The drainage easement contains an 18" diameter storm drain which will be accepted by the City for maintenance upon completion of the construction of the improvements within Bonita Ridge Estates Unit No. 4 Subdivi- sion. Mr. Castro is requesting the encroachment for the construction of a swimming pool in his back yard. At the time a building permit was applied for in conjunction with the construction of the swimming pool, a plot plan was submitted to staff with the application showing that the proposed swimming pool would be ten feet away from the ten-foot drainage easement. After con- struction was commenced on the swimming pool by .the pool company, it was determined that the swimming pool encroached approximately seven feet into the drainage easement at its furthest point. To allow the construction of the swimming pool at this location would restrict the City's access to the storm drain in the event that City forces would have to make an emergency repair to the storm drain. To allow the continued construction of the pool at its present location would require that City forces dig through a portion of the pool to gain access to the storm drain. '~- ~~ 7~ AGENDA ITEM NO'. 9 Supplemental Page 2 Engineering staff made a field investigation of the site and it has been determined that the swimming pool should be moved suf- ficiently so that no portion of it is constructed over the storm drain. If Mr. Castro moves the pool sufficiently to clear the storm drain, the encroachment of the swimming pool into the drainage easement will be reduced from seven to three feet at its furthest point. Engineering staff is recommending that Mr. Castro be granted a maximum encroachment of three feet into the drainage easement provided he moves his pool sufficiently to clear the storm drain. The issuance of the encroachment permit shall be con- ditioned upon the wall of the pool, adjacent to the storm drain, being designed and constructed as a freestanding re- taining wall capable of withstanding the lateral forces placed upon it.
