RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA GRANTING CERTAIN EASEMENTS FOR
UTILITY PURPOSES TO THE SAN DIEGO GAS AND
ELECTRIC COMPANY AND AUTHORIZING THE MAYOR TO
EXECUTE SAID EASEMENT DOCUMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, as a result of the proposed widening of Otay
Lakes Road from Camino del Cerro Grande to Canyon Drive/Ridgeback
Road, San Diego Gas and Electric Company will be relocating their
overhead 69 kilovolt transmission line which is located adjacent
to the existing roadway, and
WHEREAS, SDG&E has requested that the City grant
easements for the placement of overhead electrical lines, power
poles and supporting guy wires.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby grant easments for utility
purposes to the San Diego Gas and Electric Company as set forth
in Exhibit "A", attached hereto and incorporated herein by
reference as if set forth in full.'~
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized to execute said
easement documents for and on behalf of the City of Chula Vista.

The property in which said easement and right of way is hereby granted is
described as follows:
Parcel 1:
Lot L of Chula Vista Tract No. 86-3, Bonita Long Canyon Unit No. 4 ~n
the City of Chula Vista, County of San Diego, State of California, according to
map thereof No. 11947, filed in the Office of the County Recorder of San Diego
County on November 4, 1987.
Parcel 2:
Lot A of Chula Vista Tract 87-1, in the City of Chula Vista, County
of San Diego, State of California, according the map thereof No. 11953, filed
in the Office of the County Recorder of San Diego County, November 16, 1987;

together with that former portion of Otay Lakes Road, to be vacated and closed
by operation of the law and reverting to said Lot A.
Parcel 3:
Lot 75 of Bonita Ridge Estates Unit Number 1, in the City of Chula
Vista, County of San Diego, State of California, according to map thereof No.
8044, filed in the Office of the County Recorder of San Diego County,
California, November 29, 1974; together with that former portion of Otay Lakes
Road, to be vacated and closed by operation of the law and reverting to said
Lot 75.
Parcel 4:
Lot 217 of Bonita Ridge Estates Unit No. 4, in the City of Chula
Vista, County of San Diego, State of California according to the map thereof
No. 8370, filed in the Office of the County Recorder of said County on August
26, 1976; together with that former portion of Otay Lakes Road, to be vacated
and closed by operation of the law and reverting to said Lot 217.
The said easement in the aforesaid lands shall be more particularly
described as follows in Parcels "A" And "B" below:
Parcel "A"
That certain strip of land 20.00 feet in width, the centerline of
which is described as follows:
Commencing at the Northwest corner of Quarter Section 18 of Rancho De
La Nacion, according to map thereof No. 166, filed in said County Recorder's
Office; said Northwest Corner also being shown and delineated on Record of
Survey Map No. 10898, filed in said County Recorder's Office; thence along the
Westerly line of said Quarter Section 18, South 17°'53' 49" East, 74.35 feet;
thence South 51° 01' 11" East, 31.37 feet; thence South 38° 35' 12" East,
204.13 feet; thence South 49° 27' 36" East, 297.57 feet to the TRUE POINT OF
BEGINNING of the centerline herein described; thence South 29° 28' 40" East,
288.17 feet.
Parcel "B":
Those certain strips of land 6.00 feet in width, the centerlines of
which are described as follows:
Commencing at said Northwest corner of Quarter Section 18; thence
along the Westerly line thereof, South 17° 53' 49" East, 74.35 feet; thence
North 51° 01' 11" West, 268.14 feet to a point herein designated Point "A";
thence North 70° 02' 51" West, 468.87 feet to a point herein designated Point
"B"; thence North 83° 57' 59" West, 488.36 feet; thence North 79° 09' 16" West,
1554.63 feet; thence North 58° 43' 16" West, 293.00 feet; thence North 53° 07'
05" West, 455.53 feet to a point on the Southerly line of Parcel 2 of Parcel
Map No. 2300, filed January 29,11974 at File No. 74-023625 in said County
Recorder's Office; distant thereon North 72° 14' 21" East, (Rec. North 71° 50'
12" East), 182.00 feet from the most Southerly corner thereof; thence
continuing North 53° 07' 05" West, 324.47 feet; thence North 58° 25' 19" West,

449.07 feet to a point herein designated Point "C"; thence North 77° 57' 03"
West, 383.04 feet to the True Point of Beginning of the centerline herein
described thence North 06° 34' 49" East, 150.00 feet.
ALSO: Beginning at said Point "A"; thence North 29° 27' 59" East,
190.00 feet.
ALSO: Beginning at said Point "B"; thence North 12° 59' 35" East,
170.00 feet.
ALSO: Beginning at said Point "C"; thence North 21° 48' 49" East,
160.00 feet.
EXCEPTING from said Parcels "A" and "B" any portion lying within Otay
Lakes Road.
After construction is c~mpleted~ Grantee shall restore the premises to the
same or as good a condition as that which existed prior to the exercise by Grantee
of its rights hereunder. Such restoration shall be done in a manner satisfactory to
Grantor.
Grantor shall not dig or drill any well, plant any tree, erect~ place or
construct any building or other structure, nor impound or store fluids within the
boundaries of this easement and right of way.
Grantor shall not increase or decrease the ground surface elevations
within the boundaries of this easement and right of way without written consent of
Grantee.
Grantee shall have the right to erect, maintain and use gates in all
fences which now cross or may hereafter be permitted to cross this easement and
right of way.
Grantee shall have the right, but not the duty, to trim or remove trees,
brush, roots or material from this easement and right of way whenever Grantee deems
it necessary. Said right shall not relieve Gra~tor of the duty as owner to trim or
remove trees, brush or material to prevent danger or hazard to property or persons.
Grantee covenants for itself, its successors and assigns that should
Grantee discontinue use of this easement for the purposes set forth herein, then all
rights granted in this easement shall terminate and Grantee, upon receipt of written
request, shall execute and deliver to Grantor a good and sufficient Quitclaim Deed
to all rights herein granted.

The terms, covenants and conditions of this easement and right of way
shall be binding upon and inure to the benefit of any heirs, successors, executors,
administrators, permittees, licensees, agents or assigns of Grantor and the
successors and assigns of Grantee.
