RESOLUTION OF THE CITY COUNCIL OF `.!'HE CITY OF CHULA
VISTA APPROVING PRECISE PLAN FOR DEVELOPr7.ENT OF A
30 UNIT TOL~ITIHOUSE CONDOMINIUM PROJECT AT THE SOUTH-
WEST CORNER OF QUINTARD STREET ArdD TOBIAS DRIVE,
AND CERTIFYING THE NEGATIVE DECLARATION
The City Council of the City of Chula Vista does hereby
resolve as follows:
~~iEREAS, the City Council of the City of Chula Vista has
heretofore received the recommendation of the Planning Commission,
as contained in Resolution No. PCM-78-6, adopted on the 12th day
of October, 1977, setting forth the precise plan for the development
of a 30-unit townhouse condominium project on 2.56 acres located
at the sourthwesterly corner of Quintard Street and Tobias Drive
in the R-3-P-12 zone, and
F7HEREAS, the City Council of the City of Chula Vista has
heretofore held a public hearing to consider said precise plan on
November 8, 1977, and has taken testimony and heard evidence
thereon, and
WHEREAS, a notice of the proposed negative declaration on
said precise plan was given in accordance with the Environmental
Review Policy, and
WHEREAS, the Environmental Review Committee found that
said precise plan would have no possible significant impact on
the environment and forwarded the attached Negative Declaration,
IS-78-13, 'to the City Council of the City of Chula Vista for their
consideration, and
WHEREAS, said Negative Declaration has been available to
agencies having jurisdiction by law, all responsible agencies, and
to the public for an adequate period of time for their review and
comment, and
WHEREAS, the information contained in said negative declar-
ation has been considered by the City Council of the City of Chula
Vista prior to its action on the discretionary item before the City
Council.
NOW, THEREFORE, the City Council of the City of Chula Vista
finds as follows:
1. That the City Council of the City of Chula Vista adopts
as its record of this finding of no possible significant impact the
Council agenda statement on this agenda item and all of the attach-
ments thereto.
2. That the City Council of the City of Chula vista finds
in accordance with the recommendation of the Environmental Review
Committee and the attached Negative Declaration that said precise
plan will not have any possible significant impact on the environment,
and the attached Negative Declaration, incorporated herein by refer-
ence as if set forth fully, has been prepared in accordance with
the California Environmental Quality Act of 1970, as amended.

3. That the Environmental Review Coordinator is hereby
authorized and directed to file said Negative Declaration with the
County Clerk of the County of San Diego subsequent to the prepara-
tion of a notice of determination on this project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby approved the precise plan for
development of a 30-unit townhouse condominium project at the south-
west corner of Quintard Street and Tobias Drive in accordance with
Resolution No. PCM-78-6 of the Chula vista Planning Commission.

A. Environmental Settin
The project site involves 2.46 acres of vacant property located
at the southwest corner of Tobias and Quintard Sts. The .property
has been graded to some degree in the past. There is a general
lack of significant vegetation and wildlife. No historical or
prehistorical resources are known to be present.
There are no geologic hazards known to exist onsite, however,
Special Report 123, published by the Calif. Div. of Mines &
Geology indicates that an inferred fault is suspected of being
located to the north of the property. There are no major drainage
improvements onsite, a narrow east to west brow ditch traverses
the south portion of the property and was designed to transmit
runoff onto the adjoining acreage to the west. This facility
has not been maintained and a frunoff problem has resulted for
the properties to the south of the proposed project. (See Sec.
D of this Negative Declaration.)
B. Project Description
The applicant proposed the construction of five two story
structures that will house 30 two bedroom condominium units.
Onsite parking for 61 vehicles is planned as well as about .8
acres of common open space and approximately 400 sq. ft. of
private open space per unit.
An estimated 4000 cubic yards of earth will be excavated to
prepare pads and provide proper drainage. The applicant presently
proposes to grade the site to the southwest and direct surface
runoff to First Ave. via an underground storm drain. As drainage
easement and facilities will be required to transmit runoff
across the adjacent property to the west.
C. Compatibility with zoninG and laps
The project site is zoned R-3-P-12. The proposed plan is in
conformance with zoning but diviates somewhat from particular
precise plan guidelines setforth by the Planning Commission
(see PCA-76-K.). These aspects are of a planning nature rather
than an environmental concern and may be modified during precise
plan review.
The planned development is consistent with the intent of the
General Plan and recommended mitigation will insure conformance
with associated element of the plan.
D. Identification of Environmental Effects
Sewers
The proposed project is located within the Castle Park sewer
moratorium area where sewer capacity is limited to existing
development until downstream improvements have been completed
by the County. New construction is permitted, however, no
occupancy permits will be issued until adequate sewer capacity
becomes available.
Geology
The inferred Sweetwater fault suspected of traversing property to
the north may extend southward and project into the subject site.
No evidence substantiating surface faulting was discovered
during a geologic reconnaissance of the property to the north of
this site and further investigative studies are proposed.
Since the proposed development involves construction of residential
units a registered engineering geologist should be present during
grading to investigate potential subsurface displacement from the
inferred fault. If evidence of faulting is discovered, recommenda-
tions regarding dwelling location and construction techniques
should be incorporated into the development plan.
Drainage
Onsite drainage improvements currently consist of a concrete brow
ditch parelleling the southern property line. This facility
has not been maintained properly in the past which has resulted
in the flooding of adjacent southerly properties at lower
elevations during periods of heavy rain.
The applicant proposes to grade the project site so that surface
runoff will be directed into an underground storm drain and
disperse onto First Ave. An alternative plan has also been
discussed which would entail grading the site to direct surface
runoff onto Quintard St. Either plan would improve drainage and
alleviate the downstream flooding which has occured in the past.
Schools
The local elementary school is currently operating over capacity.
New students from the proposed project will further increase
current enrollment. Evidence of the developers compliance with
public facility; policies will be required to be submitted and
will insure adequate classroom space for new students.
A cumulative impact on all vicinity schools could occur in the
near future due to this and other non-related project approved
in this area. School districts policies relating to the
adjustment of boundaries and bussing of students to schools
with available space will mitigate this impact however, for the
time being.
Parks
The project is located within a city park district which lacks
any sizable parklands. A park is planned to be developed within
the San Diego Gas and Electric Companys easement south of Quintard
St. between Hilltop Dr. and First Ave. and will consist of 9.6
acres.
In addition, the applicant has indicated that about .8 acres of
the project will be devoted to common open space, including a
recreation area as well as an average of 400 sq. ft. of private
open space per unit.
Noise
A SWING noise analysis was conducted to determine if the proposed
dwellings would be subject to any unacceptable noise levels from
vehicle traffic. The analysis indicated that noise generating
from traffic on Quintard St. would reach an L of 64dB within
80 ft. south of the northern property line. ~ccording to SWING
guidelines conventional construction will reduce interior noise
levels by 15+dB and will generally be adequate in noise
exposure zones up to L of 65 dB. Considering the estimated L
level, siting of proposed dwellings in relation to Quintard St.dn
fencing of private open space and rear location of recreational
facilities, no substantial impact is anticipated to occur due
to noise generated by vehicle traffic.
E. Mitigation measures necessarv to avoid significant impacts.
1. A geologist be present during grading and any subsequent
recommendations due to faulting, be incorporated into the plan.
2. Developers must conform with the Public Facilities
Element of the General Plan.

1. The project site has been disturbed by past develop-
ment and is void of any significant vegetation or wildlife.
The inferred Sweetwater fault, if present on adjacent
property to the north, could project southwards into the
subject site. However, recommended mitigation stated in
Section E will insure conformance with the Seismic Safetv
element of the General Plan and will avoid any substantial
impact.
2. The proposed plan is in conformance with the Land Use
Element in the General Plan and will not achieve short term
to the disadvantage of long term environmental goals.
3. All potential impacts can be mitigated and none are
anticipated to interact to create any substantial adverse
effect on the environment.
4. Conventional construction is expected to reduce
interior intrusion of .exterior noise levels sufficiently
to achieve the required interior dwelling isolation level
of 45dBA. No significant increase vehicle traffic or
emissions is anticipated to occur.
