subdivision boundary of Rancho Rios Unit #4 and 5 Sub- divisions. In accordance with Chapter 15.32 of the Chula Vista Municipal Code, the Developer of this Subdivision was required to underground the existing overhead utilities in Otay Valley Road adjacent to his devel- opment. The City Council by Resolution #7037, on October 9, 1973, approved an Amendment to the Subdivision Improvement Agreement for Rancho Rios Unit #5 Subdivision. This Amendment to the Agreement deferr the Subdivider's obligation to complete a major drainage structure acros Otay Valley Road and construction of public street improvements and undergrounding of the existing overhead facilities adjacent to his devel opment until commencement of construction by the County of San Diego for the widening of Otay Valley Road. The Developer has deposited a cash bond deposit in the amount of Twenty-Seven Thousand Two Hundred and Fift Dollars ($27,250) with the City Finance Officer to guarantee the instal- lation of the major drainage structure and public street improvements. No cash bond has been deposited with the City to guarantee the undergroi~ ing of the existing overhead facilities. Work began on the widening of Otay Valley Road on June 15, County's contractor. Rancho Rios Developers - Odmark Company has been given written notice by the Director of Public Works to make arrangements with the Utility Companies to underground the existing overhead facilitie in conjunction with the County's widening project and the Main Street/ Otay Valley Road Undergrounding District. Section 15.32.040 of the Chula Vista Municipal Code requires that the City Council conduct a public hearing to hear persons speak in favor of or object to the request to waive the undergrounding of the existing overhead facilities. Engineering staff is recommending that a public hearing be held at 7:00 p.m. in the City Council Chambers on February 7, 1978. At the public hearing, Engineering staff will include a report in the Agenda Statement setting forth their findings and recommendations regarding the request for the waiver of underground existing overhead facilities.
