RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY
OF CHULA VISTA AND ANTHONY J. LETTIERI FOR
PROFESSIONAL CONSULTANT SERVICES FOR RANCHO DEL
REY SPECIFIC PLANNING AREA PLAN AND AUTHORIZING
THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby resolve as
follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chula Vista that that certain agreement between THE CITY OF CHULA VISTA, a
municipal corporation, and ANTHONY J. LETTIERI for professional consultant
services dated the 25th day of January , 198 9, a copy of which is
attached hereto and incorporated herein, the same as though fully set forth
herein be, and the same is hereby approved.~
BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be,
and he is hereby authorized and directed to execute said agreement for and on
behalf of the City of Chula Vista.

XZ, APPLICANT'$ SUBN[TTAL OF IqATERZALS:
APPL;CANT shall provtde such lnforNtlon as necessary, pursuant to
the heretn described scope of york for the CXTY and CONSULTANT, to
revte~ APPLICAXT's proposal, excepting therefree any busthess or
trade secrets or otherselse proprietary bustness Information held by
APPLZCANT.
XIZ. TIRe:
This agreecent shall becoee effective upon executlon as authorlzed
by the Fiay~t of the CITY, or hts destgnee, and shall tormtnate, tf
not tarstriated pursuant to the provisions contained heretnbelow tn
Paragraphs XVZ, XYZZ, or XYTIZ, or othervise extended by all
parties, on june 30, 1989, or upon adoptton of the SPA Z! Plan by
t~e Chula Vista Ct~ Council b~t no later than December 21, 1989.
X Z Z Z. COHPENSATZON:
The compensation .to be paid by CZTY to CONSULTAInt shall be $85.00 .'
per hour for each hour ~rked, CONSULTANT. shall submit eonthly
tnvotces to the Finance Director of the CZTY which shall be due and
payable wtthtn 30 da~ys. The APPLZCANT agrees to pay the CZTY .upon
demand the total sue billed by the CONSISTANT each month for the
duration of thls agreement. Ilot~lthstandlng the above payment
schedule, all morttea shall be due and payable wlthtn 30 d~ys of
tnvotce, except as provided for heretnbelo~ wtth respect to
cancel 1 atton at the convenience of CZTY or for reasons of
nonperformance.
XTV. CTTY ADN:[NZSTRATIYE OVERHF.~J):
Pursuant to this agreement, CiTY shall be entttled to clatm as an
offset to the ceepensatton schedule set forth heretnabove in
Paragraph XZIZ seven percent (7/,) of said funds as CONSULTANT has
authorized as CZTY's administrative overhead incurred in the
administration of this agreement.
XY. ZI(TE:REST OF CONSULTANT:
CONSULTANT presently has and shall acquire no interest whatsoever
tn the Rancho De1 Ray project, the subject matter of thts
agreesent, direct or indirect, whtch would constitute a confllct of
tntarest or gfve the appearance of such conflict. No person having :
any such conflict of tnteres'~ shall be eeployed or retained by
CONSUT. TANT under this agreecent. CONSULTANT specifically certifies
that neither CONSULTANT nor any other person employed or ratatried
by CONSULTANT ts perforcing work for or on behalf of EL RANCHO DEL
RE:Y PARTNERSHTP, or its predecessor tn Interest. CONSULTANT
specifically certifies, tn addition, that no preetse of future
employment or other consideration of any ktnd has been made to ,, ....
CONSULTANT or any employee, agent, or representative of CONSULTANT,,
by the APPLZCANT, any eeployee, agent, or representative of the
APPLZCANT, regarding t~e subject matter of this agreeeent, or sny
