CITY OF CHULA,VISTA COUNCIL AGENDA STATEMENT Item No. 9 For meeting of 2/28/78 ITEM TITLE Resolution y~/~: Approving Encroachment Permit #78-4, James W. Watkins ~ •~ SUBMITTED BY Director of Public Works/City Engineer ~~ ITEM EXPLANATION (4/5TH'S VOTE REQUIRED YES N0~) Mr. James W. Watkins owns parcel "C" of parcel map 531. Parcel "C" has frontage upon Palm Drive. Mr. Watkins has an approved deferral for the construction of public improvements in Palm Drive fronting his property. Mr. Watkins will be installing his improvements in conjunction with the construction of improvements within Palm Drive by the developers of Bonita Ridge Estates Unit #3 Subdivision. Mr. Watkins presently takes his access off of Palm Drive. In order to reach his existing garage, he must negotiate a very steep drive- way on his property. Because of the steepness of this driveway, it must be constructed of Portland cement concrete in order to provide all-weather access to his garage. Mr. Watkins is facing a consider- able expense to improve his private driveway. Mr. Watkins' property abuts the southerly subdivision boundary of Bonita Ridge Estates Unit #3 Subdivision and lies adjacent to lot 154 of that subdivision. A 30-foot wide general utility and access easement has been dedicated across lot 154 to provide access to lots 146 through 149 of Bonita Ridge Estates Unit #3 Subdivision, map 86--33. The developer of Bonita Ridge Estates Unit #3 Subdivision will be constructing permanent improvements within this access easement. The private access easement will be maintained by the owners of lots 146 through 149 of the subdivision. The installation of the improvements will be inspected by the Public Works Department. These improvements are required as a condition of approving the final map of the sub- division which was approved by City Council Resolution 8744. Item Number 9 Meeting of 2/28/78 Supplemental Page 2 Mr. James Watkins has applied for an encroachment permit to utilize a 16-foot long by 40-foot wide portion of lot 154 lying between his property and the 30-foot wide general utility and access easement within lot 154. Lot 154 was dedicated to the City on the final map of Bonita Ridge Estate Unit #3 Subdivision as open space. Lot 154 was accepted by the City Council at the time the City Council approved the final map. Lot 154 is to be maintained by Open Space District #4. The reason for Mr. Watkins' request for an encroachment permit is so that he can gain better access to his garage by entering his property from the private drive serving lots 146 through 149 of Bonita Ridge Estates Unit #3, instead of utilizing his very steep driveway from Palm Drive. Mr. Watkins has executed an Agreement with the developer of Bonita Ridge Estates Unit #3 Subdivision, Claire Vista Corporation, whereby Mr. Watkins, his successors and assignes, will share in the cost of maintaining the private drive with the residents within the subdivision as a condition of using the private drive for access to his property. A copy of that Agreement is attached for City Council's information. Engineering has contacted the Planning Department and Parks and Recreation Department and neither Department has any objection to the granting of the encroachment permit. The following special conditions shall be attached to the approval of the encroachment permit: 1. Mr. Watkins shall submit plans for approval by the City Engineer for the construction of the culvert pipe and driveway between his property and the 30-foot private drive. 2. The City Engineer has authority to revoke the encroachment per- mit upon 30-days notice to the owner of parcel "C" of parcel map 531. 3. Encroachment permit shall remain in effect only as long as the Agreement between the owner of Parcel "C" of parcel map 531 and the owners of lots 146 through 149 of Bonita Ridge Estates Unit #3 Subdivision remains in effect and is valid. A transparency is available for Council viewing.
