A. BACKGROUND
1. The applicant is submitting a precise plan to divide two parcels into three
parcels at 81-83-85 Quintard Street in the R-1-5-P zone.
2. The proposed project is exempt from environmental review as a Class 3(a) exemption.

2. History
In 1969, the applicant was granted a variance to divide a flag shaped :IO,898
sq. ft. (0.70 acres) lot, with 20 feet of street frontage, into two lots. At the time,
the property was zoned R-3-B-3-D (Multiple family, one unit per 3000 sq. ft. subject
the the "D" Design Modifying District). A single family dwelling has since been
constructed on the most westerly parcel which measures 90' x 150' (13,950 sq. ft.) and
the other parcel remains vacant. In September 1976, the property was zoned to R-1-5-P
(Single family residential, 5000 sq. ft. minimum lot size subject to the "P" Precise
Plan Modifying District).

3. Existing Site Characteristics
The subject property is relatively level, but is approximately 8 feet lower
than the grade of the street and the adjacent property to the south. The property
is also approximately 8 feet higher than the properties to the north. The slope
between the site and the property to the south is almost vertical. The applicant
has indicated that a retaining wall will be constructed adjacent to this slope. The
driveway to the existing single family dwelling is paved with asphalt and is in
good condition.

1. The newly created lots are 5719 sq. ft. excluding the driveway. The pad
areas are almost entirely usable and should not pose significant problems in con-
structing single family dwellings of adequate size on the lots, while maintaining
setbacks in excess of the ordinance minimums.
2. While the existing paved driveway is in good condition, additional paving
will be required in front of the newly created parcels. It has been recent policy
to require that concrete be used for private common access roads to reduce long term
maintenance problems. Therefore the staff is recommending that the 40 foot area in
front of the new parcels be paved with concrete but allowing the existing driveway
leading to the area to remain as asphalt. To provide some aesthetic relief the staff
is also recommending the inclusion of a 3' wide planter strip in front of the
southerly retaining wall.
3. Rounding the corners of the driveways will help internal circulation move-
ment. The front yards of the new lots should also be planted as soon as possible.
These lots are more self contained than street frontage lots and face the rear of
adjoining developments making landscaping a key factor in providing a pleasant
environment for the residents.

CITY COUNCIL THE APPROVAL OF A PRECISE PLAN TO DIVIDE TU10 PARCELS
INTO THREE LOTS TO BE DEVELOPED WITH SINGLE FAMILY DWELLINGS AT
31-83-85 QUINTARD STREET IN THE R-i-S-P ZONE
~~1HEREAS, Variance Resolution No. 69-38, adopted by the City Planning
Commission on August 4, 1969, permitted the creation of two lots totalling
30,398 square feet to be served by a 20 foot wide easement at 85 Quintard Street,
and
6dHEREAS, Ordinance No. 1702, adopted by the City Council on September 9, 1976,
established the R-1-5-P zone on said property (single family residential, 5,000 sq.ft.
minimum lot size, under "P" Precise Plan Podifying District), and
WHEREAS, on December 30, 1977 a precise plan was submitted by Haniseli S.
Alagata to divide said property into three lots to permit the construction of two
additional single family dwellings and the retention of the existing residence, and
WHEREAS, the City Planning Commission, at a duly advertised public hearing
held at 7:00 p.m., January 25, 1978 in the Council Chamber, City Hall, 276 Fourth
Avenue, considered the precise plan as submitted, and
WHEREAS, the proposed project is exempt from environmental review as a
Class 3a exemption.
NOW TFIERE~GRE BE IT RESOLVED that the City Planning Commission finds as
follows:
a. That such plan will not, under the circumstances of the particular case, be
detrimental to the health, safety or general welfare of persons residing or working
in the vicinity, or injurious to property or improvements in the vicinity.
The variance previously granted allowed for two douses to be built without
street frontage; adding a third lot will not be detrimental to the area
since all parcels will be larger than the minimum lot size.
b. That such plan satisfies the principles of the application of the "P" Modifying
District as set forth in Section 19.46.01.
The proposed plan is similar to the recently approved subdivision to the east.
The overall net density of 8,460 sq. ft. per unit is less than that permitted
by the underlying zone.
c. That any exceptions granted which deviate from the underlying zoning require-
ments shall be warranted only when necessary to meet the purpose and application
of the "P" Precise Plan Modifying District.
The subject property has existed in its present configuration for many years.
The 20 foot wide access road will adequately serve the three units on the
site.
d. That approval of this plan ~.Nill conform to the general plan and the adopted
policies of the city.
Tt;e proposed density is lower than the General Plan designation for this
area of 13.26 dwelling units per acre.
BE IT FURTHER RESOLVED that the City Planning Ccmmission recommends that the
City Council approve the precise plan to divide two parcels into three lots at
81-83-85 Quintard Street, subject to the following conditions:
1. The main building and garages shall set back a minimum of 22 feet from
the access road.
2. The 40 foot access road in front of the two easterly parcels, shall be
paved with 4 inches of portland concrete cement with the exception of
3 feet along the south property line. The 3 foot wide area shall be
curbed and landscaped with shrubs and ground cover and irrigated with
sprinklers.
3. The front yard areas of the two easterly parcels shall be landscaped
within 90 days after completion of construction.
4. The driveways for the two easterly parcels shall have rounded corners,
a minimum 5 foot radius, and be paved with 4" portland concrete cement.
5. A parcel map shall be filed to divide the property.

this 25th day of January, 1978 by the following vote, to-wit:
