RESOLUTION OF THE CITY COUNCIL OF~~fiHE~"CITY OF CHULA
y VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND ROBINHOOD HOMES, INC. FOR PARTICIPATING IN
THE IMPROVEMENT OF BRANDYWINE AVENUE
AND AUTHORIZING THE MAYOR TO EXE-CUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agreement
between THE CITY OF CHULA VISTA, a municipal corporation, and
ROBINHOOD HOMES, INC., for participating in the improvement of
Brandywine Avenue
dated the 13th day of October 19~~ a copy of
which is attached hereto and incorporated herein, the same as though
fully set forth herein be, and the same is hereby approved.
~- BE IT FURTHER RESOLVED that $1,500 is hereby appropriated from
the unappropriated balance of Gas Tax Fund 2106 and transferred to Brandy-
wine Avenue Project GT-11 and the expenditure of $4,200 from Brandywine
Avenue Project GT-11 is hereby authorized.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

AGREEMENT FOR CITY PARTICIPATION IN THE PUBLIC
IMPROVEMENTS OF BRANDYWINE AVENUE BEING A MP.JOR
STREET LOCATED WITHIN ROBINHOOD POINT UNIT NO. 3
SUBDIVISION CONCURRENT WITH THE INSTALLATION OF
PUBLIC IMPROVEMENTS IN SAID SUBDIVISION
THIS AGREEMENT, made and entered into this 13th day of
October , 1977, by and between THE CITY OF CHULA VISTA,
a municipal corporation, hereinafter called "City", and ROBINHOOD
HOMES, INC., a California corporation, 358 Trousdale Drive, Chula
Vista, California 92010, hereinafter called "Subdivider";
W I T N E S S E T H
WHEREAS, Subdivider has or is about to enter into an agree-
. ment with the City of Chula Vista providing for the development of
public improvements in certain streets located within that certain
subdivision to be known as Robinhood Point Unit No. 3, and
WHEREAS, one of said streets located within the subdivision
is a major street known as Brandywine Avenue, and
WHEREAS, City has heretofore agreed to participate in a
- 5' portion of the improvements of said street in accordance with Item 2
of the conditions of approval for the tentative map of said subdivision
as approved by Resolution No. 8146 on April 12, 1976, and
WHEREAS, it is agreed that the unit prices obtained by the
Subdivider be advantageous to the City.
NOW, THEREFORE, JT IS MUTUALLY AGREED by and between the
parties hereto as follows:
1. Subdivider agrees to install one-half of the certain
improvements four feet west of the centerline of Brandywine Avenue.
2. City agrees to pay subdivider for the following improve-
ments, the estimated cost of which is set forth as follows:
210 C.Y. roadway excavation at $1.00 $ 210.00
5656 S.F. surfacing, 3" AC on 4" AB (min.)
at $0.58 = 3,280.48
3,490.48
Profit and overhead expenses 509.52
TOTAL COST 4,000. 0
3. City agrees to reimburse developer in accordance with
actual contract unit prices as bid upon receipt of a verified contract
document and invoice for work completed, provided, however, City shall
not pay more than $4,200.00 for said improvements.
IN WITNESS WHEREOF, the parties hereto have caused this
agreement to be executed the day and year first hereinabove set forth.
