HomeMy WebLinkAboutReso 1978-9017RESOLUTION NO. 9017 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING ENCROACHMENT PERI`~IT #78-4, JAMES W. WATKINS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Director of Public Works has recommended that approval be granted by the City of Chula Vista to James W. Watkins, owner of Parcel "C" of Parcel Map 531 fronting on Palm Drive to allow encroachment of a private driveway into Lotl54 of Bonita Ridge Estates Unit No. 3 Subdivision for the installation of improve- ments of a private driveway giving access to applicant's property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the Director of Public Works be, and he is hereby authorized to approve said encroachment permit on behalf of the City of Chula Vista subject to the following conditions: 1. Tor. Watkins shall submit plans for approval by the City Engineer for the construction of the culvert pipe and driveway between his property and the 30 foot private drive. 2: The City Engineer has authority to revoke the encroachment permit upon thirty days notice to the owner of Parcel "C" of Parcel Map 531. 3. Encroachment permit shall remain in effect only as long as the Agreement between the owner of Parcel "C" of Parcel Map 531 and the owners of Lots 146 through 149 of Bonita Ridge Estates Unit No. 3 Subdivision remains in effect and is valid, a copy of which agreement is attached hereto. We, James W. Watkins and Patricia Ann Watkins, hereby agree and declare that in return for the use of the parcels described herein we shall share in the costs for maintenance and will be bound by paragraph 20 of those certain Declaration of Covenants, Conditions and Restrictions, recorded December 16, 1977 as File No. 521556 of Official Records, wherein the maintenance of the parcels shall be equally borne with the Grantees of the lots shown therein. This agreement is to run with the land and be appurtenant thereto, and it shall be binding upon the undersigned and all successors in interest thereto in relation to the easement described hereinabove.
