The Director of Public Works received bids in the Engineering Planning
Conference Room at 11:00 a.m. on January 11, 1978, for the construction
of Mueller Neighborhood Park, Phase 2. This project is a re-bid from
previous bid.
The following bids were submitted:

The low bid of $34,510 by T.B. Penick & Sons, Incorporated is 2% above
the Consultant's estimate of $33,840.00
On August 17, 1977, the Engineering staff received bids from the same
bidders as above. The low bid as submitted by Fritz A. Nachant, Inc.,
was $36,814.50 which was 32o higher than the Consultant's estimate of
$27,845.00 On September 20, 1977, the City Council, by Resolution
No. 8827, rejected the bids and requested that the project be re-advertised.
Van Dyke-Halsey, the Consultant retained by the City, is a Landscape
Architect and, as such, did not have up-to-date cost data relating to
the construction of the multi-purpose concrete court and the wooden

STAFF RECOMMENDATION
City Council accept bids and award contract to T.B. Penick and Sons, Inc.,
in the amount of $35,510.00 and authorize expenditure of $39,061.00 for
the project.

structure items contained in the contract. The estimate that he pre-
pared for bids which were received in August of 1977 did not anticipate
the rapid escalation in construction cost which occurred during the
time that the City advertised and received bids. The rapid increase in
construction cost can be attributed to the amount of Federal funds
released under the Public Works Employment Act Program. The revised
estimate prepared by the Consultant for the second round of bids
advertised for this Project reflects recent cost data obtained during
the past six months. The recent low bid of $34,510 by T.B. Penick and
Sons, Incorporated, is a reasonable and competitive bid taking into
account the current construction activity and availability of construction
materials.
Van Dyke-Halsey recommend that an additive item for staining all wood
structures in the amount of $1,000 be included in the award of contract.
FINANCIAL IMPACT
Funds have been appropriated and are available in the budgeted Mueller
Park Block Grant Account (BG 24) in the amount of $17,240.00. Additional
funds for the project are available in the Local Option Block Grant
Accounts. Block Grant regulations permit the transfer and use of
local option funds to complete budgeted projects. Therefore, the necessary
funds can be encumbered from the 1976-77 local option and the 1977-78
local option accounts.

contract, that sufficient monies to meet the obligations of the
contract are actually in the Treasury, or are anticipated to come
into the Treasury to the credit of the appropriation from which
the same are to be drawn, and that said monies now actually in
