HomeMy WebLinkAboutReso 1977-8956RESOLUTION N0. 8956 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING TENTATIVE MAP FOR B.B.& K. SUBDIVI- SION, AND CERTIFYING THE NEGATIVE DECLARATION WHEREAS, a notice of the proposed negative declaration on the tentative subdivision map for B.B.& K. Subdivision proposing to divide 4.7 acres into 10 single family residential lots and one lot to be retained for an existing church in an R-1 zone between Monserate and Melrose Avenue, north of Kellogg Elementary School, at the terminus of Jamul Avenue, was given in accordance with the Environmental Review Policy, and WHEREAS, the Environmental Review Committee found that said tentative subdivision map would have no possible significant impact on the environment and forwarded the attached Negative Declaration IS-78-33, to the City Council of the City of Chula Vista for their consideration, and WHEREAS, said Negative Declaration has been available to agencies having jurisdiction by law, all responsible agencies, and to the public for an adequate period of time for their review and comment, and WHEREAS, the information contained in said negative declaration has been considered by the City Council of the City of Chula Vista prior to its action on the discretionary item before the City Council, and WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as B.B.& K. Subdivision and has recommended that the City Council approve said tentative map subject to the conditions as recommended in their Resolution No. PCS-78-1, adopted on the 14th day of December, 1977, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein. NOW, THEREFORE, the City Council of the City of Chula Vista finds as follows: 1. That the City Council of the City of Chula Vista adopts as its record of this finding of no possible significant impact the Council agenda statement on this agenda item and all of the attach- ments thereto. 2. That the City Council of the City of Chula Vista finds in accordance with the recommendation of the Environmental Review Committee and the attached Negative Declaration that the proposed tentative subdivision map will not have any possible significant impact on the environment, and the attached Negative Declaration, incorporated herein by reference as if set forth fully, has been prepared in accordance witg the California Environmental Quality Act of 1970, as amended. 3. That the Environmental Review Coordinator is hereby authorized and directed to file said Negative Declaration wit the County Clerk of the County of San Diego subsequent to the prepara- tion of a notice of determination on this project. - 1 - NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the tentative subdivi- sion map of B.B.& K. DATED City Cler -2- RESOLUTION N0. PCS-78-1 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP KNOWPJ AS B. B. & K. SUBDIVISION WHEREAS, L. R. Blankenship submitted a tentative subdivision map to subdivide 4.7 acres into 10 single family residential lots to be known as B.B.& K. subdivision, and one lot to be retained for an existing church, and WHEREAS, Section 66473.5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted General Plan of the local jurisdiction, and LdHEREAS, the Planning Commission set the time and place fora public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at sait time and place, namely 7:00 p.m. December 13, 1977 in the Council Chambers, City Hall, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Planning Commission found that in accordance with the Negative Declaration on IS-78-33 and the findings stated therein, this project will have no significant adverse environmental impact and certified the Negative Declaration. NOW THEREFORE BE IT RESOLFED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds that the subdivision map known as B.B.& K. is consistent with the goals and objectives of the General Plan for the City of Chula Vista as follows: a. Land Use and Parks and Recreation Elements - The subject site abuts upon the lands of the Kellogg Elementary School and is designated a "park" or "open space facility" on the plan diagram of the Chula Vista General Plan. While the Parks and Recreation Element does not depict the site as a neighborhood park, it does, as a matter of policy, prescribe the establishment of neighborhood parks in conjunction with neighborhood schools. While the proposed residential subdivision may appear inconsistent with the Chula Vista General Plan, the "park." designation on the plan diagram is not a precise locator of future park sites, but merely a symbol which expresses the municipality's policy that park facilities should be established within or for the benefit of the general area which is adjacent to the symbol. In this instance the City of Chula Vista has determined that the neighbor- hood park and the recreation needs of the Kellogg School area can best be met by the expansion of the park and recreation facilities at Greg Rogers Park, and not by the establishment of a new park at the site in question. This policy determination is consistent with the General Plan and implements the park and open space designation ich is symbolically affixed to the Kellogg School area. The subdivision of the subject site into residential lots is consistent with the Land Use and Parks and Recreation General Plan Elements. b. Circulation Element - The extension and completion of Jamul Avenue to Melrose Avenue is consistent with the General Plan. c. Housing Element - The project should provide decent housing in a well ordered residential neiohborhood. d. Conservation Element - None of the areas proposed for conservation on the various plan diagrams of the General Plan are affected by the subject proposal, e. Noise Element - The subject property is not impacted by major noise. f. Seismic Safety and Safety Elements - The development is not adjacent to any known fault system. Extension of public improvement right-of-way widths meet or exceed safety element standards. g. Scenic Highways - The site does not abut a Scenic Highway or Gateway. h. Bicycle Routes Element. No bicycle routes are proposed on or adjacent to this site. i. Public Buildings Element - Public buildings are neither proposed nor required on the site.. 2. The Planning Commission recommends to the City Council that Tentative Map PCS-76-1 for B.B.& K. be approved, subject to the following conditions: a. The lot width of lot 3.sha11 be increased to 64 feet and the lot width of lot 10 reduced by 4 feet. b. The fencing at the rear of lots 1 through 10 shall be placed at the top of slope and a gate provided in the fence on each lot. c. The slopes of lots 1 through 10 shall be landscaped in accordance with the Landscape Manual with emphasis on tree and shrub planting. All periphery slopes shall be irrigated. Erosion control planting shall be incorporated on the slope banks of lot #11. d. A minimum 5 foot high decorative wall or fence with masonry pilasters 15 feet on center shall be provided in the exterior side yard of lot 10 facing Melrose Avenue. e. The existing overhead lines to the church and all other utility lines shall be undergrounded. f. The drainage improvements, both onsite and offsite, shall be constructed in accordance with the requirements of the Chula Vista Subdivision Manual, and as approved by the City Engineer. -2- g. The developer will pay a sewer connection charge of $4.25 per foot for lot 10 prior to connection to the existing sewer main in P~elrose Avenue to serve this lot. 3. That this resolution be transmitted, along with the Tentative Map, to the City Council, and a copy of this resolution be transmitted to the applicant. PASSED AND APPROVED BY THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA this 14th day of December, 1977, by the following vote, to-wit: AYES: Commissioners Renneisen, O'Neill, G.
