HomeMy WebLinkAboutReso 1977-8505~ ., Revised 2-15-77 RESOLUTION N0. 8505 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REPEALING RESOLUTION NO. 8436 AND DECLARING AND ESTABLISHING A POLICY FOR THE FUTURE DEVELOPMENT OF THE EL RANCHO DEL REY AREA The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the State Subdivision Map Act prohibits any county or city from approving a tentative or final subdivision map unless the governing body shall find that the proposed subdivision together with the provision for its design and improvement is consistent with appli- cable general or specific plans of the city or county, and WHEREAS, the City Council has adopted as a part of its General Plan a requirement that public facilities, in accordance with necessary and desirable levels of service, are required to satisfy needs in newly developed areas and further incorporated the policy of the City Council that any development plans include an implementation section which sets forth in detail the measures to be taken to insure that needed public services are provided concurrent with needs generated by the development, and WHEREAS, it has now been determined that future developments in that area known as E1 Rancho del Rey, being that area generally bounded by I-805 and Otay Lakes Road and Bonita Road and Telegraph Canyon Road, will require the installation or improvement of two major streets, "H" Street and Telegraph Canyon Road, and substantial sewer and storm drain improvements, and WHEREAS, it has further been determined that said improvements must be assured of completion prior to any further developments by the establishment of an assessment district or other financial arrangement to insure the full completion of said improvements prior to consideration of any further developments to provide necessary public services to both existing and future developments, and WHEREAS, it has further been determined that proper evaluation of the level of public facilities required in the E1 Rancho del Rey area is dependent upon the resolution of the application of Hillside development standards through identification of hillside ridges and canyons to be preserved has been resolved. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby declare and establish in accordance with the State Subdivision Map Act and the General Plan of the City of Chula Vista the following elements of policy for the El Rancho del Rey area: 1. The Planning Commission and City Council will not consider tentative maps or development plans for properties in the location shown on Exhibit A until such time as a revised General Development Plan including hillside development considerations for E1 Rancho del Rey has been adopted by the City Council. 2. Property owners and developers may, at their own risk, prepare tentative maps and development plans, and staff is to cooperate fully in such preparation, recognizing that neither the Planning Commission nor the City Council will consider such plans until adoption of a revised General Development Plan for the E1 Rancho del Rey area. - 1 - 3. Upon adoption of a revised General Development Plan, the City Council will finally determine whether or not to establish an assessment district for the installation of the public improvements which are required to serve the El Rancho del Rey area. Such public improvements may include, but are not limited to, "H" Street, Telegraph Canyon Road improvements, the Rice Canyon sewer, and several north-south collector streets. If such an assess- ment district is not formed, the City Council may approve tentative maps and development plans subject to such con- ditions as will equitably spread the cost of providing the public facilities in the manner prescribed by the Subdi- vision Map Act or any other manner prescribed by law or mutually agreed to by the City and the proposed developer.
