RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING TENTATIVE SUBDIVISION MAP PCS-77-10
FOR HUDSON VALLEY ESTATES AND CERTIFYING THE
ENVIRONMENTAL IMPACT REPORT
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Poletta Sue Webb has requested approval of a
tentative subdivision map for a project involving the eventual con-
struction of ten single family dwelling units, and
WHEREAS, the Environmental Review Committee of the City
of Chula Vista conducted Initial Study 77-53 and determined that
the project could have a substantial impact on the environment and,
therefore, required than an environmental impact report be prepared
on the project, and
WHEREAS, the applicant submitted the necessary information
for the City of Chula Vista to prepare a draft of said Environmental
Impact Report, and
WHEREAS, the Environmental Review Section of the Planning
Department prepared said draft Environmental Impact Report and it
was issued by the Environmental Review Committee, and
WHEREAS, notice of the availability of said draft Environ-
mental Impact Report was given through a newspaper of general circu-
lation and a notice of completion was filed with the Secretary of
Resources for the State of California, and
WHEREAS, said draft Environmental Impact Report was avail-
able for public review and scrutiny for a period in excess of thirty
days, and
WHEREAS, the Planning Commission of the City of Chula Vista
held a public hearing on said draft Environmental Impact Report and
adopted a final Environmental Impact Report, and
WHEREAS, the Planning Commission of the City of Chula Vista
has heretofore approved that certain tentative map of a subdivision
to be known as Hudson Valley Estates and has recommended that the City
Council approve said tentative map subject to the conditions as recom-
mended in their Resolution No. PCS-77-10, adopted on the 26th day of
October, 1977, a copy of which is attached hereto and by this reference
made a part hereof, the same as though fully set forth herein.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista does hereby certify that EIR-78-1 has been reviewed
and the information considered, and that it has been prepared in accor-
dance with CEQA 1970, as amended, the California Administrative Code
and the Environmental Review Policy of the City of Chula Vista.
BE IT FURTHER RESOLVED that the City Council of the City of
Chula Vista does hereby approve the tentative subdivision map of Hudson
Valley Estates in accordance with Planning Commission Resolution No.
PCS-77-10 adding thereto the condition that a prohibition against the
conversion of garages in the subdivision for purposes other than parking
of vehicles be included within the Covenants, Conditions and Restrictions
to be approved by the City Attorney's office.

RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION
MAP KNOWN AS HUDSON VALLEY ESTATES
WHEREAS, Poletta Sue Webb submitted a tentative subdivision map to subdivide
4.34 acres located on Las Flores Drive to be extended north of "D" Street into
11 lots, to be known as Hudson Valley Estates, and
WHEREAS, Section 66473.5 of the Government Code provides that approval of a
subdivision map shall be based upon findings of consistency between the subdivision
map and the adopted General plan of the local jurisdiction, and
WHEREAS, the Planning Commission set the time and place for a public hearing
to consider said tentative map, and notice of said hearing, with its purpose, was
given by the publication in a newspaper of general circulation in the city at least
10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., October 26,
1977 in the Council Chambers, City Hall, before the Planning Commission and said
hearing was thereafter closed, and
-- WHEREAS, the environmental impact report, EIR-78-1, relating to this project
was certified by the Planning Commission on October 12, 1977,
NOW THEP~EFORE BE IT RESOLVED AS FOLLOWS;
1. From the facts presented to the Planning Commission, the Commission finds
that the subdivision map known as Hudson Valley Estates is consistent with the General
Plan for the City of Chula Vista as follows:
a. Land Use Element - consistent. The General plan designates this site for
medium density residential development (4-12 dwelling units per gross acre). The
proposed project density of 3.9 dwelling units per acre is consistent with this
designation.
b. Circulation Element - consistent.. The development will extend Las Flores
Drive in conformance with General Plan standards.
c. Housing Element - consistent. The project should provide decent housing
in a well-ordered residential neighborhood..
d. Conservation, Open Space, and Parks & Recreation Elements - consistent.
None of the areas proposed for conservation or open space on the various plan diagrams
of the General Plan are affected by the subject proposal. The developer will be
assessed fees in lieu of park land dedication.
e~ Noise Element - consistent. The Noise Element recognizes the need to
continue to utilize the City~s Environmental Review process to evaluate. and ameliorate
noise impact.
g. Seismic Safety and Safety Elements - consistent, The development is
not adjacent to any known fault systems. Extension of public improvements, right
of way widths, and turn-arounds meet or exceed safety element standards. Although
a portion of the property is within the Sweetwater Valley 100 year flood plain, the
preliminary grading plan indicates dwelling units will be elevated above said flood
level.
h. Scenic Highways Element - consistent. The site does not abut a
Scenic Highway or gateway.
i. Bicycle Routes Element - consistent. No bicycle routes are proposed
on or adjacent to this site.
j. Public Buildings Element - consistent. Public buildings are neither
proposed nor required on the site.
2. The Planning Commission recommends to the City Council that Tentative Map
PCS-77-10 for Hudson Valley Estates be approved, subject to the following conditions:
a. The top and toe of slopes shall be rounded and the horizontal contours
shall be blended into the existing contours per the grading ordinance.
All manufactured slopes blending into the existing terrain shall be a minim
o~F ~'.:l or flatter. Landscaping will be required in accordance with the
Chula Vista Landscape Manual.
b. Concrete steps, at least 4 feet wide, shall be provided on at least one
side yard to provide access to the rear yard without going through the
dwelling.
c. The subdivider shall be responsible for constructing full street improve-
ments in Las Flores Drive consisting of, but not limited to, pavement,
curb and gutter, and sidewalk, street lights, street trees, sewer and
drainage facilities. For that portion of Las Flores Drive within and
adjacent to the subdivision boundary, the developer shall construct
Las Flores Drive to ten feet east of the centerline. The developer shall
be responsible for acquiring and dedicating 38 feet of the 52 feet of
ultimate. right of way for Las Flores Drive within and adjacent to the
subdivision. The developer shall .also be responsible for constructing
offsite improvements for the westerly half of Las Flores Drive from the
boundary to "D" Street. Installation of these improvements shall be
coordinated with the deferral granted for the property as shown on
Parcel Map 5711. A temporary cul-de-sac shall be constructed in
accordance with City Council Policy No. 600-01 at the northerly
terminus of Las Flores Drive. The cul-de-sac shall have a minimum
turning radius of 28 feet.
d. The subdivider shall be responsible for constructing a gravity
sewer to serve the subdivision, The sewer shall be constructed
northerly and make connection with the Spring Valley trunk sewer
or with the sewer in First Avenue. If the developer pays the
entire cost of constructing the sewer, he may request a repayment
diagram for reimbursement for that portion of the sewer benefiting
other properties. An alternative to constructing the sewer at his
entire cost would be for the developer to enter into an agreement
with the City and other interested property owners for participation
in the cost of constructing a sewer to the Spring Valley trunk line
or the sewer in First Avenue, The developer shall be responsible
for obtaining all easements and right of way for construction of the
sewer to serve his development, After construction of the gravity
sewer line and acceptance by the City, the developer shall be respon-
sible for the demolition of the existing sewer pump station within
-- Lot 1, -Upon completion of the gravity sewer line and demolition of
the existing pump station, the developer may request a vacation of
the abandoned sewer easements affecting Lot 1, The developer shall
be responsible for paying all applicalbe sewer connection charges
prior to approval of the final map.
e, The developer shall be responsible for constructing the storm drain
in Las Flores Drive adjacent to the subdivision, The developer shall
also construct offsite drainage facilities as determined by the City
Engineer. Offsite drainage facilities shall be limited to those
necessary for protection of upstream and downstream properties and
required to assure proper functioning of the system within the sub-
division, The developer may request that a repayment diagram and
district be established to reimburse him for that portion of the cost
of constructing the storm drain which benefits other properties. The
developer shall acquire necessary easements and right of way for all
drainage facilities..
f. The developer shall underground all existing overhead facilities lying
within the subdivision. All utilities serving the subdivision shall
be undergrounded.
g, The developer shall not oppose or object to the formation of an improve-
ment act district to install the improvements in Las Flores Drive,

h.~ The developer shall comply with all applicable sections of the
Chula Vista Municipal Code. Preparation of final map and plans shall
be in accordance with the provisions of the Chula Vista Subdivision
Manual,
i, Fire protection requirements will be two hydrants, the location of
which will be determined by the Fire Department upon the approval
of the tentative map,
j. The garages for all the lots shall be flood proofed.
3. That this resolution be transmitted, along with the Tentative Map, to the
City Council, and a copy of this- resolution be transmitted to the applicant.
