HomeMy WebLinkAboutReso 1989-13967 RESOLUTION NO. 13967 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE SUMMARY VACATION OF A PORTION OF A DRAINAGE EASEMENT WITHIN THE BOUNDARIES OF CHULA VISTA TRACT 87-11, HIDDEN MEADOWS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, in conjunction with development of Hidden Meadows SUbdivision, the developer will be relocating two existing storm drains within the subdivision boundary and extending the system across Hilltop Drive, and WHEREAS, it is now appropriate to abandon the portion of the drainage easement located within the subdivision on the area where the culverts are to be relocated. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista, under its authority pursuant to Chapter of Part 3 of the California Streets and Highways Code and ~pecifically Section 8333, does hereby order the summary vacation of a portion of a drainage easement within the boundaries of Chula Vista Tract 87-11, Hidden Meadows, more precisely described in Exhibits A. NOW, THEREFORE, BE IT RESOLVED that from and after the date this resolution is recorded, the drainage easement no longer constitutes a public service easement. Resolution Approving the Final Map and Subdivision Improvement Agreement and authorizing the Mayor to execute said agreement for Chula Vista Tract 87ql, Hidden Meadows b. Resolution Accepting an Irrevocable Offer to Dedicate Real Property for street purposes along the northerly line of Tranquilo Lane and dedicating said property to public use as a part of Hilltop Drive and Tranquilo Lane c. Resolution Accepting certain grants of easements for drainage purposes d. Resolution 13967 Ordering the summary vacation of a portion of a drainage easement within the boundaries of Chula Vista Tract 87-11, Hidden Meadows SUBMITTED BY: Director of Public Work~/~/ REVIEWED BY: City Manager/~}~~'' (4/5ths Vote: Yes__No X ) On September 15, 1987, by Resolution 13252, the City Council approved the Tentative Subdivision Map for Chula Vista Tract 87-11, Hidden Meadows Subdivision. The Final Map and associated items are now before Council for approval. RECOMMENDATION: That Council adopt resolution a through d listed in the item title of this report. BOARDS/COMMISSIONS RECOMMENDATION: Not applicable. DISCUSSION: Chula Vista Tract 87-11, Hidden Meadows consists of eighteen lots for single family dwellings and three lettered lots. The final map for said subdivision has been reviewed by the Public Works Department and found to be in conformance with the approved Tentative Map. Approval of the map constitutes acceptance of all drainage'and tree planting easements within the subdivision and acceptance of the right-of-way for Tranquilo Lane and Cuyamaca Avenue on behalf of the public. The developer has executed a subdivision improvement agreement in conjunction with the Final Map and has provided bonds to guarantee construction of the required improvements. Page 2, Item 7a-d Meeting Date z/14/89 Among the conditions of approval was the requirement that the developer be responsible for providing sufficient right-of-way to install required improvements and that any off-site right-of-way required be dedicated prior to approval of the Final Subdivision Map. As a result of this condition, All Type Cabinet, Inc., the owner of the adjacent property, submitted to the Public Works Department an Irrevocable Offer to Dedicate Real Property for street purposes. On December 15, 1987, by Resolution 13381, the City Council acknowledged the Offer reserving the right to accept the offer at a future time. It is now appropriate to accept the subject offer of dedication. The offer of dedication covers a lO-foot wide strip which, taken in conjunction with the 36-foot wide dedication in the Hidden Meadows subdivision, provides adequate ri ght-of-way to construct Tranqui 1 o Lane, one of two streets providing access to the subject subdivision. In conjunction with development of the subject subdivision, the developer will be relocating two existing storm drains within the subdivision boundary and extending the system across Hilltop Drive. It is now appropriate to abandon the portion of the drainage easement located within the subdivision on the area where the culverts are to be relocated. The two drainage easements proposed to be accepted will allow City forces to maintain the system which is being extended westerly of Hilltop Drive. A plat is available for Council viewing.
