RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ACCEPTING BIDS AND AWARDING CONTRACT FOR THE
CONSTRUCTION OF A STORM DRAIN CHANNEL AT "C" STREET
AND FOURTH AVENUE, ADJACENT TO GENERAL ROCA PARK
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the following two bids were received and opened at
11:00 a.m. on the first day of December, 1977, in the Engineering/
Planning Conference Room of the City of Chula Vista for the construc-
tion of a storm drain channel at "C" Street and Fourth Avenue, adjacent
to General Roca Park:
T. B. Penick & Sons, Inc., San Diego $119,844
Accurate Gunnite Company, El Cajon 184,055
and
WHEREAS, it has been recommended that said contract be
awarded to the lowest responsible bidder, T. B. Penick & Sons,
Inc. who has assured the City that he is a licensed contractor in
the State of California and can produce an acceptable performance
bond, and
WHEREAS, because the first two project bids under the EDA
grant have exceeded the original estimates for the grant and are
utilizing almost all the funds under the grant, the Director of
Public Works is recommending that the third project (Halecrest
and Telegraph Canyon Road Storm Drain) be deleted.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista does hereby accept said two bids, and does hereby
award the contract for said storm drain construction to T. B. Penick
& Sons, Inc. in the amount of $119,844 to be completed in accordance
with the specifications as approved by the Director of Public Works
of the City of Chula Vista.
BE IT FURTHER RESOLVED that the sum of $122,635 is hereby
authorized to be expended from Account No. 645-6450-PW401 for the
General Roca Park Channel Project.
BE IT FURTHER RESOLVED that the Halecrest Storm Drain
project is hereby deleted from the EDA grant application for Storm
Drain Projects Group II.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
contract for and on behalf of the City of Chula Vista.

I HEREBY CERTIFY that the indebtedness and obligation
to be incurred by the contract or agreement authorized by the
attached resolution can be incurred without the violation of any
of the provisions of the Charter of the City of Chula Vista, or
the Constitution or the laws of the State of California, that
sufficient monies have been appropriated for the purpose of said
contract, that sufficient monies to meet the obligations of the
contract are actually in the Treasury, or are anticipated to come
into the Treasury to the credit of the appropriation from which
the same are to be drawn, and that said monies now actually in
the Treasury, together with the monies anticipated to come into
the Treasury, to the credit of said appropriation are otherwise
unencumbered.
