HomeMy WebLinkAboutReso 1978-9007~.- . , RESOLUTION NO. 9007 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING TENTATIVE SUBDIVISION MAP FOR CASA DEL REY The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Ralph Monsees wishes to receive approval of a tentative subdivision map known as Casa del Rey to be located north of Telegraph Canyon Road and easterly of Paseo Ladera, and WHEREAS, said project consists of a proposed 220 lot single family subdivision on 68 acres, and WHEREAS, Ralph Monsees selected Toups Corporation from the list of environmental consultants found by the City of Chula Vista to be quali- fied for the preparation of environmental impact reports, and WHEREAS, Toups Corporation prepared an application for an Environ- mental Impact Report and submitted it to the City of Chula Vista Planning Department for the preparation of a draft Environmental Impact Report, and WHEREAS, after independent review and analysis of said application, the Environmental Review Committee of the City of Chula Vista issued a draft Environmental Impact Report on said project, giving legal notice of the avail- ability of said draft Environmental Impact Report and filing a notice of completion with the Secretary of Resources for the State of California, and WHEREAS, the Planning Commission of the City of Chula Vista held a public hearing on said draft Environmental Imn_act Report and adopted a final Environmental Impact Report, and WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as Casa del Rey and has recommended that the City Council approve said tentative map subject to the conditions of their Resolution No. PCS-77-9, adopted on the 25th day of January, 1978, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby certify that EIR-78-5 has been reviewed and the information considered, and that it has been prepared in accor- dance with the California Environmental Quality Act of 1970, as amended, the California Administrative Code and the Environmental Review Policy of the City of Chula Vista. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby approve the tentative map for Casa del Rey in accordance with the recommendations of the Planning Commission of the City of Chula Vista. PCS-77-9 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP KNOWN AS CASA DEL REY WHEREAS, Ralph G. Monsees submitted a tentative subdivision map to subdivide~68 acres into 220 single family residential lots, 2 open space lots, and 7 lots reserved for future residential use, to be known as Casa del Rey, and WHEREAS, Section 66473-5 of the Government Code provides that approval of a subdivision map shall be based upon findings of consistency between the subdivision map and the adopted General Plan of the local jurisdiction, and WHEREAS, the Planning Commission set the time and place fora public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., January 25, 1978 in the Council Chamber, City Hall, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the environmental impact report, EIR-78-5, relating to this project was adopted and certified by the Planning Commission on January 25, 1978. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: A. From the facts presented to the Planning Commission, the Commission finds that the subdivision map known as Casa del Rey is consistent with the General Plan for the City of Chula Vista as follows: 1. Land Use Element - consistent. The General Plan designates this area for medium density residential (4-12 dwelling units per gross acre). The proposed density of this project of 3.2 dwelling units per acre is therefore consistent with this designation. 2. Circulation Element - consistent. The extension of Pasdo Ladera and the proposed widening of Telegraph Canyon Road, as well as the interior street. system, is consistent with the General Plan. 3 . Housing Element - consistent. The project will provide decent housing in a well ordered residential neighborhood and has had an affirmative Fair Housing Marketing Plan approved by F.H.A. Due to land and improvement costs, the anticipated price range of the homes will be out of reach of the low and moderate income families. The developer has explored the available programs and finds that there is no government subsidy program which would enable the low and moderate income families to purchase a home within this development. ~. Conservation, Open Space, Parks and Recreation Elements - consistent. The Conservation Element diagram does not incidate any natural resources on the site. Approximately 17 acres on the southerly portion of the site will remain in open space. A 5 acre park site adjacent to the proposed school site to the east is shown. The location and acreage are consistent with the Parks and Recreation Element. 5. Seismic Safety and Safety Elements -consistent. The developer has submitted a geological report in conformance with the requirements of the Seismic Safety Element. The inferred fault traces in the area have not been found on the site; therefore, development may occur as indicated. The extension of public improvements, drainage, street widths and turnarounds meet or exceed the standards of the Safety Element. 6'. Noise Element - consistent. The Environmental Impact Report on this project has indicated that the noise levels anticipated on Telegraph Canyon Road are insignificant. The proposed landscaping and, walls will further reduce the impact of any significant noise levels.. 7. Scenic Highways Element - consistent, The developer has submitted a proposal for the beautification of the portion of the development adjacent to Telegraph Canyon Road. A 35 foot building setback is required on East "J" Street which is also designated as a scenic route. The increase in setback will assist in providing the opportunity fora pleasing street- scape on Ease "J" Street. B, Bicycle Routes Element - consistent. A bicycle lane will be provided on Telegraph Canyon Road. The right-of-way and typical street sections for Paseo Ladera and East "J" Street provide for bicycle lanes on both streets. 9. Public Buildings Element - consistent. Public buildings are neither proposed nor required on the project site. B. The Planning Commission recommends to the City Council that ,tentative map PCS-77-9 for Casa del Rey be appraoved, subject to the following conditions: 1.. Note 12 on--the map shall be revised to include lots 179 and 66. ~. The development standards shall be revised as follows: (a) Paragraph 7B shaT~`be revised to note that the front setback of lots fronting on East "J" Street shall be a minimum of 35 feet. -2- (b) Add to paragraph 13D, subparagraph 4, the following language: ". except for fencing or walls adjacent to open space areas, which shall not be permitted an increase in height." (c) The 15 foot front yard chart shall also indicate the exception for lots fronting East "J"'Street as a 35 ft. minimum. ~3. The top of the slope bank along Paseo Ladera and Paseo "A" shall be located a minimum distance of 10 feet from the edge of the sidewalk, or a split rail fence shall be constructed in accordance with city standards. 4. The designated open space lots shall be dedicated to the city or a homeowner's association formed to handle the maintenance thereof. In the event of dedication, the developer shall request the formation of an open space maintenance district. 5. The developer shall be responsible for landscaping the median in Telegraph Canyon Road and all slope banks in accordance with the following criteria: (a) The street trees designated for Telegraph Canyon Road are Eucalyptus species. Piror to planting the applicant shall verify the exact species with the Public Works Department Street Tree Division. (~) The landscaping in the drainage channel is to consist of native drought tolerant ground cover and shrubs. The dominant trees are designated as Eucalpytus species. It is the intent to establish the drainage channel and allow the landscaping to naturalize. The hydromulch mixes for the drainage channel shall conform to the "Telegraph Canyon Road and Channel Design Report," dated Parch 1977. Refer to Appendix B, (c) Open space slope areas unaffected by .construction operations shall be left in their natural condition. One-gallon trees shall be added in a "grove" design at natural canyon areas and provided with irrigation until they are established. (d) Open, space slope areas which are denuded or created by construction shall be planted with Type II plantings in conformance with the Landscape Manual ~rrrd the Grading Ordinance. Type II planting shall be irrigated with an automatic irrigation system. -3- (e) In consideration of the Scenic Highway Element, tree types should be limited to Schinis Molle (California Pepper), Eucalyptus species, and Platanus racemosa (California Sycamore) and should be planted in significant groves of one type rather than a random mixing of types. Generally, California peppers should be used on the Telegraph Canyon floor except at the drainage channel. Eucalyptus species should be used dominantly on slope areas and the California Sycamores should be grouped within the small canyon drain-off areas. Type II shrub plantings should be heavily massed at all critical slope areas with the intent that the shrub planting shall eventually create a mass shrub ground cover. (f) All open space landscaped slope areas shall be maintained fora period of one year commencing from the time of approval of the installation by the City Landscape Architect. (g) All temporary offsite slope banks and Phase II construction area shall be planted for erosion control with temporary irrigation for establishment. (h) Individual homeowner lot landscaped slope areas should conform to the Landscape Manual and Grading Ordinance. Ground cover should be ornamental in nature (e.g. Delosperma alba) with drought tolerant trees and shrubs as required. These slope areas shall be maintained for 90 consecutive 'days from the day of approval of the installation unless a maintenance release form signature is obtained from the homeowner. 6. The following street tree requirements shall be met: (a) One 15 gallon tree shall be installed for each lot, with two trees required for each corner lot. The trees shall be staked in accordance with Public Works Department standards and the type of tree will be designated by the Street Tree Superintendent. (b) The developer shall inform the homeowner that a street tree shall be planted within the street tree right-of-way as re- quired by the City of Chula Vista and that the tree may not be removed or relocated by the homeowner, (c) Upon completion of installation all street trees must be inspected and approved by the Street Tree Superintendent. 7. Nt the time of purchase, the developer shall provide the hom?- owner with an information pamphlet containing information on the following: (a) Landscape slope maintenance requirements and the mainten- ance release form in the event the homeowner elects to maintain the slope. (b) City street tree requirements. (c) General description of the types of plant materials used on all slope areas including a brief description of routine maintenance requirements for materials on homeowner's slopes. 8. Fire flow shall be 1,000 g.p.m. for two hours duration. If wood shingles are used for roof covering fire flow shall be 1,500 g.p.m. for two hours duration. Fire flow shall be minimum for 20 p.s.i. residual pressure measured in the main from which the flow is taken at the time of the measurement. 9. A total of 17 fire hydrants will be required. Each hydrant shall have one 212" outlet and one 4" outlet. Installation shall be in accordance with standard specifications. All water supplies for fire protection, including fire hydrants, shall be installed in operable condition, and access roads shall be provided and maintained, prior to any combustible construction being commenced on site.. 10. Prior to City Council action on the final map, the developer shall: a Com 1 with Cit Ordinance #1668 re ardin ark fees and () PY Y 9 9P City Ordinance #1783 on school fees. (b) File a copy of the CC&R's which shall stipulate the prohibition of the installation of TV and radio antennas in accordance with Section 15.32.030 of the Municipal Code. CC&R's shall reference the fact that all development occurring with the subdivision shall conform to the 'recorded development standards on file with the City. 11. The developer shall be responsible for the distribution of the development standards to each home purchaser. 12. The developer shal'I~be required to install the block wall facing Telegraph Canyon Road and on all corner lots in accordance with the designs submitted as part of the development standards. 13. An engineering geologist and soils engineer shall be present during grading operations. 14. The barrel cacti shall be transplanted to an appropriate location within the designated open space areas. 15. Prior to the commencement of any earthwork, a surface collection of the site shall be performed to determine if any archaeological resources are located thereon. Any artifacts recovered ;s hall be cataloged and analyzed and a letter report prepared to the satisfac- tion of the City of Chula Vista. 16. The developer shall fully improve Telegraph Canyon Road from Paseo Ladera to the section line between quarter sections 41 and 64. Improve- ments that the developer shall construct will consist of, but not be limited to, a 16 foot median island with curbs, 60 feet of pavement to provide two travel lanes and a bike lane in each direction, AC berms, street lights and drainage facilities. The developer shall be required to acquire all offsite right-of-way to provide a total of 126 feet of right-of-way for Telegraph Canyon Road. The developer shall be required to acquire a minimum of 40 feet of right-of-way south of the ultimate centerline for Telegraph Canyon Road. The ultimate southerly half of Telegraph Canyon Road lies partially within the existing 60 feet of right-of-way. 17. The developer shall construct the east half of Paseo Ladera from Telegraph Canyon Road to the northerly right-of-way line of Sesame Street. This portion of Paseo Ladera shall be consistent with the typical section for a collector street per Chula Vista', Standard Drawing No. 101-A. The construction of Paseo Ladera shall include the construction of the major drainage facility beneath Paseo Ladera. The typical section for Paseo Ladera from Sesame Street to Paseo "A" Street shall consist of 50 feet_of pavement curb-to-curb with- in 66 feet of right-of-way. From Sesame Street to Paseo Entrada, the developer shall construct the easterly half of Paseo Ladera plus 8 feet of pavement west of centerline including an AC berm. Improve- ments shall consist of, but not be limited to, curb and gutter, side- walk, pavement, .street lights and drainage facilities. The developer shall be required to acquire all offsite right-of-way for Paseo Ladera. The developer shall acquire 43 feet of right-of-way for Paseo Ladera, including slope rights, to do the grading. 18. From Paseo Ladera to the westerly subdivision boundary, the developer shall be responsible for construcing ultimate improvements in Paseo Entrada consisting of curb and gutter, sidewalk, 2812 feet of pavement, street lights and drainage facilities. The developer shall ' be responsible for acquiring the offsite right-of-way for Paseo Entrada between Paseo Ladera and the westerly subdivision boundary. The developer shall acquire 40 feet of right-of-way for the offsite portion of Paseo Entrada and slope rights for grading. If the property lying north of Paseo Entrada and between the westerly boundary of the subdivision and Paseo Ladera cannot be developed because of presence of fault trace, then the developer will be responsible for constructing the entire typical section for Paseo Entrada and Paseo Ladera from Paseo Entrada to the extension of the side property line between Lots 5 and 6 with ultimate improvements. 19. The developer shall be responsible for improving East "J" Street from the westerly boundary of the subdivision on East "J" Street to the westerly right-of-way line of Paseo Ranchero. The typical street section for East "J" Street shall be the same as that specified in condition No. 17 for Paseo Ladera north of Sesame Street. The developer shall install the same improvements and acquire the same right-of-way as required in condition No. 17 for Paseo Ladera. 20. The developer shall construct temporary cul-de-sacs at the easterly terminus of Paseo Entrada, the westerly terminus of Palseo La Cresta, the westerly terminus of Paseo Del Norte and at the northerly terminus of Paseo Marguerita in accordance with City Council Policy 600-1. 21. The various sizes of storm drain facilities shown on the map are subject to the approval of the Director of Public Works. 22. The developer shall be responsible for constructing the grass lined channel from Paseo Ladera to the boundary between sections 41 and 64. The typical section for the grass lined drainage channel shall conform to the preliminary plans and report on file in the office of the City Engineer. The manner and method of handling drainage shall be subject to approval.~y the City Engineer prior to approval of the final map. 23. The developer shall be responsible for acquiring all offsite right- of-way for the major Telegraph Canyon drainage channel. A portion of all offsite right-of-way costs may be reimbursable under a reimburse- ment district proceeding. The developer shall be responsible for 100% of the cost for constructing the major drainage channel and the balance of the cost of right-of-way for the channel in excess of the City's participation., 24. Sewer mains shall be extended to the subdivision boundary in Paseo Entrada, Del Norte and P~1arguerita Streets and East "J" Street. Paved access shall be provided to all offsite sewer manholes. 25, The developer shall be responsible for the payment of all sewer assessment and sewer connection charges prior to the approval of the final map, 26, Letters of permission shall be obtained from adjacent property owners approving the location of offsite drainage channels and brow ditches. 27, The developer shall be responsible for obtaining permission from adjacent property owners for any grading which occurs offsite and outside of the subdivision boundary. 28. If an Open Space Maintenance District is to be formed to provide for maintenance of the open space areas, this district shall be formed prior to or concurrent with approval of the final map. 29. The developer may request the formation of a reimbursement district to reimburse him for any improvements which benefit other properties than those parcels within the boundaries of the subdivision map, Formation of the reimbursement district shall be in accordance with the Chula Vista Municipal Code. The developer may be required to pay reimbursement fees as provided for in the Chula Vista Municipal Code. 30. The 5 acre area at the northeast corner of the tract shall be reserved fora park site fora period of time extending to the time of approval of a final map by the City Council. If the Council decides to purchase the park site, the City will participate in the cost of extending Ease "J" Street across the frontage of the park, If the Council should decide not to purchase the park site, the lot pattern and street System shown on the tentative map shall be deemed to be approved. y 31. Any existing overhead utilities lying within the subdivision boundary or those areas requiring offsite improvements shall be undergrounded. Undergrounding shall be in accordance with the Chula Vista Municipal Code. 32. The developer shall comply with all applicable sections of the Chula Vista Municipal Code in effect at the time the tentative map is approved by the City Council. The final map and all improvement plans shall be done in accordance with the City of Chula Vista's standard specifications, standard drawings and the Chula Vista Sub- division Manual. 33. The developer shall be responsible for paying his proportionate share for the installation of a traffic signal at the intersection of Paseo Ladera and Telegraph Canyon Road. 34, A reimbursement district is being established for Telegraph Canyon Road improvements. The developer shall waive his right to pro- test the formation of a district. The developer shall receive credit against his assessment for those improvements he constructs in Telegraph Canyon Road and which benefit other properties. C. That this resolution be transmitted, along with the Tentative Map, to the City Council, and a copy of this resolution be transmitted to the applicant.
