SUMMARY
On February 23, 2011, the Director of Public Works received sealed bids for the "Pavement
Major Rehabilitation FY09/10 (STL354)" project. The project consists of the removal and
replacement of failed asphalt concrete pavement (dig-outs), asphalt concrete pavement overlay,
concrete cross-gutters and pedestrian ramp improvements within various streets in the city.
Work on this project also includes cold milling, replacement of traffic signal loop detectors,
traffic control, striping and marking, and other miscellaneous items of work necessary for the
proper completion of the project. The proposed action would award the contract to TC
Construction Company, Incorporated.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class 1(c) categorical exemption pursuant to Section 15301, Existing Facilities, of the State
CEQA Guidelines. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopts the resolution.

DISCUSSION
The Public Works Department, through the implementation of the Pavement Management
System (PMS), has developed a program and a priority list of streets to rehabilitate and preserve
deteriorating pavement throughout the city. This PMS program is designed to extend roadway
life and serviceability through the removal and replacement of deteriorated sections of pavement
(dig-outs) and the application of various types of surface treatments, including asphalt concrete
overlays, chip seals, and rubberized slurry seals.
Asphalt concrete overlays performed within this project are primarily the continuation of
previous projects where dig-outs have been completed. The application of the asphalt concrete
overlay will complete the overall maintenance strategy on the street segments shown in
Attachment 1. This project will also continue the City's dig-out program to repair deteriorated
pavement and would be followed with a pavement surface overlay in the next pavement
rehabilitation project. Attachment 1 shows the list of streets to receive the AC overlay surface
treatment.
Since this pavement project would rehabilitate the pavement along Olympic Parkway at I-805,
implementation of the traffic signal magnetic loop installation project at both approaches of I-
805 freeway ramps at East Orange Avenue and Olympic Parkway (TF350) is part of this project.
The advance loop installation would augment the video detection on the Olympic Parkway and
East Orange Avenue freeway ramp approaches.
Other work includes the construction of cross gutter, pedestrian ramps and other miscellaneous
concrete improvements.
On February 23, 2011, the Director of Public Works received seven (7) bids for the "Pavement
Major Rehabilitation FY09/10 (STL354)" project. The following bids were received:

The low bid submitted by TC Construction Company, Incorporated is below the Engineer's
estimate of $1,401,756.59 by $269,954.09 (or approximately 19.26% below the Engineer's
estimate). Staff has verified the references and the work performed by the coritractor on previous
City projects and has determined that their work is satisfactory. T.he Contractor's License No.
402459 is current and active.

Attachment 2 is a copy of the Contractor's Disclosure Statement.
Wade Statement
The source of funding for this project is Transportation Sales Tax (Transnet). Contractors
bidding this project are not required to pay prevailing wages to persons employed by them for
the work under this project. Disadvantaged businesses were encouraged to bid in the Notice to
Contractors for various trade publications.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that the decision
concerns for repairs, replacement, or maintenance of existing streets or similar facilities and,
therefore, there is not a material financial effect of the decision on the property holdings of the
City Council Members pursuant to California Code of Regulations sections 18704.2(b)(2) and
ta7os.z~)(1).

Under City Council Policy No. 574-01, the Director of Public Works, under this contract can
only authorized a maximum cumulative change order(s) of $73,000 plus 5°/o of the original
contract over $lmillion or approximately $79,590 total without Council approval Total CIP
project funding available for this project is approximately $1,900,000. The remaining
anticipated balance of $428,657 from this funding can be used to complete the additional street
segments shown in Attachment 1. It is anticipated that approximately $300,000 will be needed
to complete these additional streets.
If approved, the proposed resolution would increase the Director of Public Works' cumulative
Change Order authority specified in City Council Policy No. 574-O1 and authorize the Director
of Public Works to expend all available funds allocated for the project, as necessary and without
further City Council action, in order to complete all work listed in attachment 1 including the
"Additional Dig-outs" as required in accordance with City standards and to account for increases
or decreases in unit quantities.
There are sufficient TransNet funds in the STL354 project account to complete the work.
ONGOING FISCAL IMPACT
Upon completion of the project, the improvements will require only routine City street
maintenance.

EXPEND ALL AVAILABLE FUNDS IN THE PROJECT
WHEREAS, City staff prepared specifications for the "Pavement Major Rehabilitation
FY09/10 (STL354)"and advertised the project on Januazy 21, 2011; and
WHEREAS, on February 23, 2011, the Director of Public Works Engineering received
seven (7) sealed bids for the project as follows:

WHEREAS, the apparent low bid submitted by TC Construction Company, Incorporated
is below the Engineer's estimate of $1,401,756.59 by $269,954.09 (or approximately 19.26%
below the Engineer's estimate); and
WHEREAS, the total "Pavement Major Rehabilitation FY09/10 (STL354)" project is
anticipated to cost $1,471, 343 including $339,540 for contingencies, staff time, material testing
and other costs; and
WHEREAS, the total CIP project funding available for this project is approximately
$1,900,000 and the remaining anticipated balance of $428,657 from this funding can be used to
complete the entire additional street segments listed in the project; and

WHEREAS, approximately $300,000 will be needed to complete the entire additional
street segments listed in the project; and
WHEREAS, staff has verified the references and the work performed by the contractor
on previous City projects and has found their work to be satisfactory.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids and award contract for the "Pavement Major Rehabilitation
FY09/10 (STL354)" project to TC Construction Company, Incorporated in the amount of
$1,131,802.50.
BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does
hereby authorize the Director of Public Works to spend all available contingency funds and
additional project funding, as necessary, in order to complete all work listed in the project as well
as the Additional Street Segments required in accordance with City standards and to account for
increases or decreases in unit quantities.
