At the meeting of October 4, 1977, the City Council accepted a report
on the installation of curb and sidewalk at 505 Hilltop Drive. The
recommendation was that the City and County share in the construction of
the necessary retaining wall and use the Block Act District process for
installation of the curb, gutter and sidewalk improvements.
Staff subsequently obtained informal bids with two alternatives. Alter-
native 1, for the construction of curb, gutter and sidewalk and concrete
masonry wall and Alternate 2, for the construction of the wall only. A
summary of the bids received is as follows:

Contact was again made with Mr. Fry to determine if he desired to pay
for the curb, gutter and sidewalk based on the bid prices received. He
still refused to install the required improvements at the bid prices
received. He informed City staff he was not willing to spend an amount
greater than $400 for curb, gutter and sidewalk.
Staff has proceeded on the basis that the City and County will share in
the cost of constructing the wall only. This will provide for a safe

The City's share of the cost for the retaining wall will be approximately
$2,000.
STAFF RECOMMENDATION
1) City Council appropriate and authorize expenditure of $4,000 from Gas
Tax 2106 funds, unappropriated reserves to cover the amount of the low
bid for Alternate 2 including contingencies and utility relocation.
2) City Council authorize County's payment for their share of the cost to
be deposited in the unappropriated reserves of Gas Tax 2106 funds.

walking area for school children. Subsequent to the construction of the
wall, we may proceed in one of two ways to effectuate the construction
of the curb, gutter and sidewalk.
1. Use the Block Act District process for constructing the curb, gutter
and sidewalk.
2. City forces construct the curb, gutter and sidewalk with Mr. Fry
reimbursing the City for its expenses. The estimated cost for
City forces to perform the work is $265.00.
The City has received a purchase order from the County of San Diego in
the amount of $1,938.81. This is equal to 50 percent of the low bid by
W.H. Ledbetter and Son, Inc., plus 10 percent for contingencies.
We propose that the City appropriate all the necessary funds for the con-
struction of the wall and then, following completion of the project, we
will reimburse City funds with the payment from the County of San Diego
for their portion of the work.

3) Authorize the Director of Public Works to execute the informal bid
with W.H. Ledbetter and Son, Inc., for construction of the retaining
wall only.
4) Authorize City forces to construct the curb and gutter and sidewalk
conditioned that Mr. Fry will reimburse the City for the costs incurred.
